April 7: San Francisco - California Public Benefits: The Basics for Non-Profit and Pro Bono Advocacy 2015 (Free)

Low-income clients need your help to protect their rights to potentially life-saving benefits. Many low-income clients have difficulty navigating the confusing and bureaucratic processes to establish and maintain eligibility for public benefits. Without legal assistance and advocacy, large numbers of clients go without the benefits to which they are entitled, which can often lead to unnecessary hunger and homelessness. Attorneys who work with low-income people, or pro bono attorneys interested in working on these types of case, can learn the basics of public benefits law.

  • Overview of CalWORKs, CalFresh, General Assistance
  • Overview of Medi-Cal and other health benefits, including implementation of the Affordable Care Act
  • Overview of Social Security Disability Insurance (SSDI), Supplemental Security Income (SSI), and the Cash Assistance Program for Immigrants (CAPI)
  • Understanding of common issues that result in administrative hearings

May 6: Seattle - Pros and Cons of Shared Parenting: Current Research and Implications for Practice

Increasingly, legal and mental health professionals are considering parents’ requests for equal or near equal parenting time. Shared parenting is a controversial topic in family law, with strongly held and divergent opinions. This CLE will provide an overview of issues involved in determinations of shared parenting. The first part will address current research related to living arrangements after divorce, fathers’ involvement, and their associations with child psychosocial adjustment. Typical shared parenting arrangements will also be discussed. The second part will address issues related to infants and overnights, adolescents, and high conflict families.

The idea, or maybe the myth, of the Magna Carta is that it established the principle that government is subject to the rule of law and that the rule of law protects individual liberties against excesses of government.  Perhaps the best test of whether a government is subject to the rule of law rule is how government treats people accused of breaking its laws. As Dostoevsky declared: “A society should not be judged on how it treats its outstanding citizens, but by how it treats its criminals.”

So, how’s the Magna Carta doing?  Professor Colbert will discuss this issue and what he’s learned in twenty-five years of representing people who have been accused of breaking the law. The discussion will include coverage of ethical issues faced when representing defendants, including communication (Rule 1.4) and scope of representation (Rule 1.2).

April 21: San Francisco - Housing Negotiation Project Training

JDC's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

March 31: Webcast - The New CFRA Regulations and Other Family and Medical Leave Developments: What Employers Need to Know

Managing employee family and medical leaves is one of the bigger challenges for businesses, and as federal and California law in this area continues to evolve at a quick pace, it can be difficult for employers to stay in step with the latest compliance obligations. And now there’s a new wrinkle for California employers: Regulations updating the California Family Rights Act (CFRA) have just been finalized and will take effect on July 1, 2015. The regulations will align CFRA more closely with the federal Family and Medical Leave Act (FMLA), and will make some other key changes, including clarifying certain employer rights and responsibilities and revising the CFRA medical certification form.     Description:
    The Mock Trial Competitions are two of five annual in-house competitions hosted by the Moot Court Honor Board to provide students with the opportunity to gain first-hand experience with a variety of practical lawyering skills. Students form teams of two and are provided the mock trial problem in advance. Teams must prepare an opening statement, direct examination of two witnesses, cross examination of two witnesses and closing arguments. The competition features two preliminary rounds and three elimination rounds (quarterfinal, semifinal, and final).
    As a judge, you will provide feedback and evaluate the participants’ performance. We welcome attorneys from all practice areas. We will provide you with details regarding the problem and fact pattern in advance of the competition.
    Judging for a UWLS competition is an opportunity to provide law students with valuable feedback on their trial advocacy skills. Volunteer judges are also invaluable to the continued success of the Moot Court Honor Board and the in-house competition program.

    A lawyer and activist, Lessig spent a decade arguing for sensible intellectual property law, updated for the digital age. He was a founding board member of Creative Commons, an organization that builds better copyright practices through principles established first by the open-source software community.
    Lessig has shifted focus to American politics and in 2011, founded Rootstrikers, an organization dedicated to changing the influence of money in Congress. In his latest book, Republic, Lost: How Money Corrupts Congress--and a Plan to Stop It, Lessig focuses on how far the U.S. has spun off course — and how citizens can regain control.

    March 26: Webcast - PTAB Trial Practice: Insights from a Former USPTO Judge

    With the rise of post-issuance proceedings, an increasing number of lawyers are presenting to the Patent Trial and Appeal Board (PTAB) with little prior experience. Moreover, the makeup of the PTAB has changed significantly in the past four years, tripling in size from about 75 judges to over 225 judges, many of whom lack substantial judicial experience. That, along with the large backlog of ex parte and inter partes cases pending before the PTAB, can greatly affect post-issuance proceedings.
