December 16: Expert Testimony: Trial Presentations and Testimony

Taking a construction-related case to trial should not be “rolling the dice.” Regardless of whether you are defending or pursuing a claim, the decision to take a case to trial should, theoretically, be simple once you have realistically analyzed the value of the claim, plus or minus the cost of a trial. But everyone involved in litigation knows it's never this simple.
A big part of most building-related litigation is expert testimony. Get it right and the case is improved. Get it wrong and the case is damaged... Or worse. The decision to pursue a claim or defend one through trial should be based on the facts at hand, not the quality of expert testimony since the facts are what they are. But there is no doubt that high quality versus low-quality expert work impacts judgments.
So, what do we do to make sure we are presenting our best case and the experts don't "fold like a lawn-chair" when push comes to shove in the courtroom? Mastering the development and delivery of expert opinions via testimony that will lead to victory is impossible in 60 minutes, but this program will provide a "map of the terrain." We will discuss real testimony experience from construction expert witness and attorneys’ perspectives.

Alabama-Only Free CLE by 12/31/2021

According to an announcement on the Alabama State Bar Website: 
"The MCLE Commission has temporarily suspended MCLE Regulation 3.1, which limits attorneys to six (6) hours of on-demand credits in any single CLE year. This accommodation allows Alabama attorneys the flexibility of satisfying their annual CLE requirement (12 hours, including 1 ethics hour) with approved on-demand courses. This only applies to the current CLE year, and attorneys must satisfy their annual CLE requirement by December 31, 2021.
In an effort to further assist Alabama attorneys during these difficult times, the Alabama State Bar is excited to offer a free online CLE platform called ProLearn. This platform is available to all active members of the Alabama State Bar and will offer enough on-demand CLE courses for members to satisfy their annual CLE requirement by the December 31st deadline."

January 20: A Discussion on Slip, Trip, and Fall Claims

The world is a dangerous place. And while falling down in your teens is often funny, falling down when you’re grown-up hurts and people are often injured. Combine that fact with a society that has become more and more litigious, and we have arrived in a time where Slip, Trip, Fall Claims are common. And when there is a claim, someone needs to figure out if the condition is a danger and render a thoughtful opinion about whether or not it caused or contributed to the fall.
A Discussion on Slip, Trip, and Fall Claims is a 1-hour walk through Pete Fowler Construction Services’ (PFCS) Construction Claims Analysis Method applied to personal injury claims that occur as a result of a hazard in the built environment.
