March 26: Immigration Consequences of Criminal Convictions: 101 Basic Concepts

Description: This one-hour seminar will go over the fundamentals of immigration consequences of criminal convictions. This includes an overview of what types of consequences are triggered by criminal convictions, what types of consequences are triggered by other contact with the criminal legal system, what constitutes a “conviction” for immigration purposes, what information is needed to do a competent immigration consequences analysis, and the duties of California defense attorneys as far as investigating and advising on immigration matters. 
The seminar will provide a basic overview of the criminal grounds of inadmissibility as well as the criminal grounds of deportability and explain how advocates can determine which grounds may apply, and familiarize attendees with “crim/imm” terms such as “aggravated felony” and “crime involving moral turpitude.”

About the Speaker:
Raha Jorjani is a detention and deportation defense attorney and runs the Immigration Representation Unit of the Office of the Alameda County Public Defender. From 2007 until 2014, Raha served as a Clinical Professor at the UC Davis School of Law in the immigration law clinic. In 2015, she taught the first course offered at the UC Berkeley School of Law dedicated to “Crimmigration.” Since 2005, Raha has provided pro bono representation and legal assistance to hundreds of immigrants – detained and non-detained - before the Immigration Courts, BIA, U.S. District Court, U.S. Court of Appeals, and California state courts.

First, we’ll briefly discuss yoga: what it is, what it is not, and the sheer breadth of what yoga encompasses. Lastly, we spend approximately one hour on yoga ethics, discovering that seven out of eight limbs of yoga don’t focus on postures, but instead on morality, ethics, conscious breathing, concentration, focus, and meditation. June 24: Artificial Intelligence for Lawyers: Ethical Concerns and Best Practices

Artificial Intelligence (“AI”) and other emerging technologies, while holding the promise of helping lawyers serve their clients efficiently and effectively, can also raise many complex ethical issues. Although an attorney’s ethical obligations remain unchanged regardless of technology relied upon in practice, in certain respects, the current rules of professional conduct may not have entirely “caught up” with emerging AI technology. 
This seminar will explore the evolution of tools leveraging AI in legal practice and will cover the ethical issues arising out of the use of AI in the practice of law. This seminar will focus on improving the ability of attorneys to understand Artificial Intelligence and the application of the Model Rules of Professional Conduct (the “Model Rules”) in leveraging Artificial Intelligence, with specific emphasis on the following:

  • Prof. Joshau A. T. Fairfield, William D. Bain Family Professor of Law Washington & Lee University School of Law,is an internationally recognized scholar in law and technology, specializing in digital property, electronic contracts, big data privacy, and virtual communities. His research explores the regulation of e-commerce, consumer protection in digital markets, and the legal applications of cryptocurrencies. His work regularly appears in leading law and technology journals, and his policy insights have been featured in The New York Times, Forbes, and the Financial Times.
    Before entering academia, Professor Fairfield was a technology entrepreneur and served as Director of Research and Development at Rosetta Stone. He has advised U.S. government agencies, including the White House Office of Technology and the Department of Homeland Security, on national security, privacy, and online safety. From 2009 to 2012, he provided privacy and civil liberties oversight for Intelligence Advanced Research Projects Activity (IARPA) initiatives. A Fulbright Scholar at the Max Planck Institute, he studied transatlantic privacy law in 2012-13. In 2013, he was elected to the American Law Institute for his contributions to law and technology.

Value-based payment (VBP) aims to transform healthcare by incentivizing providers to improve patient outcomes and reduce costs through better care coordination, preventive strategies, and increased efficiency. Yet VBPs have struggled to deliver on their promise. 
Attorney Jessica Lind Mantel will discuss a key reason for this limited progress – a regulatory framework that relies on market forces and grants payers significant autonomy in designing and implementing VBP models. This decentralized, bottoms-up approach leads to misaligned payment policies that create barriers for providers seeking to redesign how they care for patients. 
Mantel advocates for an alternative approach: value-based governance. This model emphasizes collaboration among government agencies, payers, providers, patient advocates, and other stakeholders, replacing fragmented, market decision-making with coordinated public-private efforts that foster payment alignment. Value-based governance can address other systemic challenges to health reform by advancing technical assistance programs that support providers transitioning to value-based care, improving health data-sharing infrastructures, and promoting a workforce equipped to deliver value-based care. Jessica Lind Mantel joins the Health Law & Policy Institute as co-director after eight years of service with two government agencies in Washington, D.C. She worked most recently as a senior attorney in the Office of the General Counsel for the Department of Health and Human Services. In that position she advised Centers for Medicare and Medicaid Services on legal issues dealing with Medicare matters, including implementation of the prescription drug benefit, hospital payments, incentive payments for the adoption of electronic health records, and health care reform. She previously worked as a health policy analyst in the Government Accountability Office evaluating Medicare payment issues. Prior to her service with government agencies, she practiced as an associate in the Health Care Department of the firm of Ropes & Gray in Boston and clerked for the Honorable Karen Nelson Moore of the U.S. Court of Appeals for the Sixth Circuit in Cleveland. Her research interests include the impact of various legislative and regulatory schemes on emerging trends in the health care delivery system and the allocation of limited health care resources. In 1997, Mantel received both her JD from the University of Michigan Law School and an MPP from the University of Michigan School of Public Policy. She also holds a BA in psychology from the University of Pennsylvania.

While bipartisan legislative successes have been few and far between in our highly-charged political environment, a general consensus on the need to provide a stronger framework for reviewing foreign investment in US companies led to the passage of the Foreign Investment Risk Review Modernization Act (‘FIRRMA’) in the summer of 2018. The issuance of a final rule in January 2020 implementing FIRRMA subsequently crystallized the process for CFIUS review of inbound transactions. With over 70% of U.S. adults on social media, workplace implications of social media activity present countless opportunities and pitfalls to employers. Aside from potential reputational damage, there are practical concerns when it comes to hiring practices, implementing social media policies, monitoring social media use, avoiding discrimination and harassment liability, and triggering NLRA issues. This CLE uses real-world examples of employment-related social media activity that “went viral” and provides best practices to avoid legal exposure that can come quickly and unexpectedly.

• Required and prohibited social media conduct
• Ownership of work-related social media accounts
