December 14: Compassionate Release in Pennsylvania: How to Represent Terminally Ill Incarcerated People on their Medical Transfer Petitions

This CLE program will provide attendees with an overview of Pennsylvania's Medical Transfer Statute (Compassionate Release), the mechanism by which individuals who are terminally ill and have a prognosis of less than a year to live may petition a criminal court to be released to a medical facility or to home hospice care. In the 13 year period following the enactment of the current statute, it is estimated that only 35 people have been successful in getting released.
Pennsylvania has one of the oldest populations of incarcerated people in the country, and the need for attorneys to take these kinds of cases is dire. Staff attorneys from the Abolitionist Law Center will provide an overview of the statute, discuss the best strategies for success in bringing these cases before a criminal court and providing support to families post-release, as well as providing an analysis of the crisis of aging people in Pennsylvania and what you can do to help.
There will also be a discussion about the ethical challenges in supporting medical autonomy and decision making at the end of life. By the end of the presentation, attorneys will be equipped to represent incarcerated individuals in these matters, and will be eligible to join a mailing list for pro bono case referrals.

Cybersecurity incidents are on the rise at law firms. Whether aware or not, recent studies show that a high proportion of the largest law firms in the U.S. have experienced a data breach. As custodians of a treasure trove of highly valuable and sensitive information, law firms make prime targets for cyber criminals. November 9: National Security Review Of Foreign Investment Transactions

While bipartisan legislative successes have been few and far between in our highly-charged political environment, a general consensus on the need to provide a stronger framework for reviewing foreign investment in US companies led to the passage of the Foreign Investment Risk Review Modernization Act (‘FIRRMA’) in the summer of 2018. The issuance of a final rule in January 2020 implementing FIRRMA subsequently crystallized the process for CFIUS review of inbound transactions. This seminar will review the landscape leading to FIRRMA, the highpoints of the new regulatory process, and provide an update on recent developments as changing national security concerns continue to provide calls for additional regulatory changes. It will also offer significant instruction on techniques for researching various aspects of this topic—from legislation to regulation and even how to analyze market examples of CFIUS approval clauses in M&A agreements.

December 7: Disrupting the Probation to Incarceration Pathway: Translating Research into Action

Although probation is intended to help people succeed in the community, the reality is that probation can also serve as a pathway to incarceration. In Confined and Costly, the Council of State Governments (CSG) estimated that 45% of prison admissions nationwide are due to violations of probation or parole. In Minnesota, CSG estimated that proportion may be as high as 60% and also found that people who are Black and Native American are overrepresented in Minnesota’s criminal system. Thus, probation can be a pathway to incarceration that impacts Black and Native American communities more harshly than other groups.
In 2019, the Robina Institute of Criminal Law and Criminal Justice and Ramsey County Community Corrections (RCCC) partnered together for the Reducing Revocations Challenge, a national project aimed at understanding the factors leading to probation violations and revocations. This webinar will detail the findings from the project as well as the recommendations developed by the project advisory committee for disrupting the probation to incarceration pathway in Ramsey County, Minnesota (located in the Twin Cities). This webinar will also describe the work currently underway to implement the recommendations, with a focus on how RCCC is working with its partners in the criminal legal system and members of the community to make systemwide changes with the goal of fostering greater success for people on probation.

In July of 2017, the United Kingdom’s Financial Conduct Authority announced that LIBOR (London Interbank Offered Rate) will be phased out in 2021, as regulators look to replace it with a more reliable alternative. November 17: Washington Initiative for Diversity Legal Executives Diversity Summit

The Washington Initiative for Diversity (WID) holds a Legal Executives Diversity Summit each year. The goal of the summit is to discuss ways in which leaders within the legal community can advance diversity, equity, and inclusion within the legal profession. The WA Attorney General’s Office and the WA Supreme Court are key partners in the summit. The summit attracts leaders and members from a broad spectrum of the profession in WA State. 

Join us for our remote summit on November 17, 2022. Our theme this year is a continuation of our theme from last year which was Measurement and Accountability: Committing to Targeting & Tracking DEI Efforts Post Covid-19. Last year's program was taken from the perspective of the large firm and corporate counsel.

The program this year will explore the ways that small and medium-sized firms and the judiciary are better harnessing information and utilizing it to implement policies and processes that improve diversity, equity, and inclusion in the legal field.
