June 20: Cyber Law and Cybersecurity Insurance 101

With data breaches and security incidents happening daily, it is not a matter of IF you will experience a cybersecurity incident, but WHEN. Cybersecurity threats are growing in scale and complexity and virtually every company in all industries face growing cyber risks.
As cybersecurity laws and regulations unfold and consumer lawsuits become the norm, cybersecurity remains a top concern for businesses, including the C-suite. Although there is no substitute for strong cybersecurity management, businesses often look to cybersecurity insurance policies as the last line of defense. However, cyber policies are complex, often confusing, and the cyber insurance landscape is still evolving.
This 60-minute seminar will provide an update on the current state of Cyber Law, including data breaches and privacy issues; current litigation; cybersecurity laws and regulations; cybersecurity insurance coverage with practical tips on key issues and risks to consider when purchasing a cybersecurity policy; recent trends; and available cyber resources.

For the 2024 program, we turned to practicing lawyers — the lawyers in the trenches — and we asked them what’s on their minds in the area of lawyer ethics. What problems do they see day in and day out? And we listened. The 2024 all-star panel will address hypotheticals and ethical issues that came from you. They will discuss issues from the revised IOLTA account rules to double billing issues.

April 19: Data Security Ethics for Law Firms

As it is clearly stated in the ABA Model Rules, we no longer have the option to turn a blind eye towards technology. Regardless of how much we like or dislike frantically trying to keep up with the unrelenting pace of technology, we are under obligation to do so. This class will work to make this a manageable feat. In this seminar we will review:
  • Connecting to a depo in realtime . . . securely and simply
  • Emailing transcripts, exhibits, or any file securely
  • Are you secure when using cell phone for email?
  • Ransome-ware and data loss
  • What to do if you are hacked
  • What does the future hold? Is there any hope for security?

April 13: Reclaim Your Day with Automated Law Firm Workflows

Whether we like it or not, administrative tasks are a fact of life for lawyers: did the fee agreement get drafted and sent out to that potential new client? Has discovery been propounded in this case? Did the client receive a certified copy of their final order?
So much of what we do as attorneys is trying to ensure that nothing falls through the cracks in a given case. It can be exhausting. Luckily, legal-specific technology now exists to help you automate these tasks so that you can focus on your cases and not whether that Answer got filed in the Simpson matter.
Join Jordan Turk, practicing attorney and Smokeball legal technology advisor, for this free CLE webinar. She'll share how you can automate workflows in your firms and give you tips on how to make your practice more efficient.
In this free CLE webinar, you’ll learn:
  • How to eliminate manual processes and implement standard workflows for your cases
  • Sample workflow templates from intake to initial pleadings, to discovery, to closing out a file
  • How to reduce human error and eliminate repetitive tasks with automation.

March 3, 8, 20+31: Eliminating Bias in the Legal Profession

The goal of this CLE presentation is to discuss bias and where it comes from; why it is harmful; how to detect it and how to eliminate it from our behavior as legal professionals. Practicing law is a bias landmine. From whether we believe a witness or opposing counsel; to how we counsel those in our organization we readily apply judgments to others — coloring our perceptions and thoughts. There is no cure for bias, but you can be more mindful, conscious and monitor your thoughts better. These are the four main questions we will answer in our discussion today: What is bias? What are unconscious and confirmation biases? What are the effects and costs of bias? And, finally how can we avoid bias through thinking about our thinking and implementing best practices?
As a result of attending this course, you will have a better understanding of the following:
  • Obtain a better understanding of the types of biases.
  • An awareness of the effects and costs associated with bias.
  • The benefits of setting good policy and modeling best practices.
  • Understanding your ethical obligations.
  • Gain insight to offer better legal and compliance counsel.

February 16: Refresher on Ethics of Trial Work in a Courtroom

As health officials continue to try to get the pandemic under control, the legal community is trying to get back to business as usual. But is it? Lawyers’ skills and knowledge of courtroom practice and procedure may need a bit of sharpening. It is time for lawyers to brush up on the ethical rules that are in place when handling trials. Through hypotheticals, this two-hour program will deal with areas of concern that lawyers come across every day. A panel will answer questions on how best to handle and diffuse what could turn into unnecessary confrontational situations. From discovery issues to closing arguments, hypotheticals will be presented at various trial stages with attendees answering polling questions on best practices.
It should also be noted that effective Jan. 1, 2023, the Illinois Supreme Court has enacted an updated Illinois Code of Judicial Conduct for the first time in almost two decades, bringing it in line with national standards by addressing the use of social media and other technology that didn’t exist at the code’s last major update in 1993. How some of these Rules dovetail with trial lawyers in a courtroom will be discussed as well.

From inventories that contain financial accounts to damaging discovery responses, lawyers become gatekeepers of information that could destroy lives if revealed to the public.
Law firms often fail to make appropriate investments in cybersecurity, which leaves them vulnerable to attacks. According to ABA's Cybersecurity Report, 27% of law firms have previously experienced a security breach.
Join Jordan Turk, practicing attorney and Smokeball legal technology advisor, for this free CLE webinar. She'll share cybersecurity nightmares, as well as give you tips to mitigate your risk and keep you compliant with your state bar.

September 21: Technology and the Legal Practitioner: Ethical Concerns & Best Practices

Legal professionals have a duty to provide competent representation to their clients. In the past, that meant an attorney was competent based on their experience and knowledge of the law. Today, however, the concept of competence has evolved to include a duty of technological competence. Attorneys today use a wide variety of technology – from email to Word to Artificial Intelligence tools. This session will address the ethical obligations that arise from the use of technology in the practice of law.

Wellness Program: Mind, Body, & Soul: Defining Well-Being in Law

Since the National Task Force on Lawyer Well-Being issued its Report & Recommendations in 2017, there has been much progress. However, a culture shift around well-being and sustained innovation still faces certain challenges. To be a good lawyer, law student or judge, one has to be well. To achieve well-being, we have to engage in a continuous process in which we “strive to thrive” in each of the following dimensions of our lives: emotional, intellectual, occupational, physical, spiritual and social.
Our panelists will discuss what constitutes well-being in each of these six components, provide some best practices that everyone can employ in their own lives and in their work or school setting, and consider where we have been and the challenges we face as we move forward on this front.

Diversity & Inclusion Program: Mind, Body, & Soul of Diverse Lawyers: The Weathering Effect

It is coming to light that lawyers of diversity can be impacted by “the weathering effect.” This relatively new term will be discussed in the context of how one’s experiences and reactions as a lawyer in a diverse community are different because of one’s race, gender, ethnicity, disability, socioeconomic status, and other diverse factors. The weathering effect can create an erosion of professional, mental, emotional, physical, and spiritual health from unconscious bias and the daily microaggressions that one of diversity is forced to endure. This can impact the way one responds to certain situations and can ultimately impact one’s outlook, health or longevity in the profession. It can make one more vulnerable or more callous in certain situations, more so and more sensitized than those who are not considered part of a minority community. It can create mental blocks. The concept of intersectionality – members of the profession falling into more than one identity group – and the toll it takes on those in figuring out how to react given the situation and the group into which one falls also can be exhausting.
This highly experienced panel will openly discuss their experiences and beliefs in what is happening in this arena and will offer suggestions as to how everyone can become more aware in order to improve the health of the profession.
