September 21: Reproductive Rights and the Roberts Court


In the 2019-2020 Term, the U.S. Supreme Court decided two major cases affecting abortion rights (June Medical Services v. Russo) and access to contraception (Little Sisters of the Poor v. Pennsylvania). Professor Hill will explain the background of these decisions and discuss the future implications of these two decisions for reproductive rights in Ohio and beyond.

Jessie Hill, JD, is Associate Dean for Research and Faculty Development and Judge Ben C. Green Professor of Law. She joined the faculty in 2003 after practicing First Amendment and civil rights law with the firm of Berkman, Gordon, Murray & DeVan in Cleveland. Before entering private practice, Hill worked at the Reproductive Freedom Project of the national ACLU office in New York, litigating challenges to state-law restrictions on reproductive rights. She also served as law clerk to the Honorable Karen Nelson Moore of the United States Court of Appeals for the Sixth Circuit. Hill's teaching focuses on constitutional law, civil rights, reproductive rights, and law and religion. Her scholarship has been published in the Michigan Law Review, the Duke Law Journal, the Georgetown Law Journal, and the Texas Law Review, among others.

September 24: Subrogation Arising from Commercial Kitchen Fire Losses

In 2014, an estimated 8,470 restaurant structure fires were responsible for $140 million in property loss. Approximately 61 percent of restaurant structure fires were caused by cooking equipment. Cooking materials (grease, oil) were the most frequent items first ignited. This webinar will address the subrogation and recovery opportunities presented when restaurant fire suppression systems and cooking ventilation systems fail to contain and suppress commercial kitchen fires and where instead a fire originating on a cooking line evolves into a major conflagration that causes substantial loss to the restaurant building, business property, and significant business interruption costs. We will address theories of liability arising out of the spread of a fire that otherwise should have been contained and suppressed by a restaurant’s fire suppression system that can be asserted against restaurant fire suppression system contractors who design, install, service, and maintain restaurant fire suppression systems; against designers and installers of commercial cooking equipment and vent systems; and against restaurant hood and duct cleaners who design, install, service, clean, and maintain restaurant hood and duct exhaust systems.

September 1: Black Lives Matter (In Disasters, Too) – The Intersection of Race and Policy in Disasters

While disasters do not discriminate, recovery does. Studies show that communities of color struggle to recover long after the natural disaster is over. This webinar provides a historical context of how segregation and discrimination as well as policies such as redlining isolated communities of color and put them in areas more susceptible to natural disasters, and explores ways in which attendees can advocate for change in their communities through grassroots advocacy. The webinar also examines how restriction of movement during a public health emergency impacts communities of color, balancing privacy rights and the need for collecting and sharing data during COVID-19, and how protests of shelter in place executive orders and protests supporting the Black Lives Matter movement resulted in disparate treatment among minorities.

September 9: DACA: Beyond the U.S. Supreme Court Decision

On July 28, 2020, the U.S. Department of Homeland Security (DHS) issued a new memorandum on DACA that dismantles the existing program while the future of the program is under review. This new memorandum limits who is eligible for DACA in spite of the June 18, 2020 decision from the U.S. Supreme Court which reinstated the program in its entirety.

  • Krsna Avila is based in San Francisco, California, and focuses on immigration enforcement issues, including state and local law enforcement’s cooperation with federal immigration agencies in unlawfully deporting immigrants, and Deferred Action for Childhood Arrivals advocacy. Krsna joins the ILRC with a wealth of personal and professional immigration experience. Having immigrated to the United States with his parents when he was only four months old, Krsna grew up as an undocumented immigrant. Prior to law school, Krsna worked closely with the ILRC to establish a legal services program at Educators for Fair Consideration. As their Legal Services Manager, Krsna provided legal support to undocumented youth throughout the country. Directly feeling the effects of our unjust immigration system, Krsna quickly became interested in attending law school in order to understand the legal system from a different lens. While in law school, Krsna worked at the United Nations High Commissioner for Refugees in Washington D.C. and the American Civil Liberties Union of Northern California where he supported litigation regarding free speech and racial discrimination issues. He also participated in the Asylum and Convention Against Torture Appellate Clinic, where he helped represent a client before the Board of Immigration Appeals. Krsna also volunteered with the European Council on Refugees and was an editorial member for the Cornell Legal Information Institute U.S. Supreme Court Bulletin.
  • Allison Davenport joined the ILRC in 2015 as a staff attorney based in California’s Central Valley, where she was born and raised. Prior to joining the ILRC, she was a clinical instructor with the International Human Rights Law Clinic at UC Berkeley School of Law. At the clinic she directed the establishment of the Legal Support Program for undocumented students, the documentation of human rights abuses against LGBTI individuals in El Salvador, and the promotion of equal access to clean water in California. Allison practiced immigration law, first in private practice and then as founder of the immigration legal services program at Centro Legal de la Raza. Allison also formerly worked as a staff attorney with the Center for Gender and Refugee Studies at UC Hastings. She graduated from UC Berkeley with a JD and an MA in Latin American Studies. Allison speaks Spanish.
  • Veronica Garcia joined the ILRC in December 2017 as a San Joaquin Valley Law Fellow. Prior to joining ILRC, Veronica completed an Equal Justice Works Fellowship at Centro Legal de La Raza as an DACA/DAPA Emerson Fellow. Veronica is a graduate of Howard University School of Law. During Law school, Veronica interned at various immigrant right organizations, including Kids in Need of Defense and New York Legal Aid. September 23: Prison Abolition and a Mule

Incarceration is a relatively recent development in the history of punishment, with the first modern prison constructed in Philadelphia in the early 1800s. The American penitentiary was intended as a reform, making the institution of punishment more humane and rehabilitative.
Because the United States now locks up more people than almost any country in the history of the world, this nation is perhaps the best laboratory to assess the success of the experiment. By virtually any measure, prisons have not worked. They are sites of cruelty, dehumanization, and violence, as well as subordination by race, class, and gender. Prisons traumatize virtually all who come into contact with them. Abolition of prison could be the ultimate reform.
The lecture will suggest what would replace prisons, how people who cause harm could be dealt with in the absence of incarceration, and why abolition would make everyone safer and our society more just.

Paul Butler is the Albert Brick Professor in Law at Georgetown University Law Center and a legal analyst on MSNBC. One of the nation’s most frequently consulted scholars on issues of race and criminal justice, his work has been profiled on 60 Minutes, Nightline, and The ABC, CBS and NBC Evening News. He lectures regularly for the American Bar Association and the NAACP, and at colleges, law schools, and community organizations throughout the United States. He serves on the District of Columbia Code Revision Commission as an appointee of the D.C. City Council.
Professor Butler’s scholarship has been published in many leading scholarly journals, including the Georgetown Law Journal, Yale Law Journal, Harvard Law Review, Stanford Law Review and the UCLA Law Review. He was named the Professor of the Year award three times by the GW graduating class. He was elected to the American Law Institute in 2003. Professor Butler’s book “Let’s Get Free: A Hip-Hop Theory of Justice” received the Harry Chapin Media award. His book “Chokehold: Policing Black Men” was published in July 2017. The Washington Post named it one of the 50 best non-fiction books of 2017. Chokehold was also named one of the best books of the year by Kirkus Reviews and the Atlanta Journal Constitution. The New York Times described Chokehold as the best book on criminal justice reform since The New Jim Crow. It was a finalist for the 2018 NAACP Image Award for best non-fiction.

August 19: Valuing Speed: The Costs in Fairness, Accuracy & Money in Trying to Accelerate Executions

Long before COVID-19 ravaged the nation, the use of the death penalty has been on a downward trend for quite some time. This year, the use of the death penalty has reached a new low as governments faces practical challenges of COVID. In this webinar, our panelists will discuss how execution holds initially across the country and the widespread economic downturn in the United States have negatively impacted the use of the death penalty. Our panelists will also explore how the pandemic has affected capital litigation by threatening due process specifically at trial, in post-conviction, and in execution-date clemency proceedings, inhibiting the development of mitigation cases when attorneys and their aides and experts cannot work normally. Our panelists will unpack the controversy surrounding execution drug shortages. Ohio’s implementing a de facto moratorium on executions in light of the pandemic will be examined, and considered in the context of the state’s failure to implement the recommendations of an ABA assessment team and a commission created by the state government.
