This program will focus on issues relating to incorporating and obtaining tax exempt status for nonprofit organizations. Specific issues to be covered include: fiscal sponsorship as an alternative to forming a new organization; evaluation of whether an organization qualifies as tax-exempt; selection of the appropriate tax-exempt status; choice of state law and legal structure; preparation of governing documents; “best practice” policies for conflicts of interest, whistleblowers and document retention; preparation of applications for state and federal tax exemption; review of annual filing requirements; issues regarding unrelated business income, fundraising and charitable solicitation registrations; liability issues for directors and officers; and any other issues that relate to nonprofits that attendees may raise.
