February 1: A Handy Primer on Drafting and Updating Employee Handbooks

A properly drafted and updated employee handbook not only states the terms, conditions, and expectations of employment, but can also help employers defend against claims of discrimination, harassment, breach of contract, wrongful termination, and other employment law claims. Employers who conduct business in multiple jurisdictions and industries must be diligent in making sure that employment policies are compliant with all applicable federal, state, and local laws. This webinar will give attendees a greater understanding of the purpose of an employee handbook, provide tips to effectively draft employee handbooks and best practices to monitor changes in the law which necessitate handbook revisions.

February 1: Recent English Law Changes Invite Mass Tort Litigation, Some Backed by U.S. Plaintiff Lawyers

Over the last several years English court decisions have broadened the use of aggregate litigation mechanisms, including Group Litigation Orders, which is leading to a rise in mass claimant litigation in the UK. This development brings group litigation in the UK closer to mass litigation in the United States. Recently, U.S.-based plaintiffs’ attorneys have entered the UK market, including some who are known for securing multi-million dollar verdicts. These U.S.-based lawyers have announced their goal of bringing U.S.-style aggregate litigation to English courts, which could cause a substantial change in the UK litigation climate.
Please join Dechert’s Product Liability and Mass Torts group, UK practitioners and guest speakers for a discussion of what has happened to date, what to expect and how to be one step ahead.

January 31: New California Developments and a Few Updates

The legal landscape for California employers continues to evolve through legislative and regulatory developments. In January, the California Labor Commissioner’s Office released new FAQs clarifying the California Equal Pay Act’s pay scale transparency requirements that became effective on January 1, 2023. The California Civil Rights Department also updated its FAQs for the revised California pay data reporting requirements that go into effect this year. We’ll also review California employer obligations for consumer privacy under the CCPA and the CPRA and under the permanent COVID-19 standard passed by the Cal/OSHA Standards Board on December 15, 2022. Finally, we’ll discuss the impact of the Federal Trade Commission’s possible ban on non-competes on California employers and provide an overview of the federal religious accommodation standard that the U.S. Supreme Court has agreed to review and what a change in that standard would mean for California employers.

February 28: Ukraine: Accountability and the Emergence of a New Global Order

The Russian invasion of Ukraine constitutes a clear violation of international law; by ordering the commission of various atrocity crimes, such as aggression, crimes against humanity, war crimes, and possibly genocide, Russian President Vladimir Putin has incurred individual criminal responsibility. In fact, since Nuremberg, political and military leaders have been held accountable for ordering and orchestrating the commission of atrocity crimes. In the context of Ukraine, Putin and other Russian leaders are already being investigated by the International Criminal Court, which has jurisdiction over genocide, crimes against humanity, and war crimes in Ukraine; it is likely that the ICC will indict some Russian leaders in the very near future. As the ICC does not have jurisdiction over the Russian crime of aggression, various states have advocated for the creation of an ad hoc aggression tribunal. Those conversations continue in the United Nations General Assembly, and it is possible that we will witness the creation of such a tribunal this year.
In a dynamic Q&A format moderated by CSU |LAW Professor Milena Sterio, Dean Michael Scharf will discuss the various accountability options for the prosecution of Putin and other Russian leaders, as well as the possibility that developments related to the Ukraine conflict may suggest the emergence of a new global order.

23 states and the District of Columbia have legalized marijuana in some form and a few more have decriminalized it. Four of these states and DC have legalized marijuana for recreational use as well as medical use. However, marijuana remains illegal under federal law and employers, regardless of whether or not marijuana is legal, likely will not want their employees using it at work. Please join this class for an overview of current marijuana laws, trends in the medical industry, and insight into how changing times will likely impact our current, drug-free workplaces.

January 30+31: Online Legal Research And Resources

The many ways technology can aid attorneys in locating the best and most on point statutes, caselaw, secondary materials and all relevant materials can be overwhelming. The comments to the model rules of professional conduct governing attorneys state that “to maintain competency a lawyer should keep abreast…[of] the benefits and risks associated with relevant technology.” The goal of this course is to assist attorneys in navigating online legal research, so they feel more confident and competent when researching subjects important to their work. This CLE is an interactive scenario-based course that considers the daily tasks that attendees may be required to perform.

March 15: National Security Review Of Foreign Investment Transactions

While bipartisan legislative successes have been few and far between in our highly-charged political environment, a general consensus on the need to provide a stronger framework for reviewing foreign investment in US companies led to the passage of the Foreign Investment Risk Review Modernization Act (‘FIRRMA’) in the summer of 2018. The issuance of a final rule in January 2020 implementing FIRRMA subsequently crystallized the process for CFIUS review of inbound transactions. This seminar will review the landscape leading to FIRRMA, the highpoints of the new regulatory process, and provide an update on recent developments as changing national security concerns continue to provide calls for additional regulatory changes. It will also offer significant instruction on techniques for researching various aspects of this topic—from legislation to regulation and even how to analyze market examples of CFIUS approval clauses in M&A agreements.

February 10: Diving Deeper Into Legal Research Potential: Advanced Online Legal Research Concepts

It lets people be creative. It lets people be productive. It lets people learn things they didn't think they could learn before, and so in a sense it is all about potential.” The goal of this course today is to harnessing the potential as attorneys to learn things about online legal research you didn’t think you could learn before. This course is going to be a deeper dive into online legal research. According to the model rules of professional conduct, attorneys need to maintain competency, and a component of maintaining competency is to keep abreast of the benefits and risks of relevant technology. By the end of this course you all will be made aware of advanced online legal research methods to harness your potential as a researcher and to maintain a standard of competency in the legal profession.

March 9: Self-Defense and "Unwilling or Unable" States

Prohibition of use of force and right of self-defense in U.N. Charter Articles 2(4) and 51, and pre-9/11 development of international law as regards self-defense against armed attacks by non-state actors, focusing on the doctrine of state responsibility and the requirement of attribution. Post-9/11 emergence of the new concept of "unwilling and unable" states as an expanded justification for use of force in self-defense against non-state actors, in private commentary and in state practice, particularly the military operations of some states in the fight against Islamic State (ISIS) on Syrian territory 2014-2019.
Restrictive and expansive approaches to use of force and self-defense in judicial decisions, state practice, and international law doctrine, and impact of the "unwilling and unable" standard on sovereignty and on the UN system relating to use of force. Whether the "unwilling and unable" standard has become customary international law, and whether it is possible to change the jus cogen norms of prohibition of the use of force and self-defense.

January 20: The FTC’s Proposed Rule Banning Non-Competes Explained

On January 5, 2023, the Federal Trade Commission, in a 3-1 split decision, issued a 216-page proposed rule banning non-compete agreements while seeking public comment. The proposed rule would ban contracts preventing a “worker from seeking or accepting employment … after the conclusion of the worker’s employment with the employer.” The proposed rule has several exceptions for certain employers and industries but leaves many unanswered questions. This webinar will explore common questions such as what is a de facto non-compete? What industries are excluded from the proposed rule? What about non-solicitation or non-disclosure agreements? Will President Biden outlaw non-competes altogether? Will there be legal challenges? What happens next? This webinar will answer these questions and more.
