October 4/Cleveland: FDA Approval of Aducanumab for Alzheimer’s Disease


In this Oliver C. Schroeder, Jr. Scholar-in-Residence Lecture, Michael Carome, MD, director of Public Citizen’s Health Research Group (HRG), will describe the advocacy work of HRG over the past year opposing Food and Drug Administration (FDA) approval of the drug aducanumab for treatment of Alzheimer’s disease and seeking to hold the agency accountable for its reckless decision to approve the drug in June 2021. He will highlight the unprecedented and inappropriately close collaboration between the FDA and drugmaker Biogen before and after the submission of the company’s biologics license application (BLA) for aducanumab, a collaboration that dangerously compromised the independence and objectivity of FDA senior staff and clinical reviewers who were involved in the review of Biogen’s BLA for aducanumab and key data from clinical trials of the drug. In December 2020, Public Citizen’s Health Research Group first called for an independent investigation of the FDA-Biogen collaboration by the U.S. Department of Health and Human Services’ Office of Inspector General. Dr. Carome will explain why the FDA’s close collaboration with Biogen is emblematic of regulatory capture at the agency, which has been fostered by agency leadership over nearly three decades since the enactment of the Prescription Drug User Fee Amendments in 1992.

Dr. Carome's expertise includes drug and medical device safety, FDA regulations, and the protection of human research subjects. He is editor of Public Citizen’s Worst Pills, Best Pills News, a monthly newsletter that provides reviews of the safety of prescription and over-the-counter medications. Prior to joining Public Citizen in 2011, he was associate director for Regulatory Affairs, Office for Human Research Protections (OHRP), Department of Health and Human Services; staff nephrologist at the Walter Reed Army Medical Center’s Department of Medicine; and a Commissioned Corps officer in the U.S. Public Health Service. Earlier in his federal career, he served as director, Division of Compliance Oversight, OHRP; chief of the Compliance Oversight Branch in the Office for Protection from Research Risks, National Institutes of Health; and assistant professor of Medicine for the Uniformed Services University of the Health Sciences. Dr. Carome earned his MD at Case Western Reserve University. He is a fellow of the American College of Physicians.

August 26: Anti-Money Laundering Account Surveillance Using Bulk Data Analysis

Experts in Anti-Money Laundering and Risk Management techniques in financial institutions discuss the use of bulk data analysis to monitor transactions occurring within financial institutions. These sophisticated surveillance techniques use various modeling techniques to identify the flow of transactions that may be the proceeds of criminal activity. September 24: Washington Leadership Institute 2021-2022 Class of Fellows Application Deadline

The mission of the Washington Leadership Institute ("WLI") is to recruit and train diverse and underrepresented lawyers for future leadership within the legal and bar community. WLI is now accepting applications for the 2021 Class, which must be received at the UW Law office no later than September 24, 2021.
This is an exceptional opportunity for professional development and for becoming involved with the legal community:
  • Twelve attorneys, in practice for at least three years and not more than ten years, will be carefully selected for the tenth year of the program. 
  • The eight professional development seminars run from January to August 2022. 
  • Upon successful completion, Fellows will earn a significant number of CLE credits.

The WLI was created by the Washington State Bar Association in 2004 for the purpose of accelerating the skill level, the maturation and the network of outstanding young diverse lawyers who are selected annually from a statewide pool of applicants for participation in the program. For the past 17 years, the WLI has successfully achieved its goal by producing over 200 WLI graduates, known as Fellows.
Our WLI Fellows have gone on to become federal and state court judges, successful civil plaintiff and defense lawyers, prominent in-house counsel for publicly traded corporations, elected representatives at the county and state level, and prominent state and local bar leaders. QLaw Foundation’s LGBTQ+ Legal Clinic is looking for new attorney volunteers for clinics starting in September! This is a great training for folks who are new to clinic volunteering, who want to improve their client connection skills, or who want to know more about the most common legal issues impacting LGBTQ+ people.

How Does LGBTQ+ Legal Clinic Volunteering Work?
All legal clinics happen by phone, so you can talk to clients wherever you are, and our clinic assistant and attorneys have a zoom room for in-clinic support. Volunteer attorneys are generally scheduled for one or two 90 minute clinics per quarter, however, we work around your availability with no minimum. Any WA-licensed attorney can be an LGBTQ+ Legal Clinic volunteer, whether your practice area is corporate transactions or criminal defense. We provide a schedule with legal issues ahead of the clinic so you know what to expect, and when we can, we send you a legal memo ahead of time. Basically, we provide as much structure as possible for you, so that you can focus on providing the affirming and caring support that our LGBTQ+ Legal Clinic is known for.

September 15: What Would Marcus Garvey Do: Community Policing in the Black Lives Matter Era

Reverend Harriett G. Walden, Founder of Mothers for Police Accountability, National Director of the Silent War Campaign, 2020 WSBA Frances B. North Civic Leader Award and commissioner on the Community Police Commission (create by a federal consent decree in 2012 regarding unlawful use of force), will address the intersections of poverty, race, and education in our era's civil rights movement.
Reverend Walden will lecture on how structural classism challenges current civil rights work and provide an analysis on the Seattle Community Police Commission, formed by federal consent decree in 2012 in response to unlawful use of force. August 17: PTAB Practice Updates, the Impact of COVID, and Lessons Learned Along the Way

Since its creation, parties have filed thousands of petitions to the Patent Trial and Appeal Board (“PTAB”). Today, these proceedings and the PTAB are a significant aspect of every major patent litigation, but the contours of these proceedings continue to change. On top of these changes, COVID has presented a particularly difficult landscape for most practice areas, including patent litigation, but PTAB practice has persevered. In light of the changes and challenges in the past year, four key topics should be at the forefront of every PTAB practitioner’s renewed focus this year:
First, COVID has affected almost every contour of the legal industry this year. What lessons has the PTAB learned from COVID and what impacts will those lessons have on PTAB practice and AIA Trial Proceedings moving forward? What lessons can the private sectors take from the USPTO/PTAB?
Second, discretionary denials of AIA Trial Proceedings (and denials to institute, in general) are at an all-time high at the PTAB. Commenters and courts, alike, are seeking guidance on how to navigate these denials, particularly in light of Fintiv. What can practitioners to successfully invoke or avoid these denials?
Third, despite the benefits of the PTAB’s new motion to amend pilot program, patent owners are still hesitant to file motions to amend and take advantage of the program. At the heart of this hesitation lies the continuing threat of “full-blown examination” by opting into this program. What are the risks and rewards of opting into this pilot program?
Fourth, the decision in Arthrex v. Smith & Nephew will likely issue from the Supreme Court this Summer. Will the Court hold that administrative patent judges (“APJs”) were (or were not) properly appointed to the PTAB? What does this holding mean for patent practitioners now, as well as going forward?

When a court refrains from declaring a law unconstitutional it often explains that the law represents the “Will of the People” and that mere judges should invalidate that “Will” very sparingly. But what actually is the “Will of the People?” Does it even exist in the first place? And even if it does to some degree, how many of our laws really exist because of it? 
Further, what do the answers to these questions have to say about judicial review? If the “Will of the People” isn’t all it’s often thought to be, does that mean courts should be more engaged with finding laws to violate the Constitution?
This conference brings together leading experts on these issues from law, political science, and economics to address the same central questions
(1) Does the “Will of the People” exist and if so to what extent? And
(2) what does the answer to question (1) have to say for judicial deference to the political branches on questions of constitutionality?
Several experts will present their essays answering these questions, and others will provide commentary on these overlooked issues of American democracy and constitutional law. The essays will later be published in the George Mason Law Review.

September 2: The First Hires: Basics of Equity Incentive Plans for Startups

When a new startup forms, there is often a great deal of confusion around who owns the company, and how equity can be provided to the company's first employees. This presentation will begin by identifying how a company's founders take ownership, and how they should plan for the future new hires. It will then walk through the most common early types of equity issued to early employees, including restricted stock awards, options, and early exercisable options.
Following a good understanding of these types of employee and service provider grants, we will then discuss the responsibilities of the company with respect to issuing and receiving shares. In particular, we will discuss the importance of a 409A valuation, and the 83(b) election.
