November 15: Expert Motions Under FRE 702 and Daubert

Amendments to Federal Rule of Evidence 702 go into effect December 2023 -- now's the time to prepare and review your strategy. Join us to discuss FRE 702 basics, motion strategy, and the effect of the new amendments to the rule.
FRE 702 governs the admissibility of expert witness testimony in litigation. Following FRE 702's enactment, the Supreme Court decided Daubert v. Merrell Dow Pharmaceuticals, Inc., providing a framework on how courts should evaluate expert opinions for their admissibility, which was incorporated into later amendments to the rule.
The recent amendment addresses the standard of proof and the burdens involved in demonstrating the admissibility of expert opinions. We'll look at how things might change when the new rule comes into effect.

October 16: When Doctors Become Cops

The lines between law enforcement and health care are blurring. Police lean on doctors to provide them with genetic samples, prescription histories, and toxicology results that they could not obtain on their own. This often occurs without a warrant or the patient's consent. At the same time, legislatures are using physicians as regulatory levers to police pregnant and transgender bodies. And due to chronic underfunding of social services, many Americans now receive pseudo-mental health treatment through the courts rather than clinics.
Together, these things paint a sinister picture of law enforcement being thrust into medicine in ways that are deeply troubling and vastly under-explored.

Teneille Brown is the James I. Farr Professor of Law, the Associate Dean of Faculty Research, and the Director of the Center for Law and the Biomedical Sciences (LABS) at the S.J. Quinney College of Law. She is also a faculty member in the Center for Health Ethics, Arts, and Humanities (CHeEtAH) in the department of Internal Medicine. She graduated from the University of Michigan Law School, and completed three post-doctoral fellowships at Stanford, one in the Center for Law and the Biosciences, one on the MacArthur Project for Law and Neuroscience, and one at the Stanford Center for Biomedical Ethics. Her research is highly interdisciplinary, and spans a wide range of issues at the intersection of law, genetics, neuroscience, medicine, and ethics. December 14: Ethical Selection and Extrapolation of Construction Defects

Extrapolation in construction defect (CD) litigation is a hot button issue that has been driving defendants crazy since the 1990’s. It’s hard to believe, but this issue has only recently been addressed well.
Expert consultant opinions are rooted in observational data that drive CD litigation. However, experts often only look at or test a few locations rather than 100%. This means experts are using a (sometimes small)sample to extrapolate conclusions about the overall population and the project. Looking at the math, there is nothing inherently wrong with this.... At least not in theory.
The Scientific Method is the foundation of modern technology; everyday scientists in all fields are making observations, developing hypotheses, making predictions, conducting tests, and comparing their findings to their hypotheses before finally drawing a conclusion. It is common for scientists to extrapolate their findings based on a sample, but every scientist knows that their results are only valid if the sample is truly representative of the population. Scientists are very careful about how they choose their samples, knowing a poor selection creates biased data that is impossible to extrapolate accurately.

November 15: An Introduction to the Military and Veterans Rights Bureau & Consumer Protection Resources

PILI is pleased to partner with the Illinois Bar Foundation in support of its 2023 Week of Service. As part of that effort, PILI will present two CLE programs focused on how to help veterans and members of of the military with certain legal issues they may face. These programs are also being offered in conjunction with PILI’s Virtual Pro Bono CLE Series.
Join us for this 1-hour CLE presentation to learn more about the Office of the Illinois Attorney General Military and Veterans Rights Bureau. Randall L. Tyner, Senior Assistant Attorney General, Military and Veterans Rights Bureau, will present on the types of issues their office handles and resources they provide. Additionally, our speaker will cover common frauds and scams targeting veterans and their benefits. This training will be helpful for any attorney who works with veteran clients, including volunteers on Illinois Free Legal Answers or through the Illinois Armed Forces Legal Aid Network (IL-AFLAN), to help spot clients who may be victims and know where to refer them for help.

November 13+15: Eliminating Bias in the Legal Profession

The goal of this CLE presentation is to discuss bias and where it comes from; why it is harmful; how to detect it and how to eliminate it from our behavior as legal professionals. Practicing law is a bias landmine. From whether we believe a witness or opposing counsel; to how we counsel those in our organization we readily apply judgments to others — coloring our perceptions and thoughts. There is no cure for bias, but you can be more mindful, conscious and monitor your thoughts better. 
These are the four main questions we will answer in our discussion today:
