Mock Trial and Moot Court Competitions provide an invaluable service to our students in preparing them to be better advocates, and we cannot hold them without you. We welcome attorneys from all practice areas to participate.
As a judge, you will provide feedback and evaluate the participants’ performance. We will provide you with details regarding the problem and fact pattern in advance of the competition. Judging for a MCHB competition is an opportunity to provide law students with valuable feedback on their trial advocacy skills. Volunteer judges are also invaluable to the continued success of the Moot Court Honor Board and the in-house competition program.

Note that you will receive 3 credits if you judge one round, but 5.5 if you judge a round in both competitions. This is because pre-competition training counts for .5 credits, but it is identical for both competitions, and so cannot be counted twice.

November 17/Webcast: Determining the Value of One Patented Feature: A Behavioral Alternative to a Consumer Survey #MCLE

Recent Federal Circuit decisions have made it more difficult to prove damages in litigation. This is especially true when the infringed patent relates to just one feature in a product with multiple features. Before a patent owner can obtain damages based on the entire market value of a product (patented and unpatented components sold together), the patent owner may be required to prove that the patented feature is the basis for consumer demand for the entire product. Other decisions require the patent holder to apportion the value of the whole product down to the patented feature.
Whether a damages expert’s opinion can meet these requirements is a critical question for all patent litigants. Ultimately, the persuasiveness and reliability of the factual data on consumer demand for a patented feature underlying the damages case can determine the financial outcome of the case.

This panel discussion will review the 2016 election and what the results will mean for a politically divided nation. 435 house seats, 34 senate seats, and a new presidential administration- the 2016 election will determine the course of the country for years to come, where key issues including Supreme Court appointments, climate change, health care, immigration, abortion rights and national security will be determined by the new balance of our government.
A panel of CWRU Law Faculty will analyze the legal issues that were at the fore during the 2016 presidential campaign and forecast what matters a new administration will face. December 1: Web - Avoiding the "Inevitable": The Growing Consensus that Recidivism Can Best Be Averted through Early Attention to Eventual Re-entry and by Effective Alternatives to Incarceration

There is a growing consensus throughout many parts of the country that society should re-examine and replace many traditional modes of dealing with convicted adults and juveniles found to have violated the law. Increasingly, initiatives focus as early as possible following arrest on the person's eventual re-entry into society. Individualized assessments from the outset can enhance the ways in which the person's health care, education, housing, employment, and mental health needs are addressed during confinement – leading to those who are released being far more likely to be productive citizens and far less likely to commit more crimes. Moreover, a growing number of diversion programs, as an alternative to conviction and incarceration – and their juvenile law equivalents -- avert the often disastrous collateral consequences and enhance re-entry prospects. Such diversion programs include street-level crisis intervention, problem-solving courts, and immediate diversion to behavioral health services, substance abuse treatment, housing and employment community providers, or educational programs.

Please join Ronald J. Tabak from Skadden, Arps, Slate, Meagher & Flom LLP, who co-chaired the special committee that led the New York State Bar Association to adopt unanimously a report and recommendations on these issues. He will:

Individualized assessments from the outset can enhance the ways in which the person's health care, education, housing, employment, and mental health needs are addressed during confinement – leading to those who are released being far more likely to be productive citizens and far less likely to commit more crimes. Moreover, a growing number of diversion programs, as an alternative to conviction and incarceration – and their juvenile law equivalents -- avert the often disastrous collateral consequences and enhance re-entry prospects. Such diversion programs include street-level crisis intervention, problem-solving courts, and immediate diversion to behavioral health services, substance abuse treatment, housing and employment community providers, or educational programs.

Please join Ronald J. Tabak from Skadden, Arps, Slate, Meagher & Flom LLP, who co-chaired the special committee that led the New York State Bar Association to adopt unanimously a report and recommendations on these issues. He will:
  • provide a national overview on how these issues are being addressed;
  • note some particular initiatives in New York; and
  • discuss how lawyers can work on re-entry as part of their overall pro bono work.

November 16: Cleveland - The Road to Exoneration: Litigating Wrongful Conviction Cases

In this program:
  • Brian Howe of the Ohio Innocence Project describing the history of the Ohio Innocence Project and its current efforts to establish a Cleveland OIP branch.
  • Carmen Naso, a professor at Case Western Reserve Law School and current advisor to CWRU Law’s externs for the county prosecutor and public defenders, will focus on how to select and successfully litigate wrongful conviction cases.
  • Raymond Towler, who was wrongfully convicted of rape and kidnapping and spent 29 years in prison in Cuyahoga County, will tell the story of his exoneration and of the difficulty re-entry issues that many exonerees face.
  • Terry Gilbert and David Mills are going to present on their extensive experience litigating wrongful conviction civil cases and how attorneys can successfully assist clients with a smooth re-entry into society.
