May 3: Can Google Help Itself to Some Java? Google v. Oracle - APIs, Fair Use, and Copyright Law

Extra Mile Law, PLLC, is pleased to present another CLE class in its Monday CLE webinar series. Join Jonathan Grad of Extra Mile Law, PLLC for this fast-moving, basic class about the recent Supreme Court decision in Google v. Oracle.
The case dealt with whether Google infringed on Oracle's copyright when Google copied portions of an Application Programming Interface (API) owned by Oracle.
We will look briefly at aspects of copyrighting computer programs and focus on copyright law and the fair use doctrine as discussed by the Court. We will include a brief background explanation of APIs and their use in computer programming.
This basic class will be taught at a level suitable for people without any copyright law background and without any computer programming background.
The goal of the class is to introduce the participants to some basic concepts concerning software, copyright law, and fair use using Google v. Oracle as a framework.

April 28: Adapting to Climate Change: Economic and Legal Perspectives

Some degree of significant climate change is inevitable. Even aggressive greenhouse gas emission reduction strategies will not eliminate the need to adapt to ongoing environmental changes. Adaptation will be an essential element of the climate policy toolkit. In the new book, Adapting to Climate Change: Markets and the Management of an Uncertain Future, economist Matthew Kahn explores how decisions about where we live, how our food is grown, and where new business ventures choose to locate are impacted by climate change and suggests new ways that big data can be deployed to ease energy or water shortages to aid agricultural operations and proposes informed policy changes related to public infrastructure, disaster relief, and real estate to nudge land use, transportation options, and business development in the right direction.
The law, however, is not always attentive to ecological demands, and to the broader environmental changes wrought by climate change. How climate adaptation occurs will be influenced and shaped by legal rules, both in the context of environmental law and more broadly.
In this webinar, Matthew Kahn, Bloomberg Distinguished Professor of Economics and Business, and Robin Craig, James I. Farr Presidential Endowed Professor of Law, will examine the law and economics of climate adaptation.

April 26: Policing and 'Bluelining'

The speaker will explore the increasingly popular claim that racialized brutality is not a malfunction of policing, but its function. Or, as Paul Butler counsels, “Don’t get it twisted—the criminal justice system ain’t broke. It’s working just the way it’s supposed to.”
This claim contradicts the conventional narrative, which remains largely accepted, that the police exist to vindicate the community’s interest in solving, reducing, and preventing crime. A perusal of the history of organized policing in the United States, however, reveals that it was never mainly about interdicting crime.
From its inception in the late 1800s, organized policing served the social, political, and economic priorities of empowered groups, from supporting Southern agrarian capitalist interests by imposing de facto slavery on emancipated Blacks to bolstering Northern industrialization by oppressing immigrant laborers. Thereafter, police forces grew in response, not to spikes in garden-variety crimes, but to political campaigns and cultural anxieties. And today, it remains contested whether current policing practices—especially street policing—function to alleviate, rather than exacerbate, crime problems.
While policing’s crime-reduction success is questionable, one obvious tremendous success has been its control of race, space, and place. Police draw blue lines around Black neighborhoods—just as banks drew their red lines—designating them as high-risk, pathological spaces. Police use aggressive stop and frisks, intense surveillance, and military-style home raids to keep the people in their spatial and social place. Brutality is the business of policing, reinforced in recruitment, training, and practice. Prof. Gruber will conclude that because racialized brutality is integral to policing, reformers should not primarily focus on incarcerating specific bad cops who draw headlines. The “bad apple” narrative casts racist violence as individual and deviant rather than institutional and structural and undermines the current promising, if glacial, movement toward dismantling policing as we know it.

April 20: Navigating Real Estate Issues for Cannabis Businesses

Cannabis licenses are location specific, and every state agency governing the issuance of cannabis licenses requires applicants to demonstrate “site control”, typically in the form of a lease, deed, or enforceable option to purchase. 
As a result, prospective cannabis business operators often face a funding conundrum - it is frequently difficult to fund a business without a license, but one cannot obtain a license without real estate, which requires some funding.
 Whether to purchase or lease real estate becomes a critical decision for any operator. The Company’s ability to secure Real Estate – a hard asset -- against financing must be carefully balanced against maintaining sufficient liquidity to sustain operations.
This program, presented by Katy Young, Managing Partner of Ad Astra Law Group, LLP, President of the International Cannabis Bar Association, and Lauren Rudick, co-founder of Hiller P.C.’s Cannabis Practice, will provide examples of creative solutions to resolving these threshold real estate focused application requirements.   • Laura Graham is executive director of the Yemen Accountability Project (YAP) and principal author of YAP's white paper "Prosecuting Starvation Crimes in Yemen's Civil War." Graham's recent work on atrocity crimes explores the relationship between the Security Council and the ICC, as well as the prospects of bringing accountability to perpetrators of atrocity crimes in Yemen. She is a third year law student at Case Western Reserve University School of Law and holds a PhD in Sociology. Her expertise is in ethnic conflicts, genocide, and mass atrocities. 
  • Milena Sterio is Professor of Law and Associate Dean for Faculty Enrichment at Cleveland State University's Marshall College of Law. She is author of The Right to Self-Determination under International Law, and co-editor of Prosecuting Maritime Piracy: Domestic Solutions to International Crime. Professor Sterio has established herself as one of the most prominent and influential experts in the field of maritime piracy. She has participated in the work of the United Nations' Contact Group on Piracy off the Coast of Somalia, and is a member of the Piracy Working Group, an academic think tank created within the auspices of the Public International Law and Policy Group. Her academic work has been cited in two piracy prosecutions in the United States' federal courts.
  • James C. Johnson is the Chief Prosecutor of the Residual Special Court for Sierra Leone, appointed by the Secretary-General of the United Nations in September, 2019.  He is an Adjunct Professor of Law, Director of the Henry T. King Jr. War Crimes Research Office and Faculty Advisor for the Yemen Accountability Project at Case Western Reserve University School of Law in Cleveland, Ohio, a Senior Peace Fellow at Public International Law & Policy Group, and President of Global Accountability Network.  From 2003 until 2012, Mr. Johnson served as Senior Trial Attorney and then Chief of Prosecutions for the Special Court for Sierra Leone. As such, Mr. Johnson supervised trial and investigative teams, which prosecuted ten accused, including the former President of Liberia, Charles Taylor, for war crimes, crimes against humanity and other serious violations of international law.

April 19: TCPA Litigation and Compliance After the Supreme Court’s Decision in Facebook v. Duguid: What Every Business Should Know

The Telephone Consumer Protection Act (TCPA) has been the basis of significant litigation over the past few years. Companies in many industries — including retail, hospitality, financial services, insurance, pharmaceuticals, technology, media, and telecommunications — have been targeted in class actions, individual cases, and pre-suit demand letters challenging calling, text messaging, and faxing activities. 
An automated call provision in the TCPA contains a single term that, while unambiguous in the statutory text, has been the subject of extensive litigation, multiple rounds of comments unresolved by the Federal Communications Commission, and conflicting interpretations across the Circuits. The key question has been: what is an “automatic telephone dialing system” (ATDS)? 
The 2nd, 6th, and 9th Circuits adopted an expansive and atextual interpretation of an ATDS while the 3rd, 7th, and 11th Circuits adhered to the statute’s language and the legislative intent. As a result, there has been an explosion of ATDS-based litigation in select jurisdictions.
On April 1, 2021, the Supreme Court issued a unanimous decision and reversed the broad interpretation set forth by the 9th Circuit. This ruling has significant implications for businesses that engage in calling and text messaging activities. Certain aspects of the statute have been dramatically altered while others remain minefields for litigation risk. And other federal and state laws that have taken a backseat to the TCPA pose new traps for unsuspecting businesses in connection with legitimate and valued customer engagement activities.

April 14: Litigation and Legislative Update: The Biometric Information Privacy Act (#BIPA)

As the privacy landscape evolves, the Illinois Biometric Information Privacy Act (BIPA) remains the basis of significant class action activity in federal and state courts. It is one of the most popular privacy laws among the plaintiffs’ bar with “mini-BIPAs” being contemplated in other states. Unfavorable rulings, including the Rosenbach decision from the Illinois Supreme Court, paved the way for a considerable number of putative class actions against good faith businesses across industries with operations, employees, and/or consumers in the state. These cases challenging biometric employee timekeeping systems, asset protection finger or palm printing tools, facial recognition technology, temperature/wellness check technology, health monitors, and iris and retina scans have flooded the courts and subjected companies to crushing aggregate exposure (statutory damages of $1000 up to $5000 per violation plus attorneys’ fees and costs).
There are key pending appellate-level cases that should provide clarity on key issues related to the statutes. There are also active legislative developments poised to put much-needed measures in place to rein in the minefield of litigation risk.
Our speakers are at the forefront of the litigation and legislative developments and will provide a valuable update on the state of play and what companies should be aware of as they navigate the current — and future — BIPA environment.
