Multiple Dates/Web - Possible hardship waiver for ACC webcasts

The Association of Corporate Counsel sponsors periodic webcasts, and charges a fairly typical fee if you seek CLE credit. However, attorneys experiencing financial hardship may wish to persue the option described at http://www.acc.com/education/accwebcastpolicies.cfm:

"Financial Hardship Policy for CLE Webcasts

ACC understands that due to the present economic environment, it may be difficult to cover the costs required to obtain MCLE. Please submit a request to
webcast@acc.com with the state bar that you need to obtain credit and a statement that you are currently in-transition. All requests must be received seven (7) business days prior to the airdate of the webcast you are interested in attending. ACC will then review your claim and notify you of our decision."
I can't make any promises about this, and I hope people who are not in genuine hardship but who are (like me) merely cheap, won't abuse the system. But, like the website says, for some people the costs really may be difficult. I hope someone will work through this process and let me know how it goes.

Dec 15/New Orleans, LA - The Safe Escape Initiative-- Kickoff Free CLE training event

In Jefferson Parish, a woman trying to escape a violent relationship with the help of a protective order has almost nowhere to go for legal services if she cannot afford a private attorney. The few legal services available in the parish are forced to turn away the vast majority of domestic violence victims who need help.

In response to this need, the Tulane Domestic Violence Clinic is working with The Metropolitan Center for Women and Children to start the Safe Escape Initiative, a network of pro bono attorneys who volunteer to represent one domestic violence victim in a protective order hearing in Jefferson Parish.
  • The first free CLE training will be December 15, 2010 9:00 am - 2:00 pm.
  • Lunch provided
  • 4 hours of CLE have been applied for, including one hour of ethics and one hour of professionalism.
  • The CLE training will be free, and in return attorneys will agree to accept one protective order case in 2011.
  • This training will provide attorneys with the knowledge required to represent a domestic violence victim in a protective order case, and educate attorneys about the special ethical and professional obligations that arise when working with victims of domestic violence.

Web - Contingent Fees: Access to the Court or Threat to Capitalism?

Contingent fees continue to stir great controversy especially in class action cases, mass torts, and medical malpractice lawsuits.  The controversy most recently gained national attention when President Bush banned contingency fees in cases filed by the U.S Government.  Federal judges have called contingent fees "grotesque" and plaintiffs claim they will be denied access to the courts without them. The debate remains lively among plaintiff and defense lawyers, academics, the judiciary, insurance companies, the Chamber of Commerce and the general public.

 Recent legislation and efforts to amend state constitutions to limit contingent fees have been successful. Is there a problem with contingent fees? Do plaintiff's lawyers reap a windfall when enormous fees are awarded? What are the real risks undertaken by plaintiff's counsel and does the risk justify the reward? Are contingent fee awards out of whack? Who will benefit or suffer if they are restricted or eliminated?

The CLE will delve into complex aspects of international child abduction by mothers who flee to protect themselves or their children. It will include staged readings by professional actors of actual transcripts of interviews with US mothers and their attorneys from a recent study supported by the US Department of Justice. These readings will be interspersed with discussion by internationally recognized legal and social science experts. There will be 2.5 CLE credits available and it is free. Going to  http://westlegaledcenter.com and searching on the event title "Domestic Violence and the Hague Convention" we get one event for that date, which appears to cost $0 and is accreditted in dozens of states. Unfortunately I was unable to figure out how to get a direct link to the event, but I suppose it's not unreasonable for West to require us to go through their home page; exposure to a reasonable amount of advertizing for the for-pay material is only fair, IMO!

Dec 2/Web - Addressing Inadmissibility Issues for U Nonimmigrants (Webinar)

"On this webinar, we will review the most common and difficult inadmissibility challenges faced by U nonimmigrant applicants, arguments for those that do not apply, and how to screen for them, discuss how to address them on the Form I-918 application and the Form I-192 waiver request, strategies for winning waivers, and what kinds of inadmissibility waivers have succeeded or failed and why. Susan Bowyer, Attorney at Family Violence Law Center in Oakland
Susan has been the Managing Attorney at IIBA, an attorney and echoing green fellow at the Immigrant Legal Resource Center, and the Acting Director at the Center on Race, Poverty and the Environment. For the past decade, she has provided immigration legal services for low income immigrants, and she has special expertise in immigration applications for survivors of domestic violence and other crimes. In addition, she has presented dozens of trainings on immigration relief for battered immigrants, including presentations at the 2008 California and 2009 National AILA Conferences.

Jessica began working with immigrant crime victims in 2003 as an AmeriCorps VISTA volunteer at Casa Cornelia Law Center in San Diego. Then while pursuing her law degree in Washington D.C., she worked for the Academy on Human Rights and Humanitarian Law and helped represent immigrant clients at Ayuda and Holland & Knight. In August 2008, Jessica returned to California to work at IIBA's immigrant crime victim program, through direct services, outreach, and technical assistance.

Catherine has been working in the field of immigration law since 1990, starting out as legal assistant and then a BIA Accredited Representative before her admission to the bar in December of 2001. Before joining Bay Area Legal Aid as Regional Immigration Coordinator in July of 2009, she worked at Canal Alliance, the International Institute of the East Bay, and the private immigration law firm of Simmons & Ungar.
