January 26: Individual Representation and Movement Lawyering -- Separate and Distinct or Combining to Become More Than Sum of the Parts?

This presentation will examine ways in which the representations of individuals in criminal and civil cases can act in concert with what we think of as movement lawyering and address questions such as:
  • Is the representation of an individual always in conflict with movement lawyering?
  • Who should decide how much collaboration there should be between lawyers representing an individual and lawyers working with a movement?
  • What limits on and opportunities for collaboration between lawyers representing individuals and lawyers working with movements are presented by ethical rules?
  • In some cases, is there a duty to engage with a movement during your representation of an individual? 
  • The session will address the Rules of Professional Conduct 1.2 and 3.1.
