June 13/NYC: Insurance Premiums for Protection: A Guide to Getting Paid by Your Insurer

Does reading insurance policies make your eyes hurt?  Has an insurer ever denied your company’s claim?  It's just a fact that insurance companies cannot make money if they pay too many claims.  Matt Bryant of Ohrenstein & Brown, LLP will prepare you to engage insurers who seem to hold all the cards when the chips are down.
This CLE is specifically created for the in-house attorney and will provide a crash course of insurance coverage, rights, duties and liabilities.  We will examine the alphabet soup of insurance policies such EPL, E&O, D&O, CGL, CP, MPL and others, and the types of claims they are “supposed” to cover.  Do you have a broker or an agent? Do you know what are “supposed to do”?  We will cover the law of insurance ABC: Agents, Brokers and Consultants and break out who is supposed to do what for you and what you are always supposed to do for yourself.
Can you tell if your insurer has properly denied coverage or reserved it rights?  Matt will show you the secret to reading insurance policies quickly and easily and explain what your rights are when the insurer accepts the claim subject to a reservation of rights.
Finally, we’ll take a look at the world of first party insurance litigation or DJ actions in the tri-state area to examine common claims and defenses and when you may be able to recover damages above the limit or your policy.

Selected Issues for In-House & Outside Counsel - On-Demand #MCLE

Keep up with the latest issues affecting in-house and outside counsel with this program that compiles multiple presentations given at the Network for Trial Law Firm's quarterly conference. This program consists of the following presentations:

  • Defending Product and Service Providers Overseas: As U.S. companies expand their global footprints, conduct in other countries can lead to litigation here. Manufacturing processes and incidents occurring in foreign countries, violations of foreign standards and documents generated by overseas affiliates can become fodder for, if not the centerpiece of, claims brought in the United States. Trial lawyer Joe Krasovec presents strategies and tactics to increase the likelihood that what happens overseas stays there.
  • Manage Your Case From Product Failure Through Trial: Trial lawyer Cooper Ashley completed a 2-week federal jury trial recovering more than $1M as a result of damage to product caused by an outside vendor. Consider how you would manage the investigation, testing, recall, customer communications and trial of a product failure case.
  • Strategic Pointers for Non-Compete & Trade Secret Litigation: Employees and executives changing jobs can put their companies on one side or the other of non-compete and trade secret disputes and suits. Trial lawyer Steve Fogg has litigated these cases from both sides of the fence. He shares strategic insights to achieve your goals, whether as plaintiff or defendant.

Cooper's practice is focused primarily on products liability matters on behalf of both plaintiffs and defendants and complex class action and tort cases, including environmental toxic tort and fire/explosion cases. Medical Marijuana: Unanticipated Legal Consequences and the Lessons Learned - On-Demand #MCLE

California legalized the use of medical marijuana over a decade ago, and since then 18 states and the District of Columbia have followed suit. State medical marijuana laws differ in the political processes for enactment (state legislature vs. ballot-initiative); statutory protections from criminal sanctions; and drug access (e.g., no legalized access, state regulated dispensaries, home cultivation, or access through designated caregivers). Public health officials are concerned with a variety of unanticipated legal and ethical consequences of the laws, including problems with operating statewide registry and licensing programs, unregulated marijuana dispensaries, lack of employment or disability protection for medical marijuana users, and inappropriate physician recommendations for medical marijuana use. Over time, states have developed new regulations, policies, and amended laws to resolve some problems. Other issues, such as lack of disability protection, cannot be resolved due conflicting federal drug laws, and remain serious barriers for patients.
This is a recording of a webinar addressing implementation issues and unanticipated legal, ethical and public health problems with various state medical marijuana laws; provide insights and information about ways state public health officials and attorneys have addressed problems; and provide guidance for states considering medical marijuana legislation or states with existing laws that may be dealing with similar issues. Panelists for this webinar represent state governments and non-profit organizations that have experienced unanticipated public health consequences of legalizing marijuana.

June 28/San Francisco+Web: End-of-Life Planning for the Low-Income Client #MCLE

End of Life Planning is, like Death and Taxes, one of those things that can go from an easy, informative and straightforward conversation to a drawn-out nightmare if ignored. Low income and very low-income clients, unlike the average middle class client, frequently do not understand the importance of, for example, having identified caretakers for their minor children in place. They frequently resort to “no planning” or improvised planning which does not take into account that, for example, transferring the title on a car or house does not address the issue of the mortgage or other lien. Because their day-to-day issues are so difficult, they frequently have difficulty making the time, and have no money to seek professional advice, on these issues. This program will explain appropriate planning techniques for medical, financial and personal issues, while providing an understanding of the medical framework in which medical advance planning operates. The program is being presented by two legal providers who bring a wealth of experience dealing with end-of-life issues of the low-income client, as well as one medical provider who will discuss how medical advance planning is being taught today.
What you will learn
After this program you will be able to interview and prepare a plan for the low-income client that includes a discussion of and preparation of the Advance Health Care Directive, Power of Attorney, Will and advise on other end-of-life planning techniques. You will also understand the medical view of advance planning for end-of-life, the differences between palliative and hospice care, and the intersection of the two approaches.
Who should attend
Attorneys assisting pro bono clients with end of life planning matters through representation or in a variety of clinical settings, including medical-legal partnerships, senior services collaboratives, family-focused legal services opportunities, and other pro bono programs. In addition, the presentation may be of interest to firm pro bono coordinators and partners, corporate law department pro bono managers, law clinic students and faculty, public interest and non-profit organization attorneys and staff.

June 14/Chicago: When a Company Sues Itself: The Mechanics of the Shareholder Derivative Suit #MCLE

The threat of shareholder derivative suits, or cases against directors and officers brought by shareholders on behalf of the company, continues to be a concern for directors and officers. Not only do these lawsuits traditionally require corporate governance changes, but they have resulted in increasingly expensive monetary settlements and judgments. In this seminar, we will cover the mechanics of the derivative suit, particularly emphasizing the role of special litigation committees, settlement issues, major case developments, and consider the future of shareholder derivative litigation.

"AFDA is an online community for the federal criminal defense bar designed to facilitate nationwide communication and networking within the profession.
Originally formed in the year 1995, the AFDA web site has recently been upgraded to incorporate the latest Internet technology for online communication, aimed at encouraging defense lawyers and other professionals involved in the field of federal criminal defense to access one another more easily."
