In order to be an effective legal practitioner as well as an effective manager of the practice of law, every lawyer needs to understand the pivotal importance of empathy in the practice of law. 
Empathy is the ability to sense other people’s emotions, and to imagine what they might be thinking or feeling. Empathy is a key component of emotional intelligence, which is a core competency of any highly effective lawyer, legal professional, or law firm leader. Research indicates a positive correlation between empathy and operational performance, team climate, and employee retention.

February 16: Refresher on Ethics of Trial Work in a Courtroom

As health officials continue to try to get the pandemic under control, the legal community is trying to get back to business as usual. But is it? Lawyers’ skills and knowledge of courtroom practice and procedure may need a bit of sharpening. It is time for lawyers to brush up on the ethical rules that are in place when handling trials. Through hypotheticals, this two-hour program will deal with areas of concern that lawyers come across every day. A panel will answer questions on how best to handle and diffuse what could turn into unnecessary confrontational situations. From discovery issues to closing arguments, hypotheticals will be presented at various trial stages with attendees answering polling questions on best practices.
It should also be noted that effective Jan. 1, 2023, the Illinois Supreme Court has enacted an updated Illinois Code of Judicial Conduct for the first time in almost two decades, bringing it in line with national standards by addressing the use of social media and other technology that didn’t exist at the code’s last major update in 1993. How some of these Rules dovetail with trial lawyers in a courtroom will be discussed as well.

He has practiced in all areas of complex litigation and alternative dispute resolution, with particular emphasis on antitrust, securities, false advertising, sports, entertainment, patent and related complex intellectual property litigation. Mr. Quinn’s most recent notable engagements include obtaining for CBS the dismissal with prejudice of a landmark putative class action in which current and former NCAA Division I college football and basketball players alleged that CBS, along with a host of college athletic conferences, other networks and licensors, profited from the broadcast and use of those Student-Athletes’ names, likenesses and images without permission; winning for CBS Corporation the dismissal, affirmed on appeal, of a putative securities fraud class action relating to a $14 billion impairment; obtaining a complete dismissal for ESPN, Inc. and certain Walt Disney Co. companies in a $130 million suit brought by Echostar concerning alleged contract breaches relating to rights to ESPN and Disney’s high-definition television networks; securing a complete dismissal for CBS Corporation in a $70 million breach of contract, fraud, and breach of fiduciary duty suit filed by its former anchorman and correspondent Dan Rather stemming from his departure from the network in 2006; on behalf of ExxonMobil, defeating class certification of a purported national class alleging that major petroleum companies conspired to restrict the supply of gasoline; and securing summary judgment for ESPN, Inc. in litigation against boxing promoter Don King who alleged defamation and false light invasion of privacy and sought $2.5 billion in damages.

Credit:
 CLE credit: One standard CLE credit approved for in Iowa (activity number 137111) and Minnesota (event code 189742). One standard CLE credit applied for in Indiana (distance learning) and Wisconsin. In addition:
  • Alaska: Alaska Bar members may claim credit for attendance at CLE programs offered in or from other states if the program has been accredited by another MCLE jurisdiction
  • Arizona: The State Bar of Arizona does not accredit programs for the MCLE requirement. The Rules and Regulations are predicated on the assumption that attorneys can evaluate CLE activities offered based on the guidelines and report their activities by affidavit.
  • Arkansas: Upon receipt of a completed certificate of attendance form confirming attendance at an out-of-state continuing legal education program approved by the situs state, the attorney shall be entitled to CLE credits in Arkansas.
  • California: Program is eligible for California CLE credit only if the attorney is calling in from outside of California. The program cannot be taken for California credit if you call in from California.
  • Colorado: Colorado attorneys should submit a Colorado Affidavit form along with a statement certifying that the CLE program is accredited in another mandatory CLE state.
  • Florida: Courses approved by other state bars are generally acceptable for use toward satisfying CLE requirement but attorneys must first submit a CLE Application for Course Attendance Credit.
  • Hawaii: Program is eligible for Hawaii CLE credit only if the attorney is calling in from outside of Hawaii. The program cannot be taken for Hawaii credit if you call in from Hawaii.
  • Iowa: 1.0 CLE credit approved. 
  • Indiana: 1.0 CLE credit applied for. Attorney Clem will report attendance by Indiana attorneys to the Indiana CLE office. After the program when requesting CLE credit, please inform me if you are an Indiana attorney so that I can include your name on the report.
  • Maine: Credit hours for activities approved by another MCLE state will be accepted for identical credit by the Board of Overseers of the Bar in Maine upon the Board's receipt of evidence of such certification as issued by that state
  • Minnesota: 1.0 CLE credit applied for 
  • Montana: Montana will honor the approval given by other CLE jurisdictions. Simply attach documentation of the other state's approval to your affidavit at the end of the reporting year.
  • New Jersey: New Jersey attorneys who are taking courses approved for CLE by another state will receive 1:1 credit for courses approved in that jurisdiction through reciprocity.
  • New York: Attorneys may claim New York CLE hours for programs accredited in Indiana or Wisconsin.
  • Wisconsin: 1.0 CLE credit applied for.
  • Other States: CLE credit is available in many other states if the participating attorney applies for credit.

November 15/Indianapolis: Indianapolis Women Working for the Right to Vote: the Forgotten Drama of 1917 #MCLE


Following the passage of Maston-McKinley Suffrage Bill, in the fall of 1917, between 30,000 and 40,000 Indianapolis women registered to vote. The bill, passed earlier that year, granted women the right to vote in municipal elections, school elections, liquor matters, and constitutional convention elections. While the bill did not grant women the right to vote in presidential and state elections, this “limited suffrage” gave them a significantly amplified voice in the public realm.
William Knight, an Indianapolis lumber company owner, quickly filed a lawsuit claiming the legislature did not have the right to extend their voter base through these means. Both the Marion Superior Court and the Indiana Supreme Court ruled in favor of Knight and women lost their right to vote.
