Learn the extent to which victims of sex trafficking are arrested and criminalized under current police and prosecution practice. This session will provide a basic overview of relevant federal and New York State anti-trafficking law, an examination of how those arrested and prosecuted for prostitution are overwhelmingly victims of trafficking, and how to develop advocacy tools and engage in motion practice to serve this marginalized population. In April 1980, after serving four years as a prosecutor, Terry Hake agreed to assist the FBI and the United States Attorney's Office in Chicago in an investigation of the Cook County Court System. For three and one half years, he worked undercover posing as a corrupt prosecutor and accepting bribes from attorneys and later as an attorney in private practice making payoffs to judges and court personnel for the dismissal of cases. The investigation, known as "Greylord", resulted in convictions of 18 judges, 57 lawyers, 10 law enforcement officers, and other court personnel.

April 8: Cleveland - An Academic Conflict : Pharma's Increasing Influence on Medical Education #MCLE

The line between pharmaceutical public relations and medical education are blurring. Many might think that the biggest cost that a pharmaceutical company incurs is from the research and development that is needed to bring a new medication to market. To be sure, these costs are significant, often more than $1 billion dollars. But a recent British Medical Journal (BMJ) study unveiled a far greater cost. That study showed that pharmaceutical companies actually spend 19 times more on marketing and promotion than they do on research and development. Much of this cost is from direct marketing to physicians and physicians-in-training (medical students and residents) through small gifts like lunches, pens, prescription pads, samples, and continuing medical education credits. But while these gifts are seemingly nominal, the effects are not. Moreover, industry sponsored clinical research, comprising roughly 80% of all funded research, is increasingly influential on the way that physicians practice. But those studies are far more likely to have outcomes favoring the industry sponsor than studies with other sponsors. As a result, even “pharma” sponsored lunchtime lectures can greatly impact the prescribing patterns of physicians-in-training.

After graduating summa cum laude and Phi Beta Kappa from Ohio University, she served in the United States Peace Corps as a community economic development volunteer in Panama where she helped a women’s cooperative gain sustainability and taught children oral hygiene and nutrition. She received her M.D. from Northeast Ohio Medical University where she was awarded Alpha Omega Alpha (AOA) as well as Gold Humanism Honor Society (GHHS) memberships.  Dr. Degesys served as AMSA’s National Secretary and Vice President for Internal Affairs, Nida prior to her Presidency. She also served as AMSA’s Chair of Medical Education when she developed a medical education leadership institute curriciulum “Teaching Tomorrow’s Teachers Today,” in Washington, D.C. In 2009-2010 she was the Education Coordinator for the committee on the culture of medicine where she lead a national study on medical student knowledge on patient safety . Dr. Degesys has presented her research on patient safety, students’ attitudes towards disabilities, and educational pedagogy both internationally and nationally which have won her several research awards.  Dr. Degesys was appointed by Governor Strickland of Ohio to serve as a Trustee on the Northeast Ohio Medical University Board of Trustees from 2010-2012. She is currently interviewing for emergency medicine residency.

April 2: Cleveland + Webcast - 40 years in Tax – a Look Backward (As Well as Forward) #MCLE

Don Korb has been involved in the practice of tax law for over 40 years, both as a private practitioner and as a tax administrator. He plans to talk about how the U.S. federal income tax system has changed over his career as well as how the role of tax advisors and practitioners has evolved over that same time period. He will speak from the standpoint of someone who has moved back and forth between the private and public sectors and not only has sat on “both sides of the table” but he has also occupied leadership positions at the IRS (Assistant to the Commissioner of Internal Revenue in the mid-1980’s and Chief Counsel for the IRS from April, 2004 through December, 2008) which allowed him to play a significant role in some of the changes to the tax system and the evolution of the role of tax advisors/practitioners which have occurred since he began practicing law in the early 1970’s.

Donald L. Korb is a tax partner at Sullivan & Cromwell LLP where he leads the firm’s Tax Controversy Practice. Prior to joining Sullivan & Cromwell, Don served as the Chief Counsel for the Internal Revenue Service from April 2004 until December 2008.
As Chief Counsel, Don was the chief law officer for the IRS, supervising approximately 1,500 attorneys who were assigned to the IRS National Office and among the major operational divisions of the agency. He played a prominent role in increasing the effectiveness of the Chief Counsel’s Office, and is best known for developing the litigation strategy that led to the stunning success by the government in litigating tax shelter cases during his four-and-a-half-year tenure.
Among the individual matters with which Don was personally involved while Chief Counsel was serving as the lead negotiator in resolving a landmark transfer pricing dispute. As part of the settlement, the taxpayer made the largest single payment ever made to the IRS to resolve a tax dispute.

March 6: Saint Paul + Webcast - Current Developments in Privacy & Security Rule Enforcement

As privacy becomes an ever more public issue for Americans, how are privacy protections for health care information being administered?
The Chief Regional Civil Rights Counsel for the U.S. Department of Health and Human Services, Jerome Meites, will discuss HHS’s administration of the HIPAA Privacy, Security and Breach Notification Rules. Mr. Meites will comment on coordination between HHS’s Office for Civil Rights, the HHS agency that enforces the HIPAA regulations regarding privacy, and state Attorneys General. He will also talk about HHS’s administration of the omnibus regulations, which became fully effective in the fall of 2013, as well as the privacy and security compliance audits that OCR and KPMG recently conducted. Mr. Meites will also discuss steps that covered entities can take proactively to prevent breaches of their patients’ protected health information and advice that lawyers may want to give to covered entities on these issues.

March 6: Minneapolis - Monitoring Domestic Violence in Mongolia

This CLE will focus on “Implementation of Mongolia’s Domestic Violence Legislation,” a newly-released report that analyzes the real-life results that followed the Mongolian government's enactment of the Law to Combat Domestic Violence in 2004. The Advocates for Human Rights and its partner, the National Center Against Violence (NCAV), headquartered in Ulaanbaatar, Mongolia, co-authored the report, which was released in January 2014.
Specifically, the report points to the challenges obtaining restraining orders; the consequences of domestic violence not being directly addressed by penal legislation; the barriers the country’s Family Law poses to obtaining a divorce; and the results of the lack of shelters and essential social services and support.
This session will also explore the two fact-finding missions The Advocates and NCAV conducted in Mongolia in January and March 2013. Representatives of the organizations traveled to seven cities throughout Mongolia, conducting 137 interviews with ministry officials, non-governmental organizations, victims, social workers, police, judges, prosecutors, lawyers, governors, and health care workers.

  • Aviva Breen, a board member of The Advocates, is a long-time volunteer with the organization's Women’s Human Rights Program. She has participated in training on domestic violence law reform and advocacy, including training for advocates, judges, police officers, health care professionals, and social workers. Previously, Breen was director of the Legislative Commission on the Economic Status of Women in Minnesota. Prior to her work with the Commission, she was an attorney with the Legal Services Advocacy Project.
  • Kate Bruce is a judicial law clerk with the U.S. District Court for the District of Minnesota. Previously, she was an attorney at Robins, Kaplan, Miller & Ciresi. Kate has provided extensive pro bono work, representing victims of domestic violence and asylum seekers. She has also worked with the Hague Domestic Violence Project, where she developed training resources for and provided technical assistance to attorneys representing battered mothers in cases brought under the Hague Convention on the Civil Aspects of International Child Abduction. In 2013, she had the honor of working with The Advocates as a volunteer for the domestic violence-related fact-finding mission in Mongolia.
  • Erdenechimeg “Chimgee” Haltarhuu was born in Mongolia. As a child, she frequently witnessed her father beating her mother. After graduating from the prestigious Mongolian Circus School, she joined the Mongolian State Circus. While performing across Mongolia, Russia and Europe, she married a fellow circus performer and became a victim of domestic abuse. She suffered many injuries, including a broken jaw and the loss of teeth. Because of her experiences, Chimgee spreads awareness of domestic violence and what women can do. The Ministry of Culture in Mongolia has honored her with its highest citizen award, the “Foremost Cultural Worker” for her work to prevent domestic violence. Last year, she received the “2012 Amazing Woman” award at the Mongolian Women’s Conference in Chicago. Now happily remarried, she lives in Minneapolis and works through her charity, Mission Manduhai, to aid those in her homeland.
  • Helen Rubenstein is deputy director of The Advocates’ Women’s Human Rights Program. She has conducted fact-finding missions in Mongolia and co-authored a report on the implementation of domestic violence legislation in that country. At the request of non-government organizations in Mongolia, Kazakhstn, Uganda, and Somalia, she has evaluated laws in those countries according to international human rights principles. She also has developed training programs for legal professionals in Eastern Europe and Central Asia on violence against women.

This training is targeted at attorneys interested in learning about relief available to non-citizen victims of domestic violence. The training will explain how to evaluate claims for asylum and U-Visa for victims of domestic violence. It will guide attorneys through the basic elements of each of these forms of relief and explore their procedural and evidentiary similarities and differences. The training will also focus on working with victims of domestic violence and preparing strong applications for either form of relief.

Harold Hongju Koh is Sterling Professor of International Law at Yale Law School. He returned to Yale Law School in January 2013 after serving for nearly four years as the 22nd Legal Adviser of the U.S. Department of State. Professor Koh is one of the country’s leading experts in public and private international law, national security law, and human rights. He first began teaching at Yale Law School in 1985 and served as its fifteenth Dean from 2004 until 2009. From 2009 to 2013, he took leave as the Martin R. Flug ’55 Professor of International Law to join the State Department as Legal Adviser, service for which he received the Secretary of State's Distinguished Service Award. From 1993 to 2009, he was the Gerard C. & Bernice Latrobe Smith Professor of International Law at Yale Law School, and from 1998 to 2001, he served as U.S. Assistant Secretary of State for Democracy, Human Rights and Labor.

  • Kavita Shah Arora, M.D., M.B.E. is an Assistant Professor of Reproductive Biology and Bioethics at Case Western Reserve University, as well as a practicing general obstetrician/gynecologist at MetroHealth Medical Center. She received her BS with a minor in Philosophy from the Pennsylvania State University. In 2009, she graduated with both an MD from Jefferson Medical College and a Master's Degreein Bioethics from the University of Pennsylvania. She completed her residency in Obstetrics and Gynecology at McGaw Medical Center of Northwestern University in 2013. Dr. Arora is primarily based at MetroHealth Medical Center as a practicing general ob/gyn. She is an active member of the hospital's ethics committee. Her research interests include reproductive ethics, reproductive technology, perinatal decision making, conscience, HIV care in pregnancy, and feminist bioethics. She is also interested in medical education, especially with the intersection of ethics education.
  • Mark P. Aulisio, PhD is a Professor in the Department of Bioethics at Case, where he serves as Director of the Bioethics Ph.D. Program, and Director of the Center for Biomedical Ethics of the MetroHealth System. He has authored over 70 articles and book chapters on clinical bioethics, ethics consultation, organ donation and transplant, double effect and related areas and is a sought after speaker nationally and internationally. In 2009, Dr. Aulisio was honored with the American Society for Bioethics and Humanities’ (ASBH) Distinguished Service Award for having helped to lead three national projects that resulted in Core Competencies for Health Care Ethics Consultation (1998), Status of Bioethics and Medical Humanities Graduate Training Programs in the North America Report (2002), and Improving Competencies in Ethics Consultation: An Education Guide (2009) respectively. Dr. Aulisio also has extensive international bioethics experience which includes serving: as PI on clinical bioethics projects with colleagues at Kyoto University (2003-2004) and the University of Tokyo (2004-2006); as a co-investigator in University of Paris led 11 nation project on bioethics education (2006-2008); as co-investigator on a bioethics and citizenship project with Spanish colleagues at the University of Salamanca (2010-2011); and as a contributor to the Canadian Blood Services sponsored forum on the possibility of developing a National Organ and Tissue Donation and Transplant Program (2011).
  • Sheryl A. Kingsberg, Ph.D. is a clinical psychologist and a renowned sexual health expert. She is the chief of behavioral medicine at MacDonald Women’s Hospital/University Hospitals Case Medical Center and Professor in Reproductive Biology and Psychiatry at Case Western Reserve University. Her areas of clinical specialization include sexual medicine, female sexual disorders, cognitive behavioral psychotherapy, menopause, pregnancy and postpartum mood disorders, psychological aspects of infertility, and psychological and sexual aspects of cancer. Dr. Kingsberg’s primary research interests are in treatments for female sexual disorders and the psychological aspects of infertility and menopause. She has numerous publications in many national and international journals, and is an Associate Editor for the Journal of Sexual Medicine and sits on the editorial board of the journal Menopause. She has also authored numerous book chapters on topics including perimenopause and sexuality, oocyte donation, infertility and aging, the treatment of psychogenic erectile dysfunction and sexuality after cancer.
