September 19: Application Deadline - Washington Leadership Institute (WLI) - Apply Now!

The mission of the Washington Leadership Institute ("WLI") is to recruit and train diverse and underrepresented lawyers for future leadership within the legal and bar community.
Starting August 18, 2014, the WLI will begin accepting applications for the incoming 2014-2015 class of Fellows. All required application materials must be received at the UW Law office no later than September 19, 2014, at 5:00 p.m.
This is an exceptional opportunity for professional development and for discovering a vehicle to becoming involved with the Bar and legal community:
  • Twelve attorneys, in practice for at least three years and not more than ten years, will be carefully selected for the tenth year of the program. 
  • The eight professional development seminars run from January to August 2015. 
  • Upon successful completion, Fellows will earn a significant number of CLE credits.

September 18: Cleveland - The Regulation of Care Work: Past Pitfalls, Present Trends, and Future Promises

As the population continues to age rapidly, the social and economic costs of elder care have skyrocketed and governments are struggling to ensure adequate care while at the same time containing the cost of care. Although family members provide the majority of elder care on an informal, unpaid basis, the last decade has seen a dramatic growth in the use of paid home-care services. Home care, when compared with institutional care, offers a more cost-effective response to the growing demand for elder care and it also responds to the desire of most elderly individuals to age in place within their own homes. Despite its growing importance, however, home care remains an economically marginalized job characterized by harsh working conditions including low pay, few benefits, job insecurity, and health and safety hazards. The lecture will consider the legal constraints associated with home care work, and will highlight local, national, and international strategies to address these concerns.

Donaldson, Professor of Law, Georgia State University - Atlanta, Georgia Prior to joining the Georgia State faculty in 2012, he was on the faculty at the University of Washington School of Law for 13 years. During his tenure at the University of Washington, he was a five-time recipient of the Philip A. Trautman Professor of the Year award from the School of Law’s Student Bar Association. Professor Donaldson served for two years as Associate Dean for Academic Administration and for six years as the Director of the law school’s Graduate Program in Taxation. He teaches a number of tax and estate planning courses, as well as courses in the areas of property, commercial law and professional responsibility.
  • Professor Donaldson is an Academic Fellow of the American College of Trust and Estate Counsel (ACTEC) and a member of the Bar in Washington, Oregon, and Arizona. Among his scholarly works, he is a co-author of the West casebook, Federal Income Tax: A Contemporary Approach, and a co-author of the Price on Contemporary Estate Planning treatise published by CCH. Professor Donaldson has served as the Harry R. September 17: San Francisco - Introduction To Family Law Training

Our Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by JDC’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. If the first casualty of war is truth, civil liberties are second. Panic leads the way, with such examples as the internment of American citizens of Japanese descent during World War II and McCarthyism purges during the Cold War. The reaction to 9-11 has threatened civil liberties in a potentially much more dangerous way. The government is keeping records of everything we do digitally, even on admittedly rare occasion listening to our phone calls. A National Surveillance State has been created. Even just walking on the street is often recorded. The dangers are obvious. Americans are losing their privacy as the government to an unprecedented extent is monitoring communications and recording in public, seemingly in perpetuity. The ramifications just cannot be understated and simply put, it is the hottest issue in the country.

Roger Newman is the author of "Hugo Black: A Biography," a work that won the Scribes Book Award and was a finalist for the Pulitzer Prize in biography. He also co-authored "Banned Films: Movies, Censors and the First Amendment," and was editor-in-chief of "The Constitution and Its Amendments.” Newman taught for seven years as an adjunct professor at the Columbia University Graduate School of Journalism and is currently working on a book on the Supreme Court against the backdrop of the conservative movement over the past forty years.

September 10: Cleveland - Military Justice and Article III

The Supreme Court has long held that federal adjudication before judges lacking Article III’s salary and tenure protections is permissible today only in the three categories of cases in which the Court has previously allowed it — all cases before federal “territorial” courts; criminal prosecutions before military tribunals; and “public rights” adjudication before non-Article III judicial or administrative bodies. And although the Justices have repeatedly grappled with the outer bounds of this last category in recent years, they have generally accepted the first two as settled. Scholars have followed suit, with virtually all of the extensive literature in the field focusing on the specific scope of the public rights exception, or on the search for cross-cutting theories of Article III.
As a result, it has been decades since any concerted effort has been undertaken to rationalize the scope of the military exception — whether to the Constitution’s text or purpose or to more prudential considerations. And although the similarly neglected territorial courts have remained largely untouched over the past quarter-century, the same period has witnessed significant expansions in the scope of both court-martial and military commission jurisdiction to encompass offenses and offenders not previously thought to be amenable to military, rather than civilian, trials. Although these expansions have been especially pronounced with regard to the scope of court-martial jurisdiction, they are also reflected in, for example, the en banc D.C. Circuit’s 2014 decision in the Al Bahlul Guantánamo military commission appeal. Given these expansions, the litigation that they have provoked, and the tensions they have placed upon the military exception, the time has long since passed for a reassessment of where and how military justice fits into our understanding of Article III.

His teaching and research focus on federal jurisdiction, constitutional law, national security law, and international criminal law. September 17: Cleveland - Is Economic Development Really Charity?: Evaluating "Trickle Down Charity"

As our nation's philanthropic sector becomes more entrepreneurial, ambitious and influenced by the private sector, longstanding legal standards on what constitutes "charity" struggle to stay relevant. More and more often, organizations that seek classification by the Internal Revenue Service as a Section 501(c)(3) charity (and the substantial public subsidy that this status unlocks) are not the soup kitchens and homeless shelters of yesteryear, but highly sophisticated ventures that accomplish their missions in ways that are less obviously charitable.
In no case is this more true than in the recent widespread emergence of nonprofit organizations whose primary activity is providing direct aid to for-profit businesses. These organizations invest in privately-owned, profit-seeking ventures hoping that some day this aid will help those in need in the form of jobs and a flourishing economy. While influential and, in some cases, transformative to cities and regions in economic distress, this form of charity (which I term “trickle down charity”) turns the traditional charitable services delivery model on its head by advancing private interests first and betting that benefit to a charitable class will follow.
This lecture will discuss the analytic challenges that trickle down charity poses to the IRS when it determines whether an organization like this merits 501(c)(3) status and my proposal for how the IRS can enliven its private benefit doctrine to more effectively regulate trickle down charity and help protect the overall integrity of our philanthropic sector.

September 10: Webcast - #Bankruptcy Basics for Low-Income Clients #MCLE

Although the recession is beginning to even out and foreclosures in many parts of the country are in the decline, the recession continues to affect financially marginalized people in disproportionate numbers. Many debtors are unrepresented and bankruptcy clinics are still in great demand. There is a critical need for pro bono attorneys to assist low-income clients at all levels. The practice of bankruptcy law changed dramatically with the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). The implications of BAPCPA continue to develop in the Courts, all the way up to the Supreme Court. In the meantime the practice is ever changing and can be quite complicated with even the simplest form of bankruptcy, Chapter 7. This program was developed for brand new practitioners and those who are either not familiar with the practice or have not practiced bankruptcy law since the passage of BAPCPA. The program will focus on Chapter 7 bankruptcy, from the day a new client walks into your office to the day you receive notice that they have successfully received a discharge and their case is closed.

  • An overview of Chapter 7 bankruptcy including legal sources, jurisdiction, venue, eligibility and the parties
  • Your duties as a bankruptcy attorney and debt relief agency, how to evaluate and interview a client, how to choose between a Chapter 7 or Chapter 13, and your responsibilities of investigation (due diligence)

There are over 42,000 homeowner associations (HOAs) in California alone. An estimated 8.6 million California homeowners are members. It seems likely that this number will increase substantially in the coming years. There are extensive legal requirements governing how an HOA may operate with respect to its treatment of individual homeowners, yet many homeowners find that those laws are not being followed, and HOAs do not always get the legal advice that they need in order to operate correctly or address other problems the HOA may be having as a whole.
