June 1/NYC: Rivera v. Lutheran Medical Center - an #Ethical Issue: The Perils of Representing A Client's Employees

In Rivera, the Court concluded that a law firm representing a defendant violated New York’s attorney non-solicitation rules by contacting the defendant’s current and former employees and offering to represent them at depositions at the defendant’s expense. The Court referred the lawyers to the state disciplinary committee.

In an hour long seminar, we will discuss the impact of the Rivera decision.

  • After Rivera, when can a lawyer offer to represent a client’s current and former employees?
  • Can the client properly initiate a conversation with current and former employees about representation?
  • How should current and former employees be contacted about representation?
  • Does Rivera apply to current employees?
