October 21: The Rule of Five: Making Climate History at the Supreme Court


Richard Lazarus will be lecturing about his book, “The Rule of Five”, which is the gripping inside story of how an unlikely team of lawyers and climate activists overcame conservative opposition—and their own divisions—to win the most important environmental case ever brought before the Supreme Court. 
When the Supreme Court announced its ruling in Massachusetts v. EPA the decision was immediately hailed as a landmark. But this was the farthest thing from anyone’s mind when Joe Mendelson, an idealistic lawyer working on a shoestring budget for an environmental organization no one had heard of, decided to press his quixotic case.
In October 1999, Mendelson hand-delivered a petition to the Environmental Protection Agency asking it to restrict greenhouse gas emissions from new cars. The Clean Air Act had authorized the EPA to regulate “any air pollutant” that could reasonably be anticipated to endanger public health. But could something as ordinary as carbon dioxide really be considered a harmful pollutant? And even if the EPA had the authority to regulate emissions, could it be forced to do so? 
Environmentalists urged Mendelson to stand down. Thinking of his young daughters and determined to fight climate change, he pressed on—and brought Sierra Club, Greenpeace, NRDC, and twelve state attorneys general led by Massachusetts to his side.
This unlikely group—the Carbon Dioxide Warriors—challenged the Bush administration and took the EPA to court. The Rule of Five tells the story of their unexpected triumph. We see how accidents, infighting, luck, superb lawyering, and the arcane practices of the Supreme Court collided to produce a legal miracle. An acclaimed advocate, Richard Lazarus reveals the personal dynamics of the justices and dramatizes the workings of the Court. The final ruling, by a razor-thin 5–4 margin, made possible important environmental safeguards which the Trump administration now seeks to unravel.

October 15: A State-Provincial Approach to Harmful Algal Blooms in the Great Lakes Basin: Possibilities and Pitfalls


Harmful algal blooms (HABs) are negatively impacting the Great Lakes. The Lakes should be enjoyed for recreation and serve as the home to bountiful freshwater species, however, this precious resource is becoming increasingly toxic. Much has been written and studied about the causes of HABs, and numerous solutions have been proposed. However, there are many cooks in the remedial kitchen and the progress toward remediation has been stalled and uncoordinated.
This symposium will present such a framework by two leading scientific and legal experts on HABs. Professor Irena Creed, Associate Vice President for Research at the University of Saskatchewan and Fellow of the Royal Society of Canada, and Kathryn Friedman, Global Fellow at the Woodrow Wilson International Center for Scholars Canada Institute and Research Professor at the University at Buffalo, will propose a state-provincial framework for tackling HABs. This proposal will then be reviewed by a panel of federal, state and provincial environmental regulators and a panel of industry and non-government organization stakeholders. The timely questions to be answered include: Whether is a state-provincial framework necessary? Is it possible? What are the challenges? How can an enforceable and successful framework be created?

November 12: Critical Conversations: Racial Justice and the Immigrant Rights Movement

The Binger Center’s Annual Immigration Law Forum brings together lawyers, students, advocates and community members to learn from each other and develop tools to continue the struggle to protect human rights, basic dignity and the rule of law. This year’s forum will engage lawyers and advocates in critical conversations about race. Sessions will address historical lineages and systemic racism in the immigration system with a focus on anti-Blackness, the identity questions that surround how the immigrant rights movement is defined and intersects with other movements, and how community partners across sectors can come together to support noncitizens and advance racial justice. This online virtual conference will be interactive and action-focused, with sessions throughout the day followed by breakout discussions. The goal of the forum is to empower participants to re-ground their work to invoke long term systemic change and build networks with advocates across the country.

October 12: Planting the Seeds of Violence: How U.S. Involvement in El Salvador Led to Today’s Migration Crisis

Join us for a discussion of how U.S. involvement in El Salvador in the 1980s planted the seeds for today’s crisis of migration from Central America. The panelists will outline how the United States assisted the Salvadoran government in committing war crimes by providing weapons and training soldiers, which ultimately led to the murders of over 70,000 innocent civilians. The Salvadoran Civil War left the country deeply divided and ridden with economic troubles. When the U.S. forced Salvadorans who had sought refuge in Los Angeles to return home, they brought back a gang system that grew in response to the harsh post-war inequalities. Today’s migrants are fleeing the continuing violence and financial devastation.

  • Kristina Aiad-Toss is a third-year Juris Doctor student at Case Western Reserve University School of Law and an International Business Law LLM Candidate at Middlesex University in London. She has focused her studies and professional experience on corporate social accountability and human rights. In law school, Kristina has researched land rights and sustainable land use in Myanmar, war crimes and human rights in El Salvador, labor and environmental rights in Peru, crimes against humanity in Yemen, and export control regulations in the context of the Israeli occupation of Palestine in Ramallah. She has worked for different NGO’s including Human Rights Watch, International Partners in Mission, Landesa, the Association for the Sustainable Development of Peru - CITEPAPA, and Al-Haq. She is a member of the Vis International Commercial Arbitration Moot court team and has worked on civil rights issues at the Ohio Attorney General's Office, Margolius Law, and Debevec Law Firm.
  • Brenna Dilley joined IPM in May 2019 as a law student intern investigating war crimes that took place during the Salvadoran Civil War, along with U.S. involvement in aiding and abetting those war crimes. She worked as IPM’s Director of Education & Community Engagement through April 2020. She dedicated 8 years to nonprofit work in the form of refugee work in Senegal, victim advocacy in various women’s shelters, children’s shelters and county jails. Brenna is the founder and president of Inn(H)er Change Network (IHC), which provides human trafficking survivors access to rescue and justice. She founded IHC to provide victims with an opportunity for rescue once they are separated from their traffickers. She collaborates with the Cuyahoga County Regional Human Trafficking Task Force, Human Trafficking Clinic at CWRU School of Law, local prosecutors, judges, medical professionals, and community non-profits to raise anti-trafficking awareness. Brenna is collaborating with the CWRU Mandel School of Applied Social Sciences and local law enforcement to bridge a path of justice for victims of sex trafficking who become overwhelmed by the legal system. 
  • Adela Zayas is the Director of International Partnerships and Programs & Regional Director for Latin America and The Caribbean for IPM. She studied psychology at Universidad Centroamericana “José Simeón Cañas” (UCA).  Adela is passionate about working with women, children and youth, and has developed multiple programs with TECHO El Salvador (a non-profit human rights organization), Artesanas del Mar (which supports the social, personal and economic development of young women from vulnerable communities), and Fundación Artesanas (which uses art, social entrepreneurship and psychology to promote healthy environments for women). She also volunteers as a psychotherapist at the Psychological Assistance Clinic – UCA, where she provides therapy to children, adolescents and adults and is helping to build a mental health web platform to democratize psychotherapy and increase access through online care.
