October 22: Nashville - Nashville Voting Rights Litigation Training #MCLE

The Supreme Court’s 2013 decision in Shelby County v. Holder effectively nullified a key provision of the 1965 Voting Rights Act, the most effective civil rights law ever enacted. As a result, until Congress amends the Act, voting rights litigation will be the only path available to minority voters seeking to protect their rights against discriminatory voting laws.
Help respond to this voting rights crisis by joining the American Constitution Society, the Campaign Legal Center and Georgetown Law Center in a half-day training program, taught by some of the most respected voting rights practitioners in the country. An update on pending legislation in Congress responding to the Shelby County decision will also be included.
This training will arm attendees with the tools and tips necessary to become active members of the voting rights bar, and will provide an opportunity for new and returning members of the voting rights community to meet and strategize about the challenges to come. October 21: Cleveland + Web - USA Freedom Act: Legal Changes and the Impact on Intelligence

After a heated battle that played out on Capitol Hill, the US Congress, on June 2, 2015, passed the USA Freedom Act, extending three surveillance provisions of the USA Patriot Act which had expired and amending, arguably the most controversial provision of that statute, section 215, which allowed bulk collection of US phone records by the National Security Agency. According to the new provisions on bulk collection, the NSA will no longer maintain the database of US phone records. Rather the NSA will have to request such records from the phone companies holding the records pursuant to an order from the Foreign Intelligence Surveillance Court. Both the roving wiretap and lone-wolf provisions of the USA Patriot will go back into effect under the USA Freedom Act. The new law also requires the declassification of the Foreign Intelligence Surveillance Court opinions containing significant legal decisions.
While the new law has been described as a win for privacy, the security-versus-privacy debate is far from over. Certainly, the law has been a significant post 9-11 surveillance reform measure but the ultimate ramifications for security and privacy based on what was changed and what was not changed by the law needs further public discussion. The fact that there still remain numerous legal authorities that the federal government can rely on to conduct surveillance both domestically and internationally along with the continued concern voiced by intelligence officials about the threats facing this nation call for a much closer look at the effectiveness of the reform measures with both privacy and security in mind.
This talk will outline the legal changes under the USA Freedom Act and what they mean for intelligence collection. It will also identify additional existing legal authorities for intelligence collection outside the USA Freedom Act, raising questions of whether further reform may be in the future. Lastly, it will identify some of the challenges the new law will pose for those responsible for protecting the nation from threats.

November 2: NYC - U Nonimmigrant Status: Obtaining Lawful Immigration Status for Crime Victims

Attorneys will be trained to represent Her Justice-referred clients in obtaining U Nonimmigrant ("U visa") status in the United States. U Nonimmigrant status is offered to a victim of certain crimes, like domestic violence and rape, who cooperates in the investigation or prosecution of her attacker. A grant of U Nonimmigrant status allows an immigrant and her derivative family members to work and live lawfully in the United States, and creates a pathway to lawful permanent resident status. It also allows a derivative family member residing abroad to enter the United States lawfully to be reunited with the crime victim.
Attorneys attending the training will be assigned a case, which may involve representing a crime victim and multiple derivatives, normally her children, for pro bono representation. Attorneys are expected to commit to taking a case pro bono either individually or as part of a team. Experienced Her Justice staff attorneys mentor and consult with pro bono teams throughout the course of representation. The U Nonimmigrant Status application process is transactional and does not require that the attorney attend an interview with immigration authorities.
Please note that clients' children often reside abroad. In those cases, attorneys are expected to handle the derivative cases until the children successfully enter the United States. October 6: Cleveland - Picking Cotton #MCLE


Cleveland-Marshall College of Law (1801 Euclid Ave.) will host the Friedman and Gilbert Criminal Justice Forum, “Picking Cotton,” Tuesday, October 6 at 5 p.m. The lecture will be delivered by Jennifer Thompson, co-author of the New York Times Best-Seller Picking Cotton and a prominent activist.
Thompson is an advocate for judicial reform, the need to combat sexual violence, abolition of the death penalty, the fallibility of eyewitness testimony, and the healing power of forgiveness. Her strong convictions were born of a brutal rape she suffered as a college student. Her compelling testimony sent a young man to a life term in prison for a crime he did not commit.
That man, Ronald Cotton, was eventually freed thanks in large part to his persistence in maintaining his innocence and to newly developed DNA tests. Together they co-authored a joint memoir, Picking Cotton: Our Memoir of Injustice and Redemption, which recounts their journeys, the tragedy that brought them together, and their mutual conviction that such errors must be recognized.
Thompson is commissioner for the North Carolina Innocence Commission and the president and founder of Healing Justice, a non-profit that works in aftercare for those harmed by wrongful convictions. She has appeared on numerous media outlets including "Oprah," "60 Minutes," "The Today Show," "Good Morning America," "20/20," "PBS Frontline," People, Newsweek and the New York Times.

The program is free and open to the public, and offers attendees one hour of free continuing legal education credit. A book signing will follow the lecture.

October 2: Webcast - Representing the Pro Bono Client: Advocacy Skills for Administrative Hearings 2015 (Free)

The need for pro bono assistance with administrative hearings has never been higher. Program changes and budget cuts have created a “perfect storm” for public assistance recipients. Several significant changes to key benefits programs have occurred in recent years, imposing new complex rules. At the same time, county staff has shrunk, and experienced workers have retired, increasing the occurrence of administrative errors and problems with clients’ receipt of the benefits to which they are entitled.
On the unemployment insurance front, while the number of applications has overall declined, we have yet to see a reverse of the recession-based trend of employers challenging most unemployment insurance benefit applications. Likewise, workers who depend on occupational licenses and related clearances for their livelihood are often denied because of a prior criminal record. Meanwhile, low-wage workers are experiencing wage theft at unprecedented rates, and relying on the Labor Commissioner more than ever before to recover their unpaid wages.
Legal aid services have also suffered funding problems and staffing cuts, with reduced ability to represent clients in these cases. Unfortunately, many individuals who are entitled to desperately-needed benefits but have had their benefits improperly denied, lowered, or terminated, or who are able to pursue gainful employment but are denied the necessary license and/or clearance or are not paid according to basic wage and hour laws cannot make it through the administrative hearing process on their own. As a result, low-income families face the very real possibility of hunger, homelessness, and overall family instability.
This training is designed to help mitigate the crisis faced by low-income families everywhere by providing attorneys with a basic understanding of common issues and strategies in providing pro bono assistance with administrative hearings. The program will focus on California law, but will also cover many topics such as due process and other rights that apply nationwide; therefore, advocates from other forums would benefit from the information and attending the program.

You should attend this training if you are a pro bono or legal services attorney who provides, or would like to provide, legal services to clients with mental disabilities in disability cases and/or improve your representation of clients with challenging behaviors in any area of law. This two part training provides instruction on 1) components of a mental status exam and insight into interviewing clients with mental disabilities where the mental health of your client is the subject matter of the litigation; and 2) how to effectively represent clients with challenging behaviors generally. Experienced practitioners from across the state will share their expertise on how to best approach issues that arise when representing clients with mental disabilities and challenging behaviors including interviewing strategies, providing accommodations, harm reduction lawyering, and managing expectations. At the end of the morning, you will have many tools you can use to develop a positive working relationship with all of your clients.

Currently, close to 700,000 students with disabilities receive special education services in California, comprising about 10 percent of the state’s public school enrollment. The California Special Education Law 2015 program will provide attendees with a targeted look at a number of issues affecting the practice of special education law today.

Washington, DC: September 25 - Voting Rights Litigation Training

The Supreme Court’s 2013 decision in Shelby County v. Holder effectively nullified a key provision of the 1965 Voting Rights Act, the most effective civil rights law ever enacted. As a result, until Congress amends the Act, voting rights litigation will be the only path available to minority voters seeking to protect their rights against discriminatory voting laws.
Help respond to this voting rights crisis by joining the American Constitution Society, the Campaign Legal Center and Georgetown Law Center in a half-day training program, taught by some of the most respected voting rights practitioners in the country. An update on pending legislation in Congress responding to the Shelby County decision will also be included.
This training will arm attendees with the tools and tips necessary to become active members of the voting rights bar, and will provide an opportunity for new and returning members of the voting rights community to meet and strategize about the challenges to come. We need you to be part of the next generation of voting rights defenders.

Sarah (Sally) Barringer Gordon, Arlin M. Adams Professor of Constitutional Law and Professor of History at the University of Pennsylvania, teaches in the areas of church and state, property, and legal history in the law school, and American religious and constitutional history in the history department.
Sally is the author The Mormon Question: Polygamy and Constitutional Conflict in Nineteenth-Century America (University of North Carolina Press, 2002), and The Spirit of the Law Religious Voices and the Constitution in Modern America (Harvard University Press, 2010). She is also the author of “The First Disestablishment: Limits on Church Power and Property before the Civil War,” University of Pennsylvania Law Review (2014). This article is part of a larger project on the law of religion from the Revolution to the post Civil War era, titled Freedom’s Holy Light: Disestablishment in America, 1776-1876, which is currently under consideration at a scholarly press.
Sally is particularly interested in the legal history of religion and religious peoples in American colonial and national history, with a special focus on the relationship of politics and law to belief and practice in American life.
