Mock Trial and Moot Court Competitions provide an invaluable service to law students in preparing them to be better advocates. For your service as a judge, you may receive free CLE credits.

Description:
The Mock Trial Competitions are two of five annual in-house competitions hosted by the Moot Court Honor Board to provide students with the opportunity to gain first-hand experience with a variety of practical lawyering skills. Students form teams of two and are provided the mock trial problem in advance. Teams must prepare an opening statement, direct examination of two witnesses, cross examination of two witnesses and closing arguments. The competition features two preliminary rounds and three elimination rounds (quarterfinal, semifinal, and final).
As a judge, you will provide feedback and evaluate the participants’ performance. We welcome attorneys from all practice areas. We will provide you with details regarding the problem and fact pattern in advance of the competition.
Judging for a UWLS competition is an opportunity to provide law students with valuable feedback on their trial advocacy skills. Volunteer judges are also invaluable to the continued success of the Moot Court Honor Board and the in-house competition program.

A decade ago, Dechert partner Jeremy Zucker helped to found a non-profit organization called Freedom Now. Freedom Now represents prisoners of conscience around the world on a pro bono basis, using legal and political advocacy to secure their release from prison.
While other organizations (such as Amnesty and Human Rights Watch) call attention to the plight of such prisoners, only Freedom Now takes them on as clients (typically we are retained by spouses or other close family relations) and continues to represent them until they are freed. Freedom Now has represented some very well known prisoners of conscience, including the only imprisoned Nobel Peace Prize winner, as well as many who are far less well known. Clients have included leading political opposition figures as well as journalists, editors, bloggers, human rights lawyers, religious figures, musicians and doctors, among others, and they have been imprisoned in the Americas, Africa, Europe, the Middle East and Asia.
While Freedom Now’s small staff (located in D.C.) handles some cases, its leverage comes from referring cases out to law firms. This training is for those interested in getting involved in the work of Freedom Now. The training will provide an overview of human rights advocacy as it pertains to individual prisoners of conscience. While presenting some of Freedom Now cases as illustrations, primary topics covered will include applicable international law and standards, legal venues and processes for case submission, and effective advocacy strategies.

Throughout its 37-year history, the Foreign Corrupt Practices Act (FCPA) has proven one of the most controversial tools in the United States' arsenal against corruption. Opponents believe that the law harms U.S. business interests; American corporations are prohibited from doing things that other countries' corporations can do with impunity. Proponents point out that the U.S. has helped change attitudes towards bribery, pressured other states to strengthen their domestic laws, and drawn the international community's attention to a pernicious and insoluble global problem.
However one views the FCPA, it has certainly generated business for US law firms. This panel, featuring prominent Cleveland lawyers well versed in FCPA enforcement and advising, will provide an account of the current state of the FCPA. The panelists will reflect on their own experiences defending against FCPA investigations, discuss strategies that companies can use to avoid falling afoul of the FCPA, and provide suggestions as to how the law might be improved and clarified. Limited scope representation, also known as unbundling, is a way to connect lawyers needing work to clients needing affordable or pro bono legal assistance. It allows the lawyer and the client to agree in advance that the lawyer will undertake certain tasks, such as drafting pleadings or appearing at a contested hearing, and the client will represent him or herself for other parts of the case. This is a valuable tool in increasing access to justice and improving the workings of the court system. It does, however, raise some unique ethical issues that need to be addressed.

October 22: Cleveland + Webcast - Probes and Bribes: Practioners’ Perspectives on the Foreign Corrupt Practices Act

Throughout its 37-year history, the Foreign Corrupt Practices Act (FCPA) has proven one of the most controversial tools in the United States' arsenal against corruption. Opponents believe that the law harms U.S. business interests; American corporations are prohibited from doing things that other countries' corporations can do with impunity. Proponents point out that the U.S. has helped change attitudes towards bribery, pressured other states to strengthen their domestic laws, and drawn the international community's attention to a pernicious and insoluble global problem.
However one views the FCPA, it has certainly generated business for US law firms. This panel, featuring prominent Cleveland lawyers well versed in FCPA enforcement and advising, will provide an account of the current state of the FCPA. The panelists will reflect on their own experiences defending against FCPA investigations, discuss strategies that companies can use to avoid falling afoul of the FCPA, and provide suggestions as to how the law might be improved and clarified. A reception will follow the presentations. CLE credit will also be available.

October 2: Webcast + San Francisco - Representing the Pro Bono Client: Advocacy Skills for Administrative Hearings

The need for pro bono assistance with administrative hearings has never been higher. The increased trend of employers challenging all Unemployment Benefits claims has been combined with the explosion of Unemployment Insurance claims during the recession. Budget cuts and program changes have created a “perfect storm” for public assistance recipients. Several significant changes to key benefits programs have occurred in recent years, imposing new complex rules. At the same time, county staff has shrunk, and experienced workers retired, increasing the occurrence of administrative errors and problems with client’s receipt of the benefits to which they are entitled.
Legal services also suffered staffing cuts, with reduced ability to represent clients in these cases. Unfortunately, many individuals who are owed desperately needed funds, or who have had their benefits improperly lowered or terminated, cannot make it through the appeals system benefit of legal counsel to guide them through the process or to vigorously defend against unlawful actions. As a result, families face the very real possibility of hunger, homelessness, and overall family instability.
This training is designed to help mitigate the crisis by providing attorneys with a basic understanding of common issues and strategies in providing assistance with administrative appeals. The program will focus on California law, but will also cover many topics such as due process and other rights that apply nationwide, therefore advocates from other forums would benefit from the information and attending the program.
