October 29: Medical Device Regulation: Going from Bad to Worse . . . or Better? with George Horvath


Innovations in medical device technology hold the potential to improve health outcomes across the populace. But these same innovations can inflict widespread harm; by some estimates, medical devices caused 1.7 million injuries and 83,000 deaths between 2008 and 2017. Hence, we need for a regulatory system that ensures safety while simultaneously permitting—or ideally, fostering—innovation. Over the past half-century, Congress and the FDA have created a unique and complex regulatory system that seeks to achieve these goals. But according to many critics, this system is far too lax, allowing devices to reach the market without an adequate assessment of safety; others maintain that FDA regulation is stifling innovation and depriving patients of valuable technology.
This talk will focus on some of the perennial shortcomings of medical device regulation, on how the regulatory framework might be altered to achieve its goals, and, in an era of changing administrative priorities and limited agency resources, on how we might begin to move forward.

George Horvath
joined the UC Law SF faculty as an Associate Professor of Law in 2024. His scholarship combines his background as a practicing physician and medical scholar with empirical and doctrinal legal analysis to study the fraught intersections of law and health care. His work examines the ways in which statutory, regulatory, and implementation choices about the FDA’s role in regulating medical devices and drugs has impacted safety and innovation. Prior to joining the UC Law SF faculty, Professor Horvath was an Assistant Professor of Law at the University of Akron School of Law. He was a postdoctoral Fellow in Public Law at the University of California, Berkeley, School of Law. He clerked for Judge John T. Noonan, Jr. on the Ninth Circuit Court of Appeals. Professor Horvath earned his J.D. at Berkeley Law, where he served as Editor-in-Chief of the California Law Review. Prior to his legal career, Professor Horvath earned his M.D. at Temple University Medical School and practiced as a cardiologist specializing in the study and treatment of heart rhythm disorders.

October 14: Unmasking the Financialization of Healthcare with Jacqueline Fox

Financialization of healthcare drains our current system of resources it needs to provide care. It occurs when money is siphoned off for private profit through mechanisms such as rent seeking, gamesmanship, and exploitative price setting. 
This is not an ethically neutral activity, and the people profiting in this way ought to justify why they are entitled to this money, given the foreseeable negative effects what they are doing has on people’s health. This important problem is masked by current accounting methods and healthcare billing methods, which need to be changed to allow for a more transparent assessment of what is really occurring.

teaches Health Care Law and Policy, Public Health Law, Bioethics, and Torts. She has published numerous articles on health law, health care financing and regulation, and health care reform in publications including the University of Cincinnati Law Review, Buffalo Law Review, Seton Hall Law Review, the Yale Journal of Health Policy, Law, and Ethics, the International Journal of Healthcare Technology and Management, and The Hasting Center's Health Care Cost Monitor. Her current work closely examines the newly created Independent Payment Advisory Board, which is tasked with capping the costs of the Medicare program. She has published op-ed pieces in The State newspaper and appeared on local and regional news shows speaking on the subject of health law. Her work on Medicare, in particular, has been cited in a number of scholarly publications and one of her contributions to the Hastings Center health reform publications has been the subject of an article in the New York Times. She has also been an invited speaker at universities including Oxford University, the University of Toronto, Johns Hopkins University, and Yale University. She was a visiting professor at the Santa Anna University in Pisa, Italy, for the spring semester of 2009. Fox received her B.A. from Sarah Lawrence College and J.D. and LL.M. from Georgetown University. November 5: Working with Asylum Clients Affected by War in Ukraine

Please join the Center for Gender & Refugee Studies-California (CGRS-CA) and Jewish Family and Children’s Services (JFCS) on a training about working with Ukrainian refugees. This training will equip legal practitioners with culturally competent, trauma-informed tools to improve legal outcomes and client trust for Ukrainians and Russian-speaking asylum seekers affected by war.
Our presenters will provide best practices specifically tailored to the cultural dynamics, trauma expressions, and trust barriers unique to post-Soviet populations – making sure practitioners can provide effective and ethical representation.
This training will also provide an overview of eligibility for asylum, and how persecution can be demonstrated in a client’s declaration. Attendees will gain insights from immigration practitioners, non-profit caseworkers, and clinical psychologists on how best to serve the populations most impacted by the war in Ukraine.

In the December 2023 Canadian ruling of Bjorkquist et al. v. Attorney General of Canada, the definition of who is entitled to Canadian citizenship by descent was deemed unconstitutional. Since then, the Canadian government has put measures into place allowing many individuals with Canadian ancestry to confirm their citizenship status--even after several generations in the United States. 
These measures have far-reaching implications for businesses whose employees may have claims to Canadian citizenship, families, and individuals contemplating a move to Canada or who wish to obtain a Canadian passport. 
This session will provide an overview of current and previous Canadian citizenship eligibility, the Bjorkquist ruling and expansion of who is eligible for citizenship, and the process for “lost Canadians” to claim citizenship.

October 3: Artificial Intelligence in the Energy Sector

Artificial intelligence (AI) is transforming the energy industry in profound ways. Energy companies are utilizing AI and machine learning to optimize energy production, forecast demand, detect equipment failures, and streamline operations. This rapid adoption of AI is creating new legal issues and challenges for attorneys advising energy sector clients. 
This CLE provides an overview of how leading energy companies are currently deploying AI across their operations. It will examine use cases such as predictive maintenance, automated trading, smart grid management, and dynamic pricing algorithms. 
In addition, the CLE will explore emerging legal issues surrounding the use of AI in the energy domain. This includes regulations governing AI explainability and transparency, liability issues, data privacy concerns, and intellectual property rights.
