August 26: Webcast - Kimble v. Marvel: Practical Tips for Extending Licensing Agreements Beyond Patent Expiration

On June 22, 2015, the U.S. Supreme Court issued its decision in Kimble v. Marvel Entertainment, LLC, upholding the long-standing rule that prohibits a patent holder from charging royalties for the use of an invention after the underlying patent has expired. As a result, patent holders may want to consider ways to negotiate competitive, mutually beneficial, and enforceable license agreements that exist beyond the term of the underlying patent.

To respond to the access to justice crisis facing the legal system, the civil legal services community and the judiciary have partnered in the expansion of services based on limited scope representation. August 4: San Francisco - Title IX and Sexual Assault on Campus #MCLE

The American Constitution Society is pleased to present a panel discussion addressing the difficult issue of Title IX and sexual assault in higher education. Since 2011, the Obama administration has taken an active role in the movement to end campus sexual assaults, including the formation of a Task Force on the issue, which released its first report in 2014. As part of this effort, the U.S. Department of Education has reinvigorated its enforcement of Title IX, issuing guidance letters and conducting investigations on a growing list of higher education institutions. In response, academic institutions have ramped up efforts to investigate sexual assaults and make their campuses safer. At the same time, however, some, including 28 Harvard Law School professors, have expressed concern that while stemming the epidemic of campus sexual assault is paramount, it is important to have fair processes and procedures in place to protect both the victim and the accused.
Our panel of experts, coming from an array of different backgrounds, will offer their thoughts and experiences in Title IX compliance and sexual assault investigations.

August 18: Webcast - Lessons From the 'Serial' Case: Ten Evidentiary Missteps to Avoid #MCLE

Evidence is the lifeblood of a case. And your client’s livelihood or bottom line, liberty or life, may depend on how you handle it.
There is no better illustration of this than a 1999 Maryland case involving the murder of an 18-year-old high school senior, Hae Min Lee, and the controversial conviction of her ex-boyfriend, Adnan Syed, then 17. The case inspired the record-breaking Serial podcast, which has been downloaded more than 80 million times. The case continues to inspire millions of downloads of Undisclosed, a podcast which features three attorneys who enthusiastically run down the many rabbit holes of the case’s hotly disputed evidentiary issues. It was evidentiary concerns that prompted an appellate ruling calling for a new look at the case.
Undisclosed was initiated by the same attorney who inspired the production of Serial, Rabia Chaudry, a close family friend of the defendant and an ardent advocate for his release. Joining Chaudry on Undisclosed are two attorneys with a penchant for evidentiary matters. Susan Simpson, an associate with the Volkov Law Group, handles both civil and criminal actions, and writes the blog The View From LL2 The other is Colin Miller, a professor and associate dean at the University of South Carolina School of Law and author of the popular Evidence Prof Blog.

In the past three decades, incarceration rates have exploded in the U.S., such that today we incarcerate over two million people, more than any other country in the world. The result is that many more people encounter the criminal justice system at some point in their lives. Indeed, an estimated 1 in 4 adults in California has an arrest or conviction record, and low-income people and people of color are disproportionately affected.
A person with a prior record faces significant employment and housing barriers, even when the record is old or unrelated to the job or housing. These barriers impede community reintegration and prevent formerly incarcerated people from being able to support themselves and their families or participate equally as members of their communities. This training is designed to give lawyers a foundation in the collateral consequences that result from contact with the criminal justice system, as well as tools for representing clients in need of reentry legal services.

Over the past year, thousands of unaccompanied children have fled Central America seeking safety and refuge. Over 4,200 unaccompanied children have been in placed in Maryland, giving our state the highest numbers of unaccompanied children per capita. Attorneys practicing in Maryland need to be prepared to interview and to work with this increasing population of vulnerable children.

On Demand: Webcast - Lexvid Free CLE Offer

Lexvid offers on-demand CLE recordings. The first one is free: it costs nothing to register, and they'll let you take a one-hour course of your choice for free. After that, there is a modest price for further credits.

Most, but not all, states allow earning at least some credits through one-line recordings such as this. Lexvid offers certificates of attendance for states in which its courses are registered; in some other states you have to self-apply for credit. If you self-apply for credit, it is not guaranteed that the state will grant credit, however it costs nothing to try that one free credit!
