September 23: Not Equivalent, But Better: Human Rights and Health Care Behind Bars in the Time of COVID

The COVID-19 pandemic has underscored the lack of resources and oversight that hinders medical care for incarcerated people in the United States. 
The US Supreme Court has held that “deliberate indifference” to “serious medical needs” violates the Constitution. But this legal standard does not assure the consistent provision of health care services. This leads the United States to fall behind European nations that define universal standards of care grounded in principles of human rights and the ideal of equivalence that incarcerated and non-incarcerated people are entitled to the same health care.
Drawing on a normative analysis and empirical research, this talk describes an incremental strategy based on expanding Medicaid into correctional facilities and improving comprehensive oversight that would move closer to the normative ideal without resolving many of the thorny problems of correctional health care.

September 20: Not Over Yet: The Impact of COVID-19, Racial Reckoning, and SCOTUS on LGBTQ+ and Two Spirit Civil Rights

This program will provide an overview of LGBTQ+ and Two Spirit experiences during the pandemic and racial justice reckoning and beyond. LGBTQ+ and Two Spirit identities are not captured in pandemic public health data, and research on racial disparities rarely captures LGBTQ+ or Two Spirit experiences. But we can see their impacts in our legal system, in the types of legal issues presented at QLaw Foundation’s LGBTQ2S+ and Transgender Legal Clinics, and in the cases touching on personal freedom, expression, and privacy at our United States Supreme Court. As the impacts of the pandemic and our country’s ongoing racial justice reckoning continue to play out, this presentation will offer concrete strategies for legal representation and coalition-building across communities.

November 4: OSHA ETS Vaccine Mandate

OSHA has drafted its Emergency Temporary Standard (ETS) requiring employers with more than 100 employees to either be vaccinated or tested for COVID-19 weekly and it is waiting to be released by the White House. 
In light of the imminent release of this important regulatory requirement for large employers, we have scheduled a webinar in advance to address the latest news on the standard and any anticipated or filed legal challenges.
This webinar will cover:

On Demand: FEMA’s COVID-19 Funeral Assistance Program

This Briefing will cover two policy updates from the Federal Emergency Management Agency (FEMA): 1) the COVID-19 Funeral Assistance Program and 2) recent updates to the FEMA Individual Assistance Program and Policy Guide.
In April 2021, FEMA announced financial assistance would be made available for COVID-19 funeral expenses incurred after January 20, 2020. This funding is available under the Coronavirus Response and Relief Supplemental Appropriations Act of 2021 and the American Rescue Plan Act of 2021. In June 2021, the agency announced it would provide flexibility for documentation requirements. FEMA also recently updated the Individual Assistance Program and Policy Guide, which outlines FEMA’s assistance programs after a disaster declaration.

September 9: What Employers Need to Know: Mandating COVID-19 Vaccines in the Workplace

With the COVID-19 Delta variant on the rise and the FDA’s recent approval of the Pfizer vaccine, employers are once again reviewing their policies and considering making vaccines mandatory in the workplace.
