Oct 5 / Why We Play: Sports, Drugs, and Meanings

Oliver C. Schroeder Jr. Scholar-in-Residence Lecture presented by the Law-Medicine Center


Title:
"Why We Play: Sports, Drugs, and Meanings"

The controversy over elite athletes using anabolic steroids, growth hormone, and other performance enhancing drugs largely overlooks three crucial issues. First is the context of athletic competition, the forces that press athletes to consider using drugs, and the nearly universal desire among athletes for a "level playing field." Second is the far larger community of amateur athletes including tens of millions of young people. Third are a set of disputes over the meanings of key concepts in sport: What is a "level playing field" and is it achievable or even desirable? What constitutes fairness in sport? Why does sport accept, even need, seemingly arbitrary limits on equipment and other rules? And, finally, what makes sport worthwhile, a meaningful human endeavor: In other words, why do we play?

How would this be useful to lawyers? I'd take on issues of fairness and justice; social policy ideas like harm reduction strategies in drug policy; reflections on liberty, paternalism, and public health; off-label and non-therapeutic drug use, including use supervised or promoted by physicians.

University, where he was also the Susan E. Watson Professor of Bioethics. He serves on many editorial boards, has been president of the Society for Health and Human Values and of the American Society for Bioethics and Humanities, and among other current posts serves as Chair of the Ethical Issues Review Panel for the World Anti-Doping Agency and as International Expert Advisor to Singapore�s Bioethics Advisory Committee. Dr. Murray has testified before many Congressional committees and is the author of more than 200 publications including The Worth of a Child, The Cultures of Caregiving: Conflict and Common Ground among Families, Health Professionals and Policy Makers, edited with Carol Levine, and Genetic Ties and the Family: The Impact of Paternity Testing on Parents and Children, edited with Mark A. Rothstein, Gregory E. Kaebnick and Mary Anderlik Majumder, and most recently, Performance-Enhancing Technologies in Sports: Ethical, Conceptual, and Scientific Issues, edited with Karen J. Maschke and Angela A. Wasunna. He is also editor, with Maxwell J. Mehlman, of the Encyclopedia of Ethical, Legal and Policy Issues in Biotechnology. In January 2004 he received an honorary Doctor of Medicine degree from Uppsala University.

Oct 2/ Cleveland, OH - Freedom from Religion: Rights and National Security

In his talk, Amos Guiora will discuss the topic of his book, Freedom from Religion. In his book, Prof. Guiora invites policy-makers and concerned citizens to consider an unusual technique for curtailing the threat of new terrorist attacks: curtailing religious freedom. He argues that Western and Middle Eastern tolerance of religious extremism has led to the current security crisis that our world now faces. By exploring the different policies and challenges arising in five countries (the U.S., The UK, the Netherlands, Turkey, and Israel), Prof. Guiora adds a novel argument to the global debate on religion's relationship to terror.

Guiora who teaches Criminal Procedure, International Law, Global Perspectives on Counterterrorism and Religion and Terrorism incorporates innovative scenario-based instruction to address national and international security issues and dilemmas. He is a Member of the American Bar Association's Law and National Security Advisory Committee, a Research Fellow at the International Institute on Counter-Terrorism, The Interdisciplinary Center, Herzeliya, Israel, a Corresponding Member, The Netherlands School of Human Rights Research, University of Utrecht School of Law and was awarded a Senior Specialist Fulbright Fellowship for The Netherlands in 2008. Professor Guiora has published extensively both in the U.S. and Europe on issues related to national security, limits of interrogation, religion and terrorism, the limits of power and multiculturalism and human rights. He is the author of Global Perspectives on Counterterrorism, Fundamentals of Counterterrorism, Constitutional Limits on Coercive Interrogation, and Freedom from Religion: Rights and National Security. He served for 19 years in the Israel Defense Forces as Lieutenant Colonel (retired), and held a number of senior command positions, including Commander of the IDF School of Military Law and Legal Advisor to the Gaza Strip.

Practitioners and commentators have noted that the U.S. Supreme Court has adopted a somewhat expansive attitude toward claims of retaliation and has interpreted the retaliation provisions of antidiscrimination laws accordingly. A panel of seasoned employment and labor law practitioners representing the plaintiff and defense perspectives will discuss, among other things, the recent U.S. Supreme Court cases on retaliation, the effect that the Court's expansive approach to retaliation has had on their practices, and how employers and employees should respond in advising their clients and in handling employment discrimination claims in the wake of the Court's recent decisions.

In this course, we will discuss the Patient Protection and Affordable Care Act of 2010 and consider its implications for individuals, employers, insurance companies, physicians, nurses, and other health care professionals.  We also will consider the Act's implications for Medicare and Medicaid, long term care, and other health care programs.  In addition to studying what the Act will do, we also will discuss where future legislation might be needed to fully reform the United States health care system.

  

Readings:  As a text for the course, we will be using CCH's Law, Explanation and Analysis of the Patient Protection and Affordable Care Act (2010). The DePaul Center for Animal Law cordially invites you and your colleagues to
join us for this year's symposium, "Revisiting the Line between Free Speech and
Obscenity:U.S. v. Stevens and Its Impact on Animal Welfare". The symposium will
take place at the DePaul College of Law on Thursday, September 30 from 8:30 a.m.
to 4:30 p.m.

The symposium will evaluate the constitutional issues raised in Stevens, as well
as draw attention to the destructive influence of dog fighting on our local
community. Panelists include Bob Corn-Revere, co-counsel for defendant Robert
Stevens, Randall Lockwood, PhD, Senior Vice-President for Anti-Cruelty
Initiatives and Legislative Services for the ASPCA and internationally renowned
bioethicist, author and veterinarian, Dr. Michael W. Fox.

Additionally, we are pleased to welcome Jeff Jenkins and Sean Moore as our
keynote speakers. Jeff and Sean are part of the HSUS End Dogfighting campaign,
an innovative program that relies on community outreach methods to change
attitudes and behaviors between people and their pit bulls. For more
