February 28: Web - Ethical Considerations While Representing Juvenile Clients (Washington State only)

How should attorneys approach issues such as confidentiality, client communication, and consent while working with juvenile clients? What if the juvenile client also suffers from trauma? What if he or she recently moved to the United States from a foreign country and/or has limited English-language skills? In this 90 minute CLE, faculty members will provide attorneys with best practices for competently and ethically representing juvenile clients with unique challenges and special needs.

February 16: Webcast - Brave New World: 10 Tips Adapt to the Changing Legal Landscape

Technology, outsourcing, pro-se filings and forms, and many other trends and forces are changing the way people use the law and the way lawyers think about how they practice. Lawyers who want to not only survive but thrive in this new landscape – and make sure they do so ethically – must understand these emerging trends. This presentation will provide 10 tips to help lawyers understand the emerging legal landscape and the applicable ethical rules and concepts. Lawyers who attend this webinar will learn about:
  • Unbundling: What rules apply to unbundling and limited scope representation and how can lawyers use these tools effectively and ethically?
  • Cloud services: A few bar associations have issued opinions on how to use cloud services ethically. What are these rules? What is the cloud? How can lawyers use it?
  • Social media: Overview of social media rules and some key ethical areas where lawyers stumble.
  • Technology as an Ethical Competency: ABA Model rule 1.1 comment 8 has been adopted in a few states. What is this new duty of technological competence? How can or should lawyers understand it and what does it mean?

March 10: Web - Lawyers and Lies #MCLE

Most of us are taught that being honest is an unquestioned virtue – yet the law doesn’t necessarily see it that way. This course will explore the legal status of “required honesty,” before diving deep into a review of the various Rules of Professional Conduct relating to honesty, and how they play out depending on the relationship between attorney-speaker and subject. Attorneys who attend this webinar can expect to learn:
  • The relationship between First Amendment-protected speech and professional speech regulation.
  • How shifting cultural values shape what we define as a lie.
  • Negotiation ethics and the difference between bargaining and lying.

March 31: DC - Veterans Consortium Pro Bono Program Training #MCLE

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.

May 11: Web - If you’re not on Facebook you’re committing malpractice #MCLE

Can you imagine cross-examining a witness about a telephone call if you’d never used a telephone before? It sounds ridiculous, but that’s precisely where many attorneys find themselves today when it comes social media. Whether it’s Facebook, Twitter or another channel, most of the population is now using one or more of these tools to communicate and it’s increasingly dangerous for attorneys to blithely ignore social media and other developing technologies. Attorneys who attend this webinar can expect to learn:
  • The growing number of ethics opinions addressing social media, and the obligation of attorneys to be familiar with them.
  • How to think about counseling clients on their use of social media during a pending matter — and the attorney’s own use.
  • The intersection between competency requirements and changes in law office technology.

February 10: Cleveland - Commemorating Terry v. Ohio: A Milestone in the History of African-American Lawyers

Cleveland-Marshall College of Law hosts a dedication of a new Ohio historical plaque commemorating the landmark Supreme Court case Terry v. Ohio, which continues to govern the disputed legal terrain of police-citizen encounters. The Terry case was litigated by two prominent Cleveland attorneys, defense lawyer Louis Stokes and prosecutor Reuben Payne, both 1953 graduates of Cleveland-Marshall College of Law. These two African-American lawyers argued the case in the Cuyahoga County Common Pleas Court, on appeal in the Ohio Eighth District Court of Appeals, and then in the United States Supreme Court.
The Supreme Court oral argument in Terry on December 12, 1967, was a milestone in American legal history. It was the first time two African-American lawyers argued a case before an African-American justice, Thurgood Marshall, who had assumed the bench in October 1967. The historical plaque commemorates this important event in Cleveland and American history.
The event will be held in the Moot Court Room at the Cleveland-Marshall College of Law, with a reception to follow.

February 23: Webcast - Integrating Health Impact Assessments via Environmental Policy Acts

Schools are a key part of the physical and social environment in every community. In order to promote good health, education must be of high quality, accessible, safe, and equitable. Because of the critical role that education plays as a social determinant of health, public health practitioners, policymakers, and their partners across the health system need to have a solid understanding of the relationship between education and health in order to develop effective policies and allocate resources to maximize improvements across both sectors.

The new federal Every Student Succeeds Act as well as emerging legal and policy approaches at the state and local level provide opportunities for schools and other educational programs to more fully engage with their communities and encourage the development of well-rounded students and citizens.

This webinar, co-sponsored by the Network and the CDC’s Public Health Law Program, is the first in a series on the Social Determinants of Health and the Law, and will explore how law and policy can be used to address education as a social determinant of health.

Social media is now part of the fabric of practicing law. There are ethics opinions galore and not all of them are consistent. Courts are grappling with difficult issues of preservation of, or access to, information on social media sites, and even the more difficult issues of jurors who live on their mobile devices. Gumshoe detective work on witnesses and jurors is running up against professional misconduct concerns. And lawyers and judges themselves are sometimes the ethical focal point by their use of social media websites. The Illinois Supreme Court has appointed a commission that is looking into formulating rules to cover this area with a report expected in 2017, but before then, our panel will give you a number of important insights on how you should – and should not – conduct yourself consistent with your obligations under the rules of professional conduct. So don’t get bitten by a byte!

2:30-4:30 pm CST
Broadcast live via the Internet from the DePaul Center, Room 8005
