Sep 9/Cleveland, OH - Establishing a New #Constitutional Court for South Africa: Adapting the Common Law to Reflect a Democratic Criminal Justice System

One of the central features of South Africa's transition from apartheid to a constitutional democracy was the establishment of a new Constitutional Court with the power first to approve the new Constitution and then to interpret and enforce its provisions, including the expansive Bill of Rights.  Justice Richard J. Goldstone was appointed by President Nelson Mandela to the new Court and participated in many of its early decisions.  He will discuss the complex issues involved in establishing a new apex court for post-apartheid South Africa with a particular focus on how it shaped a new democratic criminal justice system. Among his discussion points, he will address the constitutionality of the death penalty--a highly contentious issue in the constitutional negotiations that resulted in an equally contentious decision by the Court; the presumption of innocence; and crimes relating to gender and sexual orientation.

Justice Richard Goldstone
During South Africa’s transition from Apartheid to democracy in the early 1990s, Justice Goldstone served as the chairperson of the Commission of Inquiry Regarding Public Violence and Intimidation, which came to be known as the Goldstone Commission. His judicial career includes appointment to the Transvaal Supreme Court in 1980 and later to the Appellate Division of the Supreme Court of South Africa. After serving as the first chief prosecutor of the United Nations' International Criminal Tribunals for the former Yugoslavia and Rwanda, Justice Goldstone returned to South Africa and was appointed a judge of the Constitutional Court in 1994, remaining on the court until 2003.
Justice Goldstone is the recipient of many prestigious awards, including the MacArthur Award for International Justice, the International Human Rights Award of the American Bar Association, and Honorary Doctorates of Law from universities around the globe.
Since 2004, Justice Goldstone has taught as a visiting professor of law at Harvard Law School, New York University School of Law, Fordham University School of Law, and Georgetown Law School among others.

Our Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by VLSP’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. In this recession, an increasing number of Californians are facing eviction and do so without the benefit of legal counsel to guide them through the process or the representation necessary to vigorously defend against unlawful actions.  As a result, families face the very real possibility of homelessness. This training is designed to help mitigate the crisis by providing private attorneys with a basic understanding of eviction defense and housing law, and an opportunity to connect with non-profit legal service agencies able to facilitate pro bono representation of low income families facing this predicament.

Housing Negotiation Project training

VLSP's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

Unraveling the Complexities of the GPL: an On-Demand CLE

With 65% of the more than 200,000 open source projects available on the Internet using GPL licenses, they are the most widely used open source licenses in the world. The way that software development organizations integrate code licensed under the GPL and AGPL into their applications and services, and depending on how that code is deployed, can expose a company and its intellectual property to significant risk.

Oct 21/DC - The Veterans Consortium Pro Bono Program

Veterans denied benefits by the U.S. Department of Veterans Affairs (VA) can appeal to the U.S. Court of Appeals for Veterans Claims.
Thousands of veterans or their survivors have filed appeals in the Court. Most cases involve claims for VA disability or death benefits. Unfortunately, for many veterans the promise of effective judicial review has proved elusive. A majority of those who appeal to the Court do not have a representative at the time they file their appeal. Unrepresented veterans are at a significant disadvantage in litigating against the VA General Counsel’s Office, which represents VA in all Court proceedings. Mentally and physically disabled veterans may be especially disadvantaged.
The program offers attorneys an uncommon opportunity to repay those who served. Please consider participating and helping veterans and their families prove entitlement to benefits.

Anytime/Web - Trademarks and Open Source Licenses

Trademarks have come to play an increasingly important role in the open source community. While it may seem that the strict control required by trademark laws would be inconsistent with the freedoms preserved by the open source licenses, trademarks actually are an integral part of the rights which will make open source software successful. Moreover, companies and communities can protect their valuable trademarks in a manner consistent with open source principles and to the benefit to developers and users of open source software alike.
We will discuss how open source projects can use both trademark and copyright law to build their communities while preserving software freedoms.
BlackDuck Factoids: While all open source projects come with licensing agreements that define the terms and conditions for the use of the copyrighted software, such licenses only rarely specifically address the right to use the valuable trademarks that may be associated with the open source project. (Of the sixty five open source licenses approved by OSI, 22 are silent on trademarks, 23 prohibit the use of names or trademarks in endorsements, advertising or publicity. Finally, another 27 expressly exclude a grant of trademark rights with some licenses having more specific restrictions.) Some projects, but not many, include FAQs on trademark use or even provide a trademark use policy.

This training will prepare volunteer attorneys to assist low-income, unrepresented litigants in civil collection cases through VLP's Fair Debt Collection Lawyer of the Day project at the Boston Municipal Court.  The training will cover civil procedure and practice at the BMC, Limited Assistance Representation, as well as substantive areas of consumer and fair debt collection law that you will need as a volunteer.  Fair debt collection cases are a great opportunity for lawyers seeking courtroom experience. 
About this project: 
Volunteer attorneys assist low-income debtors and creditors at the Boston Municipal Court in the Brooke Courthouse on Wednesdays from 9 a.m. to noon and 1:30 p.m. to 3 p.m. on a Limited Assistance Representation (LAR) basis.  LAR means that the attorney only represents the client in the proceeding (case management conference, motion, etc.) before the court that day.  The representation begins and ends on the same day. 
This project is joint effort of the Volunteer Lawyers Project, Senior Partners for Justice, and the Litigation Section of the Boston Bar Association.
