November 2, 13, 19+25: Navigating the New Town Square: Cultivating Competency in Basic Online Legal Research

“The Internet is becoming the town square for the global village of tomorrow.” -- Bill Gates
The goal of this free online continuing legal education program is to assist attorneys in navigating online legal research so they are more confident and competent when researching subjects important to their work. The growth in the amount of information available and the many different platforms on which to obtain it impacts the way attorneys practice law. It also brings forth more issues and new laws that your clients may face. The many ways technology can aid attorneys in locating the best and most on-point statutes, caselaw, secondary materials and all relevant materials can be overwhelming. November 24: Project Planning & Management for Professional Services

Successful project management is like a dance; it looks easy when done right, but also easy to look foolish without knowing the basics. Project Managers need to adapt to frequent change, juggle many involved parties and stakeholders, and organize next actions for an entire team of people. Even experienced project managers struggle to control the chaos of large projects without a Project Management System to guide them. This program’s system is a guide for creating and executing a plan, managing change, invoicing, and measuring performance. This overview is beneficial for anyone looking to improve their project management processes, including consultants, designers, construction contractors, and insurance and legal professionals who handle mismanaged projects. While it is impossible to learn a dance that works for every song, this structure gives the fundamentals needed to be confident in adapting to any tempo or genre a project may bring. Title:

November 19: International Expansion - Leveling the Playing Field for Midsize Companies and Startups

Companies from across the world, including small and midsize, have decided to enter the U.S. market – a decision predicated on a variety of strategic considerations. A U.S. presence gives companies credentials, access to capital and strategic partners, and helps build the reputation necessary for global expansion. Expansion to the U.S. or moving an existing business from a foreign jurisdiction to the U.S. can, indeed, be an exciting time for an entrepreneur.
However, to achieve success, non-U.S. companies must consider a series of interrelated legal and cultural factors – from good corporate hygiene to leadership to attractive positioning for investments or the exit. In this session, we will discuss the various considerations foreign companies must evaluate when expanding to the U.S., as well as the savvy, ‘plugged-in’ team of professionals who must collaborate to benefit these inbound businesses.
This will be an interactive Zoom meeting, so please be prepared for introductions and to talk about your big wins in our breakout rooms at the start of the meeting. For MCLE verification of attendance, we encourage everyone to use computers rather than phones to call in.

November 18: Introduction to Status, Realities, Legal Framework and Future of Indigenous Peoples in the United States and Canada

You don’t have to be a lawyer to join the first-ever signature event on behalf of the American Bar Association (ABA), co-sponsored by the Canadian Bar Association (CBA), to celebrate Native American Heritage Month in November. Join us as our esteemed panelists discuss the current status and resiliency of indigenous peoples in the United States and Canada. The panelists will address the critical question of how past discriminatory – and even brutal governmental policies – led us to the current status of indigenous peoples today. More importantly, the panelists will discuss what steps, laws, and policies can be taken to improve the lives of indigenous peoples in the United States and Canada. The panelists will compare and contrast the history, status and future of the First Nations People in Canada vs. American Indians and Alaska Natives in the United States. After the panel discussion, the audience will gain a high-level overview of the issues around indigenous populations, which we hope will lead to desire to learn more. Please join us for this engaging, informative, and entertaining panel.

November 13: Fifth Trade Law Fall Update

Three years of Trump Administration efforts at vigorous trade enforcement and restructuring on top of major international disruptive developments including Brexit, growing Sino-American tensions, 2020's global pandemic and the resulting effort to adjust to a modified trade environment, have taxed the skills of even the most adaptable in this field. While partisan views on trade policy have evolved and, in some areas, divergence has increased in the last four years, it is unlikely the winner of the next presidential election will abandon the use of trade laws as a policy tool.
Professor Colares and the organizing committee of The Fifth Trade Law Fall Update welcome you to a zoom conference Friday, November 13, 2020. This post-election, fall update will examine the status of trade litigation under Sections 232(b) of the Trade Expansion Act of 1962 (targeting steel and aluminum imports, among other goods, deemed to threaten national security) and Section 301(b) of the Trade Act of 1974 (targeting Chinese imports for harms caused to the U.S. economy by China's "unreasonable or discriminatory" measures on technology transfer, intellectual property and cyber intrusions), as well as their near-future implications for supply-chain diversification and resiliency.

November 11: Evaluating Top Concerns About Litigation Finance

Law firms and their clients are increasingly turning to litigation finance to fund commercial lawsuits. While the benefits of funding are evident, and the demand for funding is increasing, the industry remains unregulated and opaque. Perhaps because of this, many lawyers are hesitant about using third-party financing for their litigation matters. Join us for this webinar in which a panel of leading industry experts, practitioners, and litigation funders will discuss why lawyers are concerned about litigation funding—and whether they are right to be.
Educational Objectives:
  • Learn about how attorney-client privilege, attorney work product, and disclosure concerns are understood and addressed in the litigation finance context
  • Hear about a number of other concerns that lawyers voice about the industry, including running afoul of fee-sharing rules and the risk of facing actions for collateral damages from funders
  • Learn from our panel of experts how to safely navigate the waters of litigation finance, and what is on the horizon for the industry.

November 6: George A. Leet Business Law Symposium

Join us for the George A. Leet Business Law Symposium, "Equity Holdings in the Three Index Funds: Anti-Competitive Effects, Fiduciary Duties and Environmental, Social and Governance Issues," sponsored by the CWRU School of Law’s Center for Business Law.
The symposium will focus on equity holdings in large index funds and the rise of the "big three" — Blackrock, Vanguard and State Street — which control 25 percent of the vote in the S&P 500 now. This is projected to grow to 34 percent in 10 years and 40 percent in 20 years. The concentration of equity holdings in large index funds is a trending topic in corporate and finance academia—one that appears to be getting on the radar of regulators and legal practitioners.
The rise of Environmental, Social, Governance (ESG) investing and fiduciary responsibility is also a significant development, with asset managers have an increasing inclination to value whether a public company is "doing good," in addition to “doing well." The traditional paradigm of separating ownership from control may be in for profound changes.
Panelists will address several topics, including fiduciary obligations of index fund managers; implications for corporate governance and stockholder activism; potential anti-competitive effects; and the rise of Environmental, Social, Governance (ESG) investing.

  • The continuation or expansion of the Families First Coronavirus Response Act
  • Federal paid leave laws and other COVID-19 relief plans as well as the potential for competing state/local laws
  • Wage & Hour changes and the authority of the Department of Labor: minimum wage thresholds, worker misclassification, and joint employment
