January 25: Researching Experts And Judges

Judges and Experts are two of the key players in any litigation. A Judge has wide discretion in all facets of a case, and it is important to know their likes and dislikes. Just as critical is to investigate the Experts (including your own) involved in a case. This seminar looks at the various types of online resources that are available to investigate Judges and Experts as well as tips and strategies on how that information might be utilized. This seminar will address how to use online resources to learn more about those individuals who hear your cases. Even if you are not the one who conducts the research, just knowing what resources are available may help you better prepare the presentation of your cases.

December 14: The Year in Review and Looking Forward to 2023: What Every California Employer Needs to Know

The past year has been extremely challenging and 2023 should prove just as challenging. There have been a number of developments that California employers should be aware of as we usher in the new year: expanded pay transparency and pay reporting obligations; expanded sick and CFRA leave requirements; a new obligation to provide bereavement leave; and CPRA/CCPA policy requirements to name only a few. Join Cozen O’Connor for our annual review of these California employment law developments. We will explain the new laws scheduled to take effect in 2023, review important U.S. Supreme Court and California court rulings, discuss pending legislation and key court decisions (including the 9th Circuit’s pending decision regarding AB 51), and, of course, review COVID-19 requirements that remain in effect. We will also cover best practices to prepare your organization for employment law compliance in the new year and beyond.

December 6: Leveraging Technology to Prepare Briefs with Greater Efficiency and Accuracy

This course focuses on the importance of accuracy and efficiency in the review and preparation of briefs and motions. In particular, it stresses an attorney’s duty of competence, which includes an obligation to accurately cite and quote legal authorities in the briefs presented to the courts, as well as the duty to cite only valid legal authorities and to disclose adverse authorities. Additionally, it addresses the duty lawyers owe to their clients to work as efficiently as possible in the preparation of briefs and motions, which includes a concomitant obligation to leverage available technologies to assist in performing these tasks. Ultimately, the course illuminates the legal technologies currently available to assist lawyers with reviewing and preparing briefs accurately and efficiently.
Topics of Discussion:
I. Explanation of the relevant ABA model rules requiring attorneys to keep abreast of legal technology to assist in servicing clients
II. Retrieving and reviewing cited authorities more efficiently with legal technology, e.g., LMO’s “get cited docs”
III. Validating citations more accurately and efficiently with legal technology, e.g, LMO’s “check cite format”
IV. Preparing and updating tables of authorities more efficiently with legal technology, e.g., LMO’s “prepare TOA”
V. Validating quotes more accurately and efficiently with legal technology, e.g, LMO’s “check quotes”
VI. Researching concepts from an opponent’s brief more efficiently with legal technology, e.g., LMO’s “find precedent”
VII. Gathering intelligence efficiently regarding companies, law firms, judges and other entities in an opposing brief using legal technology, e.g., LMO’s “find” tool

December 15: Eliminating Bias in the Legal Profession

The goal of this CLE presentation is to discuss bias and where it comes from; why it is harmful; how to detect it and how to eliminate it from our behavior as legal professionals. Practicing law is a bias landmine. From whether we believe a witness or opposing counsel; to how we counsel those in our organization we readily apply judgments to others—coloring our perceptions and thoughts. There is no cure for bias, but you can be more mindful, conscious and monitor your thoughts better. These are the four main questions we will answer in our discussion today: What is bias? What are unconscious and confirmation biases? What are the effects and costs of bias? And, finally how can we avoid bias through thinking about our thinking and implementing best practices.
