May 21: Protecting Your Canna-IP: What You Should Know, Now

With the rapid growth (and normalization) of the U.S. and international cannabis industries, sufficiently protecting the intellectual property of your brands and innovations is a key consideration for those working in this industry. As always, because cannabis remains classified as a Schedule I drug under U.S. federal law, this presentation addresses the unique challenges the cannabis industry faces in obtaining and enforcing intellectual property rights in this space. For example, this presentation will provide an overview of the current status of U.S. canna-patent, canna-trademark, and canna-copyright laws, which include: 
  • Seeking federal and state trademark protection for cannabis brands.
  • Federal copyright protection for original works of authorship involving cannabis.
  • Patenting cannabis innovations, including devices and methods surrounding all aspects of the cannabis industry (as well as the plant itself).
  • Challenging and enforcing cannabis IP (particularly canna-patents) in light of recent PTAB and district court proceedings.
