One of the primary goals of the Bankruptcy Code is to provide for an orderly distribution of funds to creditors. In order to accomplish this goal, the Bankruptcy Code gives the trustee/debtor-in-possession various powers to bring assets back into the bankruptcy estate through the avoidance of certain transfers that occurred prior to or after the bankruptcy filing. This presentation will provide an in-depth look into these "avoidance actions" from the perspectives of both the trustee/debtor-in-possession and creditors.
