July 18: The theory and practice of cross-examination in international arbitration for Korean practitioners

Cross-examination has been described as the ‘greatest legal engine ever invented for the discovery of truth’ (John Wigmore, Evidence 1st ed., 1904). It is an essential element of international arbitration, and yet it is seldom taught.
The event will begin with a 30 minute presentation on the theory of cross-examination in international arbitration. Participants will then have the opportunity to practice their cross-examination skills before international arbitrators using a fictitious problem developed by Dechert, which will be circulated in advance. The mock problem will explore the tension between the energy-intensive cryptocurrency industries and the journey to net zero carbon emissions, thereby providing participants with a unique opportunity to learn about the art of cross-examination through the prism of two trends which are likely to feature prominently in future disputes. The role of witnesses will be performed by FTI Consulting. (Anyone interested in the subject who does not wish to engage in the mock cross-examinations can still attend as an observer.)
The session will be conducted live in Seoul (which is recommended to maximise the learning experience), while remote participation will also be possible. For those wishing to join virtually, Zoom links will be sent closer to the event date.

In the past year, private litigants, “red state” attorneys general, and other U.S. government officials have increasingly scrutinized ESG-related investment and business decisions, including through litigation filings in state and federal courts.
