Intellectual property (IP) theft has jumped from $1.2 billion in 2017 to $3.3 billion in 2021. This theft involves various forms of infringement, &, per the U.S. Trade Representative’s most recent Notorious Markets report, it also presents forced labor, national security, & consumer protection issues.

May 9: Immigration Litigation, How and Why it Works

In this webinar, Harris Bricken attorneys Akshat Divatia, Tom Oster, and Jack Scrantom, will discuss the Administrative Procedures Act (APA) as a tool for seeking relief in Federal Courts against US immigration authorities. Seeking relief in Federal Court under the APA is often the most expedient means to resolve issues with immigration authorities. The number of claims filed against US Citizenship and Immigration Services (USCIS) in Federal court have risen dramatically--from just over 1,000 in 2015 to well over 4,000 in 2021.
The increase in the number of lawsuits challenging USCIS action in adjudicating immigration petitions is no coincidence. US immigration authorities have become increasingly unreasonable and challenging to deal with in recent years. In our view, this is directly correlated with the rise in instances of unfair and unequitable adjudications. Common issues that both temporary and permanent immigrant visa petitioners and beneficiaries regularly face are unreasonably delayed, carry incorrect application of the law, and fail to follow procedures. Often, there is no sufficient, timely, or reliable administrative remedy available to redress the injury caused by USCIS. Seeking relief in Federal Court is often the only means to resolve these issues.

October 6: What’s a WY DAO LLC? Decentralized Autonomous Organizations

A DAO (decentralized autonomous organization) is an online community that uses blockchain technology to function and transact toward a specific purpose or mission (e.g. an investment, global community service, or sending one lucky DAO member to the moon).
In DAOs there are no hierarchies and no central control. DAOs also have no corporate form and therefore no bylaws, operating agreements, contribution agreements, or subscription agreements. The rules of investing and participating, as for cryptocurrencies, are set out on a blockchain in smart contracts, which contain some key terms but rarely track existing corporate laws.
DAOs that fail to implement optimal structural integrations risk being treated as unintentional partnerships complete with joint and several liability for all DAO participants and an inability to enforce any of its contracts with the outside world.
Like cryptocurrencies and blockchains, DAOs are inherently borderless and involve people and organizations across the globe, requiring legal expertise that also extends beyond national borders. In 2021, Wyoming became the first U.S. state to attempt to provide more legal certainty to DAOs. Other states followed, and international jurisdictions are also vying for the coveted title of most crypto-friendly jurisdiction.
