September 3: Transferring Data Across a Schrems-Muddied Pond


Transatlantic data transfers have never been murkier. The European Court of Justice’s judgment in Schrems II—which invalidated a popular cross-border data transfer mechanism and arguably redefined another—has left global commerce, including a $7.1 trillion transatlantic economic market, in a contracting and compliance quagmire.
With data as the bedrock of the digital economy, how can multinational businesses continue to transport information from the EU with the demise of the Privacy Shield? Our discussion will include implications of the newly mandated adequacy assessments for standard contractual clauses and binding corporate rules.
