January 26: Individual Representation and Movement Lawyering -- Separate and Distinct or Combining to Become More Than Sum of the Parts?

This presentation will examine ways in which the representations of individuals in criminal and civil cases can act in concert with what we think of as movement lawyering and address questions such as:
  • Is the representation of an individual always in conflict with movement lawyering?
  • Who should decide how much collaboration there should be between lawyers representing an individual and lawyers working with a movement?
  • What limits on and opportunities for collaboration between lawyers representing individuals and lawyers working with movements are presented by ethical rules?
  • In some cases, is there a duty to engage with a movement during your representation of an individual?

March 9: Self-Defense and "Unwilling or Unable" States

Prohibition of use of force and right of self-defense in U.N. Charter Articles 2(4) and 51, and pre-9/11 development of international law as regards self-defense against armed attacks by non-state actors, focusing on the doctrine of state responsibility and the requirement of attribution. Post-9/11 emergence of the new concept of "unwilling and unable" states as an expanded justification for use of force in self-defense against non-state actors, in private commentary and in state practice, particularly the military operations of some states in the fight against Islamic State (ISIS) on Syrian territory 2014-2019.
Restrictive and expansive approaches to use of force and self-defense in judicial decisions, state practice, and international law doctrine, and impact of the "unwilling and unable" standard on sovereignty and on the UN system relating to use of force. Whether the "unwilling and unable" standard has become customary international law, and whether it is possible to change the jus cogen norms of prohibition of the use of force and self-defense.

December 14: Litigation 2023: What’s New and What’s Next

The legal landscape in 2022 has been impacted by a fascinating combination of political, economic, and judicial headwinds. More than ever before, litigators need to stay apprised of developments outside of the courtroom to give their clients the best chance of prevailing inside the courtroom.
But even more valuable than the knowledge of what’s happening now is what’s coming next.
In our annual outlook series, Bloomberg Law 2023, more than 30 Bloomberg Law legal analysts offer their expert insights and perspectives on issues that practitioners should be following in the year ahead.
On this webinar, you’ll hear from four of our litigation analysts on the trends and topics they’ll be following in 2023. Our analysts will help you navigate some of the upcoming year’s biggest challenges, from antitrust and the environment to cybersecurity and social media liability.
Learning Objectives:
  • Know what to expect from forces that are shaping litigation as the new year approaches.
  • Learn about emerging legal concepts and strategies involving Section 230, the major questions doctrine, merger scrutiny, and common-law data breach claims.
  • Gain insight on positioning clients to take advantage of the latest legal trends.
Who would benefit most from attending this program?
  • Law firm attorneys advising clients across a wide array of legal practice areas
  • In-house counsel involved in litigation matters
  • Legal industry trend-watchers seeking intelligence on future developments.

December 13: An Update On The Committee On Foreign Investment In The U.S.

The Committee on Foreign Investment in the United States (CFIUS) has authority to review certain investment transactions by foreign persons in U.S. businesses.
Through sweeping legislative changes in 2018 through the Foreign Investment Risk Review Modernization Act, CFIUS’s jurisdiction expanded significantly and mandated filings with respect to certain covered transactions for the first time. Since that time, various changes have occurred with the CFIUS process and the U.S. Government has continued to use the process as a powerful tool in protecting U.S. national security. In September, President Biden issued an Executive Order on Ensuring Robust Consideration of Evolving National Security Risks by the Committee on Foreign Investment in the United States
This session will explore CFIUS’s jurisdiction and the procedures and process of filings with CFIUS. The session will also explore efforts by CFIUS’s Office of Monitoring & Enforcement with respect to “non-notified” transactions.
