December 16: Expert Testimony: Trial Presentations and Testimony

Taking a construction-related case to trial should not be “rolling the dice.” Regardless of whether you are defending or pursuing a claim, the decision to take a case to trial should, theoretically, be simple once you have realistically analyzed the value of the claim, plus or minus the cost of a trial. But everyone involved in litigation knows it's never this simple.
A big part of most building-related litigation is expert testimony. Get it right and the case is improved. Get it wrong and the case is damaged... Or worse. The decision to pursue a claim or defend one through trial should be based on the facts at hand, not the quality of expert testimony since the facts are what they are. But there is no doubt that high quality versus low-quality expert work impacts judgments.
So, what do we do to make sure we are presenting our best case and the experts don't "fold like a lawn-chair" when push comes to shove in the courtroom? Mastering the development and delivery of expert opinions via testimony that will lead to victory is impossible in 60 minutes, but this program will provide a "map of the terrain." We will discuss real testimony experience from construction expert witness and attorneys’ perspectives.
