May 20: NYC+Philadelphia+Princeton - Where Are We Now? Patent Misuse Doctrine Since Princo

This session will discuss the current state of the patent misuse doctrine in light of several novel theories recently asserted in a number of cases. It will begin with a brief background and description of the doctrine of patent misuse, including its origin and the policies that motivated its development. Next, we will discuss recent decisions from the Federal Circuit, including the 2010 en banc decision in Princo Corp. v. International Trade Commission. It will conclude with a survey of cases following Princo, in which courts have analyzed (or will soon be analyzing) various theories to determine whether those theories give rise to a viable patent misuse defense.
