Derivative Work - On-Demand MCLE

Recently, RDR books endeavored to publish  an unauthorized encyclopedia of all things Harry Potter. Warner Brothers filed suit, and the resulting litigation turned out to be a fascinating fight over the precise contours of copyright law's "derivative work" right.
In this audio we look back at that now-settled case, using it as a launching point from which to consider not only the scope of the derivative work right, but also some practical questions about when and whether a copyright holder ought to enforce such a right as against fan-produced materials.

Telecon/June 14 - Outspoken Opinionated Attorneys Needed for #Ethics seminar!

Attention Minnesota, Wisconsin and New York Attorneys: Richard Clem has a free CLE opportunity for you - if you're opinionated!
He writes:

"I'm going to be doing an "Elimination of Bias" CLE on Tuesday, June 14. Two credits of "Elimination of Bias" are required in Minnesota, but such programs are rarely offered outside the state, and can be difficult to find for Minnesota licensed attorneys living in other states. I have a couple of people in that position, and I'll be doing a telephone conference call on Tuesday, June 14 at 1:00 PM Central Time.
I've exhausted everything I know about the subject in the first hour of the program, so the second hour is an open discussion by the participants. Unfortunately, two people doesn't make for a very lively discussion.
Therefore, I'm using the lure of free CLE credit to get a couple more people to participate. The more opinionated you are, the better. If you have personal experience with bias in the legal profession or court system and would like to share, that would be greatly appreciated. But unfortunately, this won't be the typical CLE where you can sit in the back of the room and read the newspaper.
If you are interested, please let me know at clem.law@usa.net. I'll send you the course materials from the first half of the program to read, along with the proposed discussion questions, and instructions for calling in.
I have applied for 1.0 Minnesota Elimination of Bias credit. In addition, I will be applying for 1.0 Wisconsin standard CLE credit. Wisconsin credit was granted for the first half of the program, but I'm not sure how they will treat the discussion format. But Wisconsin has reciprocity with New York, so if it's approved, it will also provide New York credit. Many other states will get you credit on the strength of the Minnesota credit.

One of the most contentious issues in the debate over patent reform is the question of how, if at all, Congress should change the way courts calculate patent damages.
To understand that fight, this audio examines a series of editted excerpts from testimony recently given before the Senate and, separately, the Federal Trade Commission, all on the question of damages reform. June 28/Seattle - The Ehren #Watada Case: Standing On Principle

The World Peace Through Law Section of the Washington State Bar Association’s meeting on Tuesday, April 26, noon – 1 p.m. features Kenneth S. Kagan, of the Seattle firm Carney Badley Spellman, discussing his experiences in successfully defending Lt. Ehren Watada from court-martial proceedings for his refusal to deploy during the Iraq War.  

Lt. Watada’s refusal to deploy garnered national attention and was based upon his claim that the Iraq War itself was illegal, violating international law.  Mr. Kagan will discuss both the substantive legal issues involved and his practice experiences with this notable case.

First Lieutenant Ehren K. Watada was the first commissioned officer in the US armed forces to refuse to deploy to Iraq, in June, 2006, saying he believed the war to be illegal and that, under the doctrine of command responsibility, it would make him party to war crimes. He was brought before a court-martial in 2007 which ended in a mistrial, and was discharged in 2009.

Mr. Kagan has extensive trial and appellate practice experience in both the public and private sectors and in state and federal trial and appellate courts, as well as before state administrative agencies. He has been responsible for a number of published appellate court decisions, including the decision of the Washington State Supreme Court, Seattle v. Mesiani, wherein the Court ruled that DUI roadblocks are unconstitutional. In 1994 and 1995, he served as Disciplinary Counsel to the Washington State Bar Association. Since then, Mr. Kagan has developed expertise in additional practice areas, including legal ethics, professional licensing and discipline (representing, among others, doctors, lawyers, psychologists, therapists and counselors), and complex civil litigation, including medical malpractice and wrongful death.
