August 30: European Patent Filing Strategies: Choosing the Appropriate Option #MCLE

A number of patent filing strategies are available in Europe. Patent applications may be filed at the European Patent Office (EPO) and at national patent offices such as the UK Intellectual Property Office (UKIPO) and the German Patent and Trade Mark Office (DPMA). Utility model applications are another form of intellectual property protection that can be pursued in certain countries. Each option has its advantages and disadvantages, and some approaches may be more appropriate in certain circumstances based on cost and other concerns. Recent developments may also have an impact on which filing strategy makes the most sense.

September 22: Representing the Pro Bono Client: Advocacy Skills for Administrative Hearings 2016


The need for pro bono assistance with administrative hearings has never been higher. Clients who have been denied or are at risk of losing vital public benefits, employment benefits, and/or housing subsidies, have a right to an administrative hearing, but are often unrepresented in what can be a confusing and adversarial process. Significant changes to key benefits programs, including Social Security, General Assistance, CalWORKs, CalFresh, Medi-Cal and In-Home Support Services have occurred in recent years imposing new complex rules. On the unemployment insurance front, while the number of applications has overall declined, we have yet to see a reverse of the recession-based trend of employers challenging many unemployment insurance benefit applications. Housing Authorities frequently seek to deny and revoke housing subsidies often due to tenuous allegations of criminal activity. Meanwhile, low-wage workers are experiencing wage theft at unprecedented rates and relying on the Labor Commissioner more than ever before to recover their unpaid wages.
Legal aid services have also suffered funding problems and staffing cuts with reduced ability to meet the demand to represent clients in these cases. Unfortunately, many individuals who are entitled to desperately-needed benefits but have had their benefits improperly denied, lowered, or terminated, who are at risk of losing a housing subsidy, or who are not paid according to basic wage and hour laws cannot make it through the administrative hearing process on their own. As a result, low-income families face the very real possibility of hunger, homelessness, and instability.
This training is designed to help mitigate the crisis faced by low-income families everywhere by providing attorneys with a basic understanding of common issues and strategies in providing pro bono assistance with administrative hearings. The program will focus on California law, but will also cover many topics such as due process and other rights that apply nationwide; therefore, advocates from other forums would benefit from the information and attending the program.
What You Will Learn

  • An overview of administrative hearings low-income clients most frequently need involving:
  • State public benefits, including General Assistance, CalWORKs, CalFresh, Medi-Cal and Unemployment Insurance claims;
  • Federal public benefits, including Supplemental Security Income;
  • Federally assisted housing programs, including public housing and Housing Choice Voucher Program (HCVP or "Section 8"); and
  • Unpaid wages, and other wage and hour-related rights.
  • Best practices and common advocacy strategies, preparation, and procedures for administrative hearings, including:
  • Obtaining evidence: informal and formal discovery
  • Drafting position statements/hearing briefs
  • Presenting your case at hearing
  • Alternatives: Informal resolution
  • Rehearings and further appeals
  • California law and practice specifics

All attorneys interested in or currently assisting pro bono clients with administrative matters through representation or in clinical settings; law firm pro bono coordinators, managers and partners; law clinic students and faculty; and public interest and non-profit legal services attorneys and staff would benefit from attending this program.

September 15: Webcast - Bankruptcy Basics for Low-Income Clients 2016

Although the economy is improving and foreclosures in many parts of the country are in decline due to rising home values, financially marginalized people still file bankruptcy in disproportionate numbers. Many debtors are unrepresented and bankruptcy clinics are still in great demand. There is a critical need for pro bono attorneys to assist low-income clients at all levels. The practice of bankruptcy law is ever changing (all of the forms changed effective April 1, 2016) and can be quite complicated with even the simplest form of bankruptcy, Chapter 7. This basic program was developed for brand new practitioners and those who are either not familiar with the practice or have not practiced bankruptcy law since the passage of BAPCPA. The program hopes to develop practitioners who will volunteer their time and skills to those who cannot afford representation. The program will focus on Chapter 7 bankruptcy, from the day a new client walks into your office, to the day you receive notice that they have successfully received a discharge and their case is closed.
What You Will Learn
  • An overview of Chapter 7 bankruptcy
  • Duties and due diligence of the attorney
  • How the discharge works and the effectiveness of the automatic stay
  • How to protect the debtor’s property through exemptions
  • An overview of the means test for the low-income client
  • Issues in bankruptcy to be aware of and understand
This program was designed for practitioners, paralegals and legal assistants who are new to bankruptcy or new to BAPCPA. It is a basic “How to File a Chapter 7” program.
If you would like to volunteer in pro bono clinics, develop bankruptcy as one of your practice areas, or are a new attorney who wants to develop a bankruptcy practice, this program will give you the tools you need to get started in the practice of Chapter 7 bankruptcy.

September 13: Webcast - California’s Proposition 47 Two Years On: Find Out What to Do Now

In November 2014, California’s Proposition 47 reduced many theft and forgery crimes worth $950 or less, and most simple drug possession crimes, for people without sex offenses or strike priors, down from felonies, or possible felonies, to straight misdemeanors. It also gave people with prior convictions three years to petition to have those reduced. For the most part, this is working well, but many recurring issues are still unresolved.
Join Garrick Byers as he addresses the following issues, including:
  • Is paying for a meal at a restaurant using a stolen credit card felony burglary, or misdemeanor shoplifting? Does the client still have a prison prior if the underlying felony is now reduced?
  • The Courts of Appeal keep filing cases, but the California Supreme Court keeps granting review. Have the amended Publication rules, letting us cite published cases that are on review, clarified things, or made the law more murky then ever? 
  • Hundreds of thousands of Californians are eligible for relief. A felony record makes housing and jobs hard to get. Can we reach them all in one year? And what about new clients who walk in your door with prior or present Prop. 47 offenses? 
  • Prop. 47 was supposed to generate millions of dollars to be used for education, drug treatment and to combat recidivism. What is happening to that?

Peter Eigen, is the founder of Transparency International and pioneer of the global fight against corruption. Eigen has developed and led groundbreaking initiatives to improve governance and raise awareness of the devastating effects of corruption on economic growth, social welfare and justice. Eigen, a lawyer by training, has worked in economic development for several decades. He has seen how abuses of power can undermine the public’s trust and cost people their freedom, health, money and, sometimes, their lives. Following positions with the World Bank in Latin America and Africa, Eigen founded Transparency International (TI) in 1993. With chapters in more than 100 nations, TI has become the leading non-governmental organization promoting transparency and accountability in development. In addition to leading TI's Advisory Council, Eigen now focuses on Global Governance, especially around natural resources extraction.

August 12: Webcast - Reentry in California – Overcoming Legal Barriers to Community Reintegration 2016

In the past three decades, incarceration rates have exploded in the U.S., such that today we incarcerate over two million people, more than any other country in the world. The result is that many more people encounter the criminal justice system at some point in their lives. Indeed, an estimated 1 in 3 adults in California has an arrest or conviction record, and low-income people and people of color are disproportionately affected.
A person with a prior record faces significant employment and housing barriers, even when the record is old or unrelated to the job or housing. These barriers impede community reintegration and prevent formerly incarcerated people from being able to support themselves and their families or participate equally as members of their communities. This training is designed to give lawyers a foundation in the collateral consequences that result from contact with the criminal justice system, as well as tools for representing clients in need of reentry legal services.

Further Notes On CLE Credit:
  • Alaska: Alaska Bar members may claim credit for attendance at CLE programs offered in or from other states if the program has been accredited by another MCLE jurisdiction
  • Arizona: The State Bar of Arizona does not accredit programs for the MCLE requirement. The Rules and Regulations are predicated on the assumption that attorneys can evaluate CLE activities offered based on the guidelines and report their activities by affidavit.
  • Arkansas: Upon receipt of a completed certificate of attendance form confirming attendance at an out-of-state continuing legal education program approved by the situs state, the attorney shall be entitled to CLE credits in Arkansas.
  • California: Program is eligible for California CLE credit only if the attorney is calling in from outside of California. The program cannot be taken for California credit if you call in from California.
  • Colorado: Colorado attorneys should submit a Colorado Affidavit form along with a statement certifying that the CLE program is accredited in another mandatory CLE state.
  • Florida: Courses approved by other state bars are generally acceptable for use toward satisfying CLE requirement but attorneys must first submit a CLE Application for Course Attendance Credit.
  • Hawaii: Program is eligible for Hawaii CLE credit only if the attorney is calling in from outside of Hawaii. The program cannot be taken for Hawaii credit if you call in from Hawaii.
  • Iowa: 1.0 CLE credit applied for.
  • Maine: Credit hours for activities approved by another MCLE state will be accepted for identical credit by the Board of Overseers of the Bar in Maine upon the Board's receipt of evidence of such certification as issued by that state
  • Minnesota: 1.0 CLE credit applied for.
  • Montana: Montana will honor the approval given by other CLE jurisdictions. Simply attach documentation of the other state's approval to your affidavit at the end of the reporting year.
  • New Jersey: New Jersey attorneys who are taking courses approved for CLE by another state will receive 1:1 credit for courses approved in that jurisdiction through reciprocity.
  • New York: Attorneys may claim New York CLE hours for programs accredited Wisconsin.
  • Wisconsin: 1.0 CLE credit applied for.
  • Other States: CLE credit is available in many other states if the participating attorney applies for credit. For further information on reciprocity, see the Baran CLE Reciprocity Guide.

As technological development moves seemingly at the speed of light, lawyers' ethical duties to zealously protect privilege and confidentiality are more complex than ever before. This course includes discussion on:
