Webcast - Register Now!
Also presented in-person in San Francisco.
Description:
Unaccompanied immigrant children (UACs) from Central America have been coming to California in increasing numbers for the past few years. These children are placed in removal proceedings, and without access to government appointed counsel, they have difficulties navigating the confusing and complex immigration system alone. Many children are eligible for some form of humanitarian relief or have other avenues to avoid deportation, however without an attorney to help them, the majority are ordered removed to their home countries, often to very dangerous conditions. Attorneys who work with immigrant youth, or pro bono attorneys interested in working on these issues, can learn the basics of the immigration detention and removal process for children, best practices for working with these children, how to effectively present asylum and special immigrant juvenile status claims, and other removal defense strategies.
What You Will Learn:
  • Best practices for working with children including interviewing techniques and trauma informed practices
  • Overview of immigration detention and removal system for children
  • Overview of Special Immigrant Juvenile Status (SIJS), including inadmissibility issues
  • Nuts and bolts of SIJS cases in California probate court proceedings (seeking guardianship)
  • Nuts and bolts of SIJS cases in California family court proceedings (seeking custody)
  • Representing SIJS eligible clients before USCIS and EOIR
  • Asylum claims for children
  • Removal defense strategies (e.g., challenging the Notice to Appear (charging document), evidence of alienage, and other evidence brought forward by DHS)
  • Benefits available for immigrant youth (education, public benefits, etc.)
Who Should Attend:
Attorneys interested in assisting or representing immigrant youth, firm pro bono coordinators and partners, law clinic students and faculty, public interest and non-profit organization attorneys and staff, immigration advocates, and other providers working with immigrant youth.

California historically has been considered a hot-bed of environmental regulation, and that trend has continued in recent years. The State has long kept a list of particularly dangerous chemicals known to cause cancer or reproductive toxicity and requires companies doing business in California to warn consumers about any potential exposure to those chemicals. Does this sound like an area of law that does not apply to your clients? Think again. There is virtually no product and no industry untouched by California’s Safe Drinking Water and Toxic Enforcement Act (better known as “Proposition 65”), and with new lawsuits cropping up every day, any client doing business in California needs to know about the pitfalls of this California law.

Two million American workers report they are victims of workplace violence each year. Join our highly credentialed panelists as they examine:
  • OSHA’s criteria for initiating workplace violence inspections
  • OSHA’s citation history under the general duty clause and the high-risk industries subject to the enforcement initiative
  • The Secretary of Labor’s legal burden of proof under Review Commission and Circuit Court law

October 22: Cleveland - The Collision of Anti-Discrimination Laws And The Religious Rights Of Employers

The Collision of Anti-Discrimination Laws And The Religious Rights Of Employers
When/Where:
Wednesday, October 22, 2014
5:00pm - 6:00pm
Moot Court Room
Cleveland-Marshall College of Law
Cleveland State University
1801 Euclid Ave
Cleveland, Ohio 44115
Description:
Employers asserting religious rights in the workplace has become increasingly visible, a trend that is likely to continue following the Supreme Court’s 2014 Hobby Lobby decision. There, the Court held for the first time that closely-held for-profit corporations are persons that may exercise religion within the meaning of the Religious Freedom Restoration Act. Although the reach of the decision remains unclear, it is certain to raise a host of novel issues. For example, because of its sincerely-held religious beliefs, might an employer choose to exclude coverage for blood transfusions or anti-depressant medications? Might it decline to promote a female employee if it means she would supervise male subordinates? Might it refuse to employ LGBT individuals?

Separately, an increasing number of religious institutions have required their employees to sign detailed “morality clauses,” requiring them to behave in a manner fitting the employer’s strict faith decrees. These institutions have threatened employees who refuse to do so or watched as employees quit in protest.

These and other instances of employers asserting their religious rights inevitably sets up a clash between employers running their workplaces consistent with their religious beliefs on the one hand, and employees seeking protection under anti-discrimination laws on the other. Amy Ryder Wendtz of the law firm of Littler Mendelson and Danielle O. Doza, past Policy Council with the ACLU of Ohio, will discuss these and other issues that pertain to the religious rights of employers, with particular focus on the actual and potential effect of Hobby Lobby on employee rights under anti-discrimination laws. In addition, the panel will discuss how attorneys might advise their clients in light of Hobby Lobby and the varied potential issues it raises.

November 20: Minneapolis - Corroborating the Story

Description:
Asylum clients are like no other clients in the legal system. An asylum client’s experiences and trauma span the globe and involve some of the worst human rights violations of our time. Successfully communicating their story poses unique and fascinating challenges for advocates. From filing the application to preparing for an immigration interview, an asylum applicant faces an intensive and daunting immigration process that many worthy applicants cannot navigate.
Asylum Step By Step is a four-part series designed to provide volunteer attorneys with skills and techniques necessary to successfully represent asylum seekers, to help avoid common pitfalls, and to give advocates an opportunity to learn from experienced attorneys.
This session focuses on utilizing documentary evidence and supplemental affidavits from witnesses or service providers to strengthen parts of your client’s narrative and bolster your client’s legal argument.

October 29: Webcast - Product Packaging and Labeling: An Overview of Current Legal Principles #MCLE

Marketplace promotion of products can involve not only attractive packaging designs, but also a mix of labeling concerns including product performance claims, regulatory compliance, required disclosures, and identification of intellectual property rights. Product promotion not only drives sales, but seeks to develop brand loyalty and provide consumers with useful information about the product. As such, product packaging and labeling is tied to legal issues involving compliance with one or more government agencies, marking of IP rights, industry standards, and more.
During this webinar, we will provide an overview of current legal issues to consider when developing product packaging and will cover these topics:

·       A summary of issue spotting of product packaging
o   Claim substantiation
o   Disclosures
o   Comparative claims
o   Endorsements
o   Marking product IP
·       Trademark use as a source identifier of a product
·       State and federal government compliance issues for food and medical products
·       Digital and print labeling
