Dangers and unintended consequences of new and proposed legislation in New York responding to the foreclosure crisis are explored by Bruce J. Bergman, author of Bergman on NY Mortgage Foreclosures, in a new CLE offered by LexisNexis. In this recession, an increasing number of Californians are facing eviction and do so without the benefit of legal counsel to guide them through the process or the representation necessary to vigorously defend against unlawful actions.  As a result, families face the very real possibility of homelessness. This training is designed to help mitigate the crisis by providing private attorneys with a basic understanding of eviction defense and housing law, and an opportunity to connect with non-profit legal service agencies able to facilitate pro bono representation of low income families facing this predicament.

2011 National Defender Training Program in Las Vegas Sep 9-10 has a JULY 15, 2011 DEADLINE for scholarship applications. Qualifying attorneys may not only get this CLE for free but may get a scholarship, but only if you follow the application directions and otherwise qualify. This is for defense attorneys and their supervisors who intend to put their learnings to use and to share them as detailed below. Multiple Dates/Web - Possible hardship waiver for ACC webcasts

The Association of Corporate Counsel sponsors periodic webcasts, and charges a fairly typical fee if you seek CLE credit. However, attorneys experiencing financial hardship may wish to persue the option described at http://www.acc.com/education/accwebcastpolicies.cfm:

"Financial Hardship Policy for CLE Webcasts

ACC understands that due to the present economic environment, it may be difficult to cover the costs required to obtain MCLE. Please submit a request to
webcast@acc.com with the state bar that you need to obtain credit and a statement that you are currently in-transition. All requests must be received seven (7) business days prior to the airdate of the webcast you are interested in attending. ACC will then review your claim and notify you of our decision."
I can't make any promises about this, and I hope people who are not in genuine hardship but who are (like me) merely cheap, won't abuse the system. But, like the website says, for some people the costs really may be difficult. I hope someone will work through this process and let me know how it goes.

 A hardship waiver for a paid program can be a good way to get free CLE if you qualify, and it can be an excellent give-back for the sponsor. This generous offer from ACC deserves recognition!

Web - Contingent Fees: Access to the Court or Threat to Capitalism?

Contingent fees continue to stir great controversy especially in class action cases, mass torts, and medical malpractice lawsuits.  The controversy most recently gained national attention when President Bush banned contingency fees in cases filed by the U.S Government.  Federal judges have called contingent fees "grotesque" and plaintiffs claim they will be denied access to the courts without them. The debate remains lively among plaintiff and defense lawyers, academics, the judiciary, insurance companies, the Chamber of Commerce and the general public.

 Recent legislation and efforts to amend state constitutions to limit contingent fees have been successful. Is there a problem with contingent fees? Do plaintiff's lawyers reap a windfall when enormous fees are awarded? What are the real risks undertaken by plaintiff's counsel and does the risk justify the reward? Are contingent fee awards out of whack? Who will benefit or suffer if they are restricted or eliminated?

Susan Bowyer, Attorney at Family Violence Law Center in Oakland
Susan has been the Managing Attorney at IIBA, an attorney and echoing green fellow at the Immigrant Legal Resource Center, and the Acting Director at the Center on Race, Poverty and the Environment. For the past decade, she has provided immigration legal services for low income immigrants, and she has special expertise in immigration applications for survivors of domestic violence and other crimes. In addition, she has presented dozens of trainings on immigration relief for battered immigrants, including presentations at the 2008 California and 2009 National AILA Conferences.

Jessica Farb, Immigrant Victim Legal Services Coordinator at International Institute of the Bay Area (IIBA) in Oakland
Jessica began working with immigrant crime victims in 2003 as an AmeriCorps VISTA volunteer at Casa Cornelia Law Center in San Diego. Then while pursuing her law degree in Washington D.C., she worked for the Academy on Human Rights and Humanitarian Law and helped represent immigrant clients at Ayuda and Holland & Knight. In August 2008, Jessica returned to California to work at IIBA's immigrant crime victim program, through direct services, outreach, and technical assistance.

Catherine Ward-Seitz, Regional Immigration Coordinator for Bay Area Legal Aid
Catherine has been working in the field of immigration law since 1990, starting out as legal assistant and then a BIA Accredited Representative before her admission to the bar in December of 2001. Before joining Bay Area Legal Aid as Regional Immigration Coordinator in July of 2009, she worked at Canal Alliance, the International Institute of the East Bay, and the private immigration law firm of Simmons & Ungar.
