June 4: Seattle - Fostering Civility in the Legal Profession

Incivility in the legal profession impedes the pursuit of justice. Research shows that incivility wastes time, squanders economic resources, and burdens the courts. It also negatively impacts lawyers by increasing stress levels and creating greater propensity for them to suffer from substance and alcohol abuse, depression, isolation, and dissatisfaction with their work. Furthermore, it reduces the public’s perception of a fair and equitable process, thus decreasing confidence in our system.
Rooting the discussion in RPCs 1.1, 1.2, and 3.5, this one-hour presentation will identify characteristics of civility, explain the cost of incivility, and establish that civility both promotes a positive public perception of the justice system and is at the same time the best approach to serving individual clients’ interests. This session will demonstrate that the Washington State Rules of Professional Conduct neither mandate nor justify uncivil conduct; rather they discourage incivility and promote civility. We will end by considering personal strategies for fostering civility that both affirmatively build public confidence in the justice system and reduce the risk of unethical practice.

May 27: Webcast - Strategies for the Use of Expert Evidence in Post-Issuance Proceedings #MCLE

The U.S. Patent and Trademark Office’s inter partes review (IPR) proceedings have become an increasingly popular means for accused infringers to challenge the validity of issued patents. While an IPR may be a faster and less-expensive alternative to district court litigation, limitations on discovery and presentation of evidence in patent office proceedings raise concerns that are not present in the average litigation case. Although expert evidence is not required in every IPR, decisions of the Patent Trial and Appeal Board thus far have indicated that expert testimony is often crucial to success and that grant or denial of a petition for IPR can hinge upon the nature and structure of expert testimony. As a result, eliciting and attacking expert testimony can be an extremely important part of IPR proceedings.

June 3: NYC - Human Rights First's Spring Asylum Training

Human Rights First is planning an asylum training on June 3, 2015 for attorneys interested in taking a pro bono asylum case and others interested in learning more about asylum law and procedure. The training is free and CLE credit will be offered. No prior experience in immigration law is necessary. Since 1978, Human Rights First has worked to protect and promote fundamental human rights around the world. Human Rights First's Refugee Representation program assists indigent refugees from all backgrounds who have fled persecution on the basis of their race, religion, nationality, membership in a particular social group, or political opinion, and who are seeking asylum in the United States. Many of these asylum seekers are in urgent need of legal representation to prepare their cases for adjudication by judges at the Immigration Court. Others need representation before the Asylum Office. Some need legal assistance to seek release from immigration detention or representation to fight their cases from within the detention center. This training will give you a strong foundation for taking one of these cases for pro bono representation through our program.

    June 16: San Francisco - Creating Workplaces Free from Gender Identity Bias

    This MCLE will present a survey of state and federal law as it applies to gender identity and will focus on legal developments in employment protections, access to consistent identity documents and access to transition-related health care. The MCLE will conclude with tips for working with transgender clients and recommendations for how to create an inclusive workplace free from gender identity bias. The MCLE will also define and discuss some commonly used terminology.

    June 12: NYC - #Veterans Consortium Pro Bono Program Training #MCLE

    This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
    Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
    These trainings tend to fill up quickly, so register asap.

    June 5: Webcast - Protecting Domestic Violence Survivors and Children in California: Pro Bono Representation in Low-Income Domestic Violence Restraining Order Cases 2015

    Attend this program so that you can receive the training you need to represent low-income domestic violence survivors seeking domestic violence restraining orders in California, including crafting safe and effective child custody and visitation orders. Experienced attorneys will give you a practical training to enable you to obtain orders critical to protecting victims of abuse. A sitting judicial officer will give you the view from the bench on how these hearings proceed and pitfalls to avoid. These cases can often be handled in one or two hearings and make the essential difference in creating a safe and stable environment for the domestic violence survivor and family.
    What You Will Learn
    • Domestic Violence 101 - definitions, cycle of violence, working with survivors
    • California Domestic Violence Prevention Act restraining orders - procedures, forms, and relief
    • How to prepare clients for child custody recommending counseling and understand the role of court-based "Family Court Services"
    • How to prepare for and appear on a domestic violence restraining order hearing, including asking for support and safe and enforceable custody/visitation orders
    • California law on domestic violence and related issues so that you can adequately issue spot and advise clients, including:
