For over a century, the social sciences and civil justice have influenced one another, fueling debates that drive innovation and expose systemic challenges. That conversation has produced new insights and procedures but also sharp criticism of the way lawyers have gone about their work and the way social scientists have conducted their assessments of the civil justice system.This year’s Clifford Symposium revisits a crucial topic—the influence, or absence thereof, of key social science insights on civil justice. The symposium will explore five key questions raised by social science scholarship. The first, and the original inspiration for this program, is the impact of the oeuvre of the late Daniel Kahneman, Nobel Prize winner in Economics. It will then turn to the work of another outstanding social scientist, Tom Tyler, whose insights about voice and legitimacy have had a profound influence on how we think about civil justice processes. The symposium will then consider what social science research might teach us about decision maker prejudice and bias, as well as how judges perform their assigned tasks. Finally, it will examine the integrity of social science research and its broader implications for the legal system

June 6+7: The Legacy of Industrywide Deadly Misconduct

At least three times in the past hundred years, entire American industries have united in a coordinated and sustained effort to advance their financial interests by knowingly promoting products that have deadly consequences for enormous numbers of individuals exposed to them. The three industries involved in these activities have been the asbestos manufacturers, the tobacco sellers and the opioid purveyors. 

There have been striking parallels both in their conduct and the inadequate societal response to the harm done. Accordingly, this year’s Clifford Symposium will explore:

• The historical legacy of these events
• The ethical questions raised by the legal representation offered the industries
• The behavior of those who enabled widespread harm
• The American industries that appear to be following the same deadly roadmap
• The procedures we might adopt to address these activities.

June 3+4: Civil Litigation in a Post-Covid World

We have all now come through the winter of a COVID-driven discontent. It has left its mark on our work as lawyers, our courtroom procedures, our legal responses to calamity, and our views of government. So, what happens now?
That is the question our speakers will address at the 27th Annual Clifford Symposium. While there truly is a basis for thanksgiving, the road ahead may be far from smooth. It was, after all, the loathsome future monarch, Richard III, who proclaimed in Shakespeare’s play the dawning of a “glorious summer.” Will our post-COVID time be as fraught? We certainly hope not, but we need to address matters, so that problems may be dealt with, tyrants thwarted, and the legal system harnessed to facilitate recovery.
To these ends we have assembled a remarkable group of scholars. They will examine the psychological and procedural effects of the methods COVID produced. They will consider our social safety nets, both through insurance and the application of tort law. Finally, they will take a close look at the role that has been and, in the future, may be played by government.
