October 29: Medical Device Regulation: Going from Bad to Worse . . . or Better? with George Horvath


Innovations in medical device technology hold the potential to improve health outcomes across the populace. But these same innovations can inflict widespread harm; by some estimates, medical devices caused 1.7 million injuries and 83,000 deaths between 2008 and 2017. Hence, we need for a regulatory system that ensures safety while simultaneously permitting—or ideally, fostering—innovation. Over the past half-century, Congress and the FDA have created a unique and complex regulatory system that seeks to achieve these goals. But according to many critics, this system is far too lax, allowing devices to reach the market without an adequate assessment of safety; others maintain that FDA regulation is stifling innovation and depriving patients of valuable technology.
This talk will focus on some of the perennial shortcomings of medical device regulation, on how the regulatory framework might be altered to achieve its goals, and, in an era of changing administrative priorities and limited agency resources, on how we might begin to move forward.

George Horvath
joined the UC Law SF faculty as an Associate Professor of Law in 2024. His scholarship combines his background as a practicing physician and medical scholar with empirical and doctrinal legal analysis to study the fraught intersections of law and health care. His work examines the ways in which statutory, regulatory, and implementation choices about the FDA’s role in regulating medical devices and drugs has impacted safety and innovation. Prior to joining the UC Law SF faculty, Professor Horvath was an Assistant Professor of Law at the University of Akron School of Law. He was a postdoctoral Fellow in Public Law at the University of California, Berkeley, School of Law. He clerked for Judge John T. Noonan, Jr. on the Ninth Circuit Court of Appeals. Professor Horvath earned his J.D. at Berkeley Law, where he served as Editor-in-Chief of the California Law Review. Prior to his legal career, Professor Horvath earned his M.D. at Temple University Medical School and practiced as a cardiologist specializing in the study and treatment of heart rhythm disorders.

October 14: Unmasking the Financialization of Healthcare with Jacqueline Fox

Financialization of healthcare drains our current system of resources it needs to provide care. It occurs when money is siphoned off for private profit through mechanisms such as rent seeking, gamesmanship, and exploitative price setting. This is not an ethically neutral activity, and the people profiting in this way ought to justify why they are entitled to this money, given the foreseeable negative effects what they are doing has on people’s health. This important problem is masked by current accounting methods and healthcare billing methods, which need to be changed to allow for a more transparent assessment of what is really occurring.

Jacqueline Fox
teaches Health Care Law and Policy, Public Health Law, Bioethics, and Torts. She has published numerous articles on health law, health care financing and regulation, and health care reform in publications including the University of Cincinnati Law Review, Buffalo Law Review, Seton Hall Law Review, the Yale Journal of Health Policy, Law, and Ethics, the International Journal of Healthcare Technology and Management, and The Hasting Center's Health Care Cost Monitor. Her current work closely examines the newly created Independent Payment Advisory Board, which is tasked with capping the costs of the Medicare program. She has published op-ed pieces in The State newspaper and appeared on local and regional news shows speaking on the subject of health law. Her work on Medicare, in particular, has been cited in a number of scholarly publications and one of her contributions to the Hastings Center health reform publications has been the subject of an article in the New York Times. She has also been an invited speaker at universities including Oxford University, the University of Toronto, Johns Hopkins University, and Yale University. She was a visiting professor at the Santa Anna University in Pisa, Italy, for the spring semester of 2009. Fox received her B.A. from Sarah Lawrence College and J.D. and LL.M. from Georgetown University. Prior to joining the faculty at the University of South Carolina, she was a Greenwall Fellow at Johns Hopkins and Georgetown Universities, and a Donaghue Scholar of Research Ethics at Yale University.

Professor Jessie Hill
Professor Jessie Hill’s
teaching and scholarship focus on constitutional law, civil rights, reproductive rights, and law and religion. Her articles have been published in the Michigan Law Review, Duke Law Journal, Georgetown Law Journal, and Texas Law Review, among others. She has also appeared in numerous local and national press outlets, including CNN, the New York Times, Ms. Magazine, and NPR.
Professor Hill is a frequent lecturer and consultant on reproductive rights issues, and she is currently litigating numerous challenges to abortion restrictions in Ohio. She is the founding director of the Reproductive Rights Law Initiative at the School of Law, which provides education and legal support relating to reproductive rights. Her work was recently profiled in the Case Law-Med magazine.
Professor Hill has received recognition for her work both within and outside the academy. She is a recipient of the university’s Distinguished Research Award. She has also been appointed a Nootbaar Fellow in Law and Religion at Pepperdine University Caruso School of Law. In 2023, she received both the Black Law Students Association Faculty Award and the Champion for Women Award from the Cuyahoga Democratic Women’s Caucus, and she has been recognized by the ACLU of Ohio for her reproductive rights advocacy.
She joined the faculty in 2003 after practicing First Amendment and civil rights law with the firm of Berkman, Gordon, Murray & DeVan in Cleveland. Before entering private practice, Professor Hill worked at the Reproductive Freedom Project of the National ACLU office in New York. She also served as law clerk to the Honorable Karen Nelson Moore of the United States Court of Appeals for the Sixth Circuit. She received her JD, magna cum laude, from Harvard University and her AB, magna cum laude, from Brown University.

Coordination, Not Competition: Achieving Value-Based Care Through Shared Governance with Jessica Mantel
Description:
Value-based payment (VBP) aims to transform healthcare by incentivizing providers to improve patient outcomes and reduce costs through better care coordination, preventive strategies, and increased efficiency. Yet VBPs have struggled to deliver on their promise. 
Attorney Jessica Lind Mantel will discuss a key reason for this limited progress – a regulatory framework that relies on market forces and grants payers significant autonomy in designing and implementing VBP models. This decentralized, bottoms-up approach leads to misaligned payment policies that create barriers for providers seeking to redesign how they care for patients. 
Mantel advocates for an alternative approach: value-based governance. This model emphasizes collaboration among government agencies, payers, providers, patient advocates, and other stakeholders, replacing fragmented, market decision-making with coordinated public-private efforts that foster payment alignment. Value-based governance can address other systemic challenges to health reform by advancing technical assistance programs that support providers transitioning to value-based care, improving health data-sharing infrastructures, and promoting a workforce equipped to deliver value-based care. Through shared responsibility for policy outcomes and horizontal coordination across the public and private sectors, value-based governance offers a pathway to successfully transforming the healthcare delivery system.

Speaker:
Jessica Lind Mantel joins the Health Law & Policy Institute as co-director after eight years of service with two government agencies in Washington, D.C. She worked most recently as a senior attorney in the Office of the General Counsel for the Department of Health and Human Services. In that position she advised Centers for Medicare and Medicaid Services on legal issues dealing with Medicare matters, including implementation of the prescription drug benefit, hospital payments, incentive payments for the adoption of electronic health records, and health care reform. She previously worked as a health policy analyst in the Government Accountability Office evaluating Medicare payment issues. Prior to her service with government agencies, she practiced as an associate in the Health Care Department of the firm of Ropes & Gray in Boston and clerked for the Honorable Karen Nelson Moore of the U.S. Court of Appeals for the Sixth Circuit in Cleveland. Her research interests include the impact of various legislative and regulatory schemes on emerging trends in the health care delivery system and the allocation of limited health care resources. In 1997, Mantel received both her JD from the University of Michigan Law School and an MPP from the University of Michigan School of Public Policy. She also holds a BA in psychology from the University of Pennsylvania.

Speaker:
Jessie Hill’s teaching and scholarship focus on constitutional law, civil rights, reproductive rights, and law and religion. Her articles have been published in the Michigan Law Review, Duke Law Journal, Georgetown Law Journal and Texas Law Review, among others. She has also appeared in numerous local and national press outlets, including CNN, the New York Times, Ms. Magazine and NPR.
Hill is a frequent lecturer and consultant on reproductive rights issues, and she is currently litigating numerous challenges to abortion restrictions in Ohio. She is the founding director of the Reproductive Rights Law Initiative at the School of Law, which provides education and legal support relating to reproductive rights. Her work was recently profiled in the Case Law-Med magazine.
Hill has received recognition for her work both within and outside the academy. She is a recipient of the university’s Distinguished Research Award. She has also been appointed a Nootbaar Fellow in Law and Religion at Pepperdine University Caruso School of Law. In 2023, she received both the Black Law Students Association Faculty Award and the Champion for Women Award from the Cuyahoga Democratic Women’s Caucus, and she has been recognized by the ACLU of Ohio for her reproductive rights advocacy.

March 19: Evaluating Hospital Procedures for Authorizing Emergency Abortion

All states that have banned or restricted abortion after the Supreme Court’s decision in Dobbs v. Jackson Women's Health offer some exception for abortions that are medically necessary to save a patient’s life during an emergency. However, the internal procedures for reviewing and approving requests for emergency abortion vary dramatically from institution to institution. In some hospitals, the treating physician can make this judgment on their own; in others, an ethics committee must review the decision; in others, hospital counsel may impose limits on physicians’ authority to terminate pregnancy.
 Prof. Sawicki will offer insights as to how well each of these decision-making procedures balance patient safety, clinical standards of care, medical ethics and legal risk, with the goal of encouraging hospital attorneys and health care providers to thoughtfully select approaches that best meet their patients’ needs.

Speaker:
Prof. Nadia Sawicki’s areas of expertise include torts, health law and bioethics. Her scholarly work addresses subjects including the law's role in shaping the informed consent process; tort law's limitations in protecting the rights of patients in the end-of-life and reproductive health contexts; the challenges of protecting patients' rights to safe and accessible medical care while also accommodating health care providers' conscientious beliefs; and the state’s role in enforcing ethical norms in medicine.
In 2020, Prof. Sawicki was elected as a member of the American Law Institute. She has previously served as a member of the American Bar Association’s Special Committee on Bioethics and the Law, and co-chair of the American Society for Bioethics and Humanities’ Law Affinity Group.
Prior to joining Loyola, Prof. Sawicki held the inaugural George Sharswood Fellowship at the University of Pennsylvania Law School, where she taught bioethics and public health law. She has also served as a lecturer in History and Sociology of Science at the University of Pennsylvania's School of Arts and Sciences, practiced law with Wolf, Block, Schorr & Solis-Cohen, and clerked for the Honorable J. Curtis Joyner of the U.S. District Court for the Eastern District of Pennsylvania. Before attending law school, Prof. Sawicki worked as an analyst in the Nursing Executive Center at the Advisory Board Company.
