Fred Corbit has practiced law since 1980. Presently he is an attorney at the Northwest Justice Project (NJP). Prior to going into public service at the NJP on August 31 of this year, he was a partner at Heller Ehrman LLP, where he represented companies and individuals from across the country in connection with issues related to finance, real estate, acquisitions and sales, business litigation, and bankruptcy. Prior to joining Heller Ehrman in 1989, Fred was a partner at the Lasher law firm in Seattle.
Throughout Fred’s professional career, he has lectured at Continuing Legal Education programs and has published numerous law related articles. Mr. Leen is a member of the Deed of Trust Revision Committee of the Washington State Bar Association. He recently completed a four year term as Trustee of the Legal Foundation of Washington, which distributes IOLTA funds to low income legal service providers.

    Realities of Alternative Fee Arrangements - Panel - On-Demand MCLE

    AFA's can sound good: predictability, discounts, and the outside lawyer gets a guarantee of a certain measure of work. In practice, however, there can be unforeseen consequences, especially when two or more firms are assigned aspects of the same litigation and their fees are constrained by AFA's. Issues include Model Rule 1.5 ("Reasonableness of Fees and Expenses") and its application to "success" fees, the conflict between outside counsel's duties to the client and his/her own financial interest when a fee cap is reached before the matter has concluded, fungibility of services, disparity of effective hourly rates, overloading of firms and load-leveling among firms. The panel will discuss allocation of risk and the attendant ethical conflicts that can arise under several kinds of AFA.

    The Bar Association of San Francisco's Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.

    March 21/Web: Soft Contained Playground Equipment Litigation

    The presentation will define exactly how "soft contained playground equipment" differs from traditional park department and elementary school playground equipment. Soft contained playground equipment is utilized by the fast food industry in some restaurants. The American Society for Testing and Materials International's standard will be cited for the audience. The concept of why fast food restaurants and family entertainment centers place playground equipment within their establishments will be discussed.
    The U. S. Consumer Product Safety Commission has developed a safety checklist for this type of equipment, and the presenter will highlight some of the more salient points. From his background in the capacity of an expert witness, the presenter will discuss actual soft contained playground equipment cases he worked on. These cases involved matters of: use zones, no climb netting, protrusion within a slide, inappropriate surfacing, and dining furniture too close to the equipment. He will discuss the concept of supervision and the lack of supervision, which can lead to litigation.

    • The motivation why fast food companies and entertainment centers place playground equipment into their restaurants

    March 22/Cleveland: Legal and Ethical Implications of Posthumous Reproduction

    In Astrue v. Capato, 132 S. Ct. 995 (2012), the Supreme Court held that children conceived through in vitro fertilization after the death of a parent were not automatically entitled to survivor benefits under the Social Security law. The Court stated that the children’s eligibility to receive the benefits depended upon their ability to inheritance under the state’s intestacy system.
    The facts of the Astrue case indicate just one of the legal consequences of posthumous reproduction. The Symposium aims to give judges, legislators, practicing attorneys and academics the opportunity to present research that highlights the legal and ethical issues that may occur because of the availability of posthumous reproduction.

    March 14/Seattle: Collaborative Law Training

    Free for members of the King County Bar Association Collaborative Law Section.
    The King County Bar Association was the first county bar association in the country to create a Collaborative Law Section and is taking a new leadership role by being the first Bar Association in the Country to offer basic training in Collaborative Law that includes a significant focus on practice outside family law.
    What makes this training unique is that it is being offered in monthly two hour modules allowing participants to get as little or as much training as they want and to focus their training on the substantive areas of law that are of greatest interest to them.     March 13/Cleveland: Taxes and the Constitution #MCLE

    Congress’s power to tax is generally taken for granted, but the Constitution contains important limitations on the taxing power—the power to lay and collect taxes. Some issues:
    • What distinguishes a “tax’ from other governmental charges?
    • What are direct and indirect taxes and why does it matter whether a tax is one or the other?
    • What’s the significance of the Sixteenth Amendment, which permits Congress to enact a “tax on incomes” without having to meet the apportionment rule that otherwise applies to direct taxes?
    • Does the taxing power legitimate any exercise of congressional power that is funded by taxation?
    These issues are not of only historical interest. Some were implicated in the recent litigation on the legitimacy of the individual mandate in the Obamacare legislation—the requirement, beginning in 2014, that most Americans acquire suitable health insurance or pay a penalty.

    March 12/NYC: U Nonimmigrant Status: Obtaining Lawful Immigration Status for Crime Victims

    You must be an attorney at one of inMotion's Corporate Partner firms in order to participate in this training.
    Attorneys will be trained to represent inMotion-referred clients in obtaining U Nonimmigrant ("U visa") status in the United States. U Nonimmigrant status is offered to a victim of certain crimes, like domestic violence and rape, who cooperates in the investigation or prosecution of her attacker. A grant of U Nonimmigrant status allows an immigrant and her derivative family members to work and live lawfully in the United States, and creates a pathway to their being able to obtain lawful permanent resident status. It also allows a derivative family member residing abroad to enter the United States lawfully to be reunited with the crime victim.
    Procedural and substantive aspects of filing a request for U Nonimmigrant status with immigration authorities will be discussed in detail. Training manuals and sample documents will be provided at the training.
    Attorneys attending the training will be assigned a case, which may involve representing a crime victim and multiple derivatives, normally her children, for pro bono representation. Attorneys are expected to commit to taking a case pro bono either individually or as part of a team.  Experienced inMotion staff attorneys mentor and consult with pro bono teams throughout the course of representation.
    The U Nonimmigrant Status application process is transactional and does not require that the attorney attend an interview with immigration authorities.
    Please note that clients' children often reside abroad. In those cases, attorneys are expected to handle the derivative cases until the children successfully enter the United States.  InMotion will provide video CLE training and materials for Consular Processing for U Nonimmigrant Visas.

    March 13/San Francisco+Web: California Eviction Defense: Protecting Low-Income Tenants #MCLE

    In the current economic climate an increasing number of low-income Californians are facing eviction.  Unfortunately, many tenants are evicted without the benefit of legal counsel to guide them through the process or the representation necessary to vigorously defend against unlawful actions.  As a result, families face the very real possibility of homelessness.  This training is designed to help mitigate the crisis by providing attorneys with a basic understanding of eviction defense and housing law and an opportunity to connect with non-profit legal service agencies able to facilitate pro bono representation of low income families facing this predicament.

    • Affirmative defenses in Unlawful Detainer actions
    • Eviction defense after foreclosure
    • Evictions and terminations in subsidized housing

    The Sandy Hook tragedy has raised questions about whether America’s mental health system is adequate to respond to mentally ill persons, including those who may be violent.
    This program will discuss the law of mental disability, funding, medical and institutional options, the role of lawyers in issues facing military veterans who return home with mental health problems, and the intersection between mental illness and violence.

    • Barbara Lindberg, Lead Nurse Planner, Optumhealth Education:Lindberg is an attorney and registered nurse, as well as an adjunct professor of law, teaching Mental Health Law in the Health Law Institute at Hamline Law. She has her BSN and earned her JD from William Mitchell College of Law. Before she came to Optumhealth, she worked as a health care contracts attorney in the Medicaid Managed Care Unit of the Minnesota Department of Human Services, and as a transplant management consultant for United Healthgroup.
    • Judge Jay Quam, Presiding Judge, Probate/Mental Health Court in Hennepin County: A graduate of Moorhead State University and the University of Minnesota Law School, Judge Quam served as a shareholder at Fredrikson and Byron, a conciliation court judge, and an adjunct professor at the University of St. Thomas School of Law. He has been active with many Hennepin County and Minnesota State Bar Association Committees and with Minnesota Justice Foundation, receiving the HCBA Judicial Professionalism Award in 2010.
    • Professor David A. Larson, Hamline Law: Professor Larson is a senior fellow at Hamline's Dispute Resolution Institute and a fellow of the American Bar Foundation. He teaches and writes on alternative dispute resolution, torts, mental health, and employment law. He served as "professor-in-residence" at the Equal Employment Opportunity Commission headquarters in Washington, D.C., where he worked on regulations and interpretive guidance for the Americans with Disabilities Act. He earned his JD from the University of Illinois College of Law and his LLM from the University of Pennsylvania Law School.
