January 22/Saint Paul, MN: The Future of Gun Rights


Mr. Gura will discuss current development in the Second Amendment regarding the cases that are currently being litigated today on a variety of topics throughout the country. He has been directly involved with litigating a number of these cases. A major issue he’ll discuss is the issue of carrying handguns outside the home for self-defense. He will include examples of the District Court in Maryland that struck down that state’s may-issue law in Woollard v. Sheridan and the Seventh Circuit Court’s hearing in Moore v. Madison, a challenge to Illinois’ band on the carrying of handguns. He will conclude with discussion of where the courts are headed on these issues and open up for some brief debate and dialogue with attendees.

The Wisconsin Supreme Court, a non-partisan court, has recently seen persistent partisan divide.  Additionally, Supreme Court campaigns nationwide continue to be inundated with big money contributions, with nearly $28 million spent on television ads alone in 2012.  The increasing role of campaign contributions in judicial races poses unique challenges to maintaining an independent and impartial judiciary, and the public's trust in our system of justice.

For more than 20 million youngsters, each day begins and ends with a trip on a bus. In addition, 10 percent of all K to 8th graders walk or bicycle to school. Other students are driven to and from school. The greatest risks to student occur not only while riding the bus, but also while walking to and from school and walking to and from the school bus or auto drop off. January 16/San Francisco: Introduction to Family Law Training #MCLE

The Bar Association of San Francisco's Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by VLSP’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. January 15/San Francisco: Housing Negotiation Project Training

The Bar Association of San Francisco's Volunteer Legal Services Program's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

Ethics: Alternative Fee Arrangements & Pro Bono Service - On-Demand #MCLE

Discover the practical and ethical considerations of alternative fee arrangements and learn about the ABA's stance on pro bono service and corporate pro bono work in this two part program.
  • Part 1: Alternative Fee Arrangements - AFA's can sound good: predictability, discounts, and the outside lawyer gets a guarantee of a certain measure of work. In practice, however, there can be unforeseen consequences. Trial lawyer Jean Bertrand will discuss allocation of risk and the attendant ethical conflicts that can arise under several kinds of AFA. Issues include ABA Model Rule 1.5 ("Reasonableness of Fees and Expenses") and its application to "success" fees, the conflict between outside counsel's duties to the client and his/her own financial interest when a fee cap is reached before the matter has concluded, fungibility of services, disparity of effective hourly rates, overloading of firms and load-leveling among firms.

Selected #Ethical Issues for Litigators & Business Attorneys: On-Demand #MCLE

A trio of highly qualified attorneys take on emerging ethical issues pertaining to litigators, in-house counsel, employment lawyers, and business attorneys alike. Part 1 of this course is comprised of the following lectures:

  • Ethics: Effect of Corporate IT Policies on Otherwise Privileged Communication - Personal use of corporate IT resources has become commonplace and, in some instances, essential for busy employees. If the company has an IT monitoring policy, however, that policy could prevent any privilege from attaching to personal communications from company employees to third parties that pass through the company's server. Counsel should be aware of the effect these corporate IT policies have (or could have) on evidentiary privileges and, therefore, the scope of discoverable information in various litigation settings.
  • Ethics: Navigating the Perils and Promises of Social Networking - In-house counsel need to promulgate policies and spread the word in the workplace about the use of social media by company employees, vendors and professionals to protect the company from unnecessary brush fires that could burn out of control. Ethical limitations on lawyers direct or indirect communication with jurors and parties in litigation, through LinkedIn and Facebook groups, "friending," "liking," posting, etc.

December 17/Web: FCPA Update

The Foreign Corrupt Policies Act (FCPA), the world’s oldest anti-corruption law, just got a makeover.  The long-anticipated FCPA Guidance was released last week in an undertaking that the Justice Department and SEC have called “unprecedented” in its attempt to clarify compliance and enforcement issues, causing  all in-house and outside counsel  who do business with or outside the United States to listen up.
This program provides the necessary framework to what the Justice Department and the Securities and Exchange Commission have called the “the most comprehensive effort ever undertaken to explain enforcement of the Foreign Corrupt Practices Act” and outline counsel will need to know to procure and protect business transactions outside the United States.

January 9/Cleveland+Web: The Eighth Amendment and the Mentally Ill on Death Row #MCLE

The Supreme Court has recently demonstrated an interest in the Eighth Amendment protection against cruel and unusual punishment as it applies to discrete groups. In the past few years the Court has determined that the Eighth Amendment prohibits the execution of the mentally retarded and juveniles. Even more recently the Court determined that the Eighth Amendment prohibited life without parole (LWOP) for juveniles convicted of non-homicide crimes and just this term the Court determined that mandatory LWOP for juveniles convicted of murder also violated the Eighth Amendment. These developments raise questions about applications to other groups. One area of increasing attention is the Eighth Amendment implications of executing the mentally ill.

Professor Michael Benza is Visiting Associate Professor at Case Western Reserve University School of Law.   Professor Benza received his Bachelor of Arts (1986) and law degrees (1992) from Case Western Reserve University. He also received a Master of Arts degree in Clinical Psychology (1988) from Pepperdine University. He was the 1992 Biskind Fellow from CWRU School of Law and spent a year working for the Legal Resources Centre, a civil and human rights law firm in South Africa. Upon returning to the States, he spent four years in the Capital Defense Unit at the Office of the Ohio Public Defender. He was assistant counsel at the Cleveland Bar Association working with the Certified Grievance Committee as well as other committees. Professor Benza teaches Criminal Law, Criminal Procedure I, Death Penalty Issues, and the Death Penalty Lab, and coached the Mock Trial team. The Student Bar Association selected Professor Benza as the Professor of the Year in 2007, 2008 and 2009. In 2009 Professor Benza was elected as an alumni member to the Society of Benchers.
Professor Benza continues to represent death row inmates in state courts and federal habeas proceedings. He has litigated capital cases in state trial courts, state appellate and post-conviction courts, and federal courts including arguing Smith v. Spisak before the Supreme Court of the United States.

December 13/Web: Achieving Open Source Compliance in the Enterprise #MCLE

IDC recently reported that “open source makes up 30% or more of the code at major Global 2000 organizations and is increasingly looked to as a resource.”  Technology trends in cloud computing and mobilization,  key areas of IT investment in 2013, are driving the adoption and reliance on open source.
But as open source software is more broadly used, IT organizations are struggling to manage, control and ensure compliance.  In an environment where development organizations are under intense pressure to keep pace in competitive markets, a lack of formal policies and ad hoc management practices are insufficient in making sure license obligations are met.
The need to ensure compliance is also being reinforced by the growth in adoption of open source projects using the AGPL license, which closes the distribution loophole associated with the GPL license. At the same time, enterprises creating and distributing mobile apps are becoming more like ISVs, the early adopters of open source compliance processes, and therefore need to proactively manage and control open source.
