Asset recovery and judgment enforcement with an Asian angle can be challenging.  This seminar will focus on how to leverage combined action in Asia, the Caribbean and the U.S. to achieve effective outcomes for clients.
Topics covered will include:
  • Sequencing enforcement in key Asian jurisdictions, to leverage intra-Asian judgment enforcement treaties;
  • Using interim remedies (injunctions, discovery orders, etc.) in the British Virgin Islands, the Cayman Islands, and other offshore financial centers;
  • Using discovery procedures available through the U.S. court system to assist international actions;
  • Seeking assistance from U.S. and other governments known to be aggressive in international asset forfeiture; and
  • Applying best practices in preparing for and managing the unique investigative demands of foreign asset recovery.

Speakers:
  • Michael S. Kim, Kobre & Kim LLP (Hong Kong/New York),  was recently ranked as one of the top 10 judgment enforcement/asset recovery lawyers in the world by the publishers of the Global Arbitration Review. He is co-author of the book Debtor-Creditor Fraud and has testified as an expert witness on insolvency in the courts of the Cayman Islands. Prior to establishing Kobre & Kim LLP, Mr. Kim served as a prosecutor with the U.S. Department of Justice in New York. Earlier in his career, Mr. Kim practiced at Davis Polk & Wardwell LLP.
  • Jalil Asif QC, Kobre & Kim LLP (Offshore Jurisdictions), is an English Queen’s Counsel with deep experience acting for judgment debtors and creditors in large, complex international collections matters in Europe and the Caribbean. Prior to joining Kobre & Kim LLP, Mr. Asif QC practiced at 4 New Square, Lincoln's Inn, London. 
  • Simon Cullingworth, Kobre & Kim LLP (London),  is an English solicitor focusing on international disputes, with a focus on enforcement of complex, high-value commercial judgments. He is the lead solicitor in a number of large international disputes involving global asset tracing, representing U.S. and European companies in litigation in the United Kingdom for breach of contract, fraud and theft, breach of restrictive covenants, and intellectual property disputes.
  • William F. McGovern, Kobre & Kim LLP (Hong Kong), focuses on international investigations. Prior to joining Kobre & Kim LLP, Mr. McGovern worked as a senior litigator and Executive Director for Morgan Stanley in the U.S. and Asia, where he managed a team of lawyers based in Hong Kong, Sydney, Tokyo and Mumbai. Earlier in his career, Mr. McGovern served in the Division of Enforcement at the U.S. Securities and Exchange Commission and as a prosecutor in New York.
