September 19: Contempt of Cop and the First Amendment - Village of Woodmere v. Workman

Join Jonathan Grad of Extra Mile Law, PLLC for this fast-moving, basic class in which we will discuss Village of Woodmere v. Workman. In the case, a citizen was arrested and charged with disorderly conduct and several other misdemeanors. The disorderly conduct charge was based on speech perceived to be disrespectful toward the police officer, implicating the First Amendment. In reviewing this case, we will learn about several interesting topics including:
  • whether resisting arrest can serve as the basis for an arrest;
  • the Fighting Words exception to the First Amendment; and
  • the selective prosecution defense.
The case also provides an opportunity to briefly examine the concept of a so-called "contempt of cop" arrest.

August 29: The Constitution & Police Reform: Lessons from Connecticut and DC Litigation

  • National Collegiate Athletic Association v. Alston et al, a case challenging NCAA imposed limitations on benefits provided to student athletes,
  • Mahanoy Area School District v. B.L, a case about the application of the First Amendment to speech uttered by a student outside of school hours, and
  • Lange v. California, a case exploring the exigent circumstances exception to the Fourth Amendment's warrant requirement.
