With data security incidents and data breaches happening daily, it’s important for attorneys to turn towards one reality—it’s NOT IF a breach or incident will occur—it’s WHEN. 

These incidents are forcing government agencies, companies, law firms, etc. to address, define, and handle these challenges. As cloud technology and big-data analytics have become the norm, cybersecurity risks have increased and it is more important than ever to have both an avoidance and a response plan in place.

 During this 60-minute CLE session, we will cover

It is an implied warranty or contract, meaning it does not have to be an express contract, covenant, or provision of a contract. It is a common law right of a tenant or legal doctrine.” Although there is no concise, statutory definition of the term, there are LOTS of regulations mandating the minimum performance requirements of residential property being rented by owners to tenants.

This presentation is a 1-hour walk through Pete Fowler Construction Services’ (PFCS) Construction Claims Analysis Method applied to Habitability Claims brought by residential tenants against landlords. No two claims are the same, but our analytical method walks us through a professional investigation and analysis, like how the scientific method aids in discovery of the workings of our natural world, regardless of the specifics of the claim.

September 25: Constructed Movements: Extraction and Resistance in Mexican Migrant Communities

Professor Shah's book Constructed Movements examines migration from the perspective of Mexican migrant communities including migrants themselves, their family members and community organizers. These perspectives, gathered over five years, and in four diverse geographic areas of Mexico, form the basis of the book's key insight that migration is part of a larger cycle of colonial extraction from marginalized Mexican communities to benefit Mexican and U.S. elites. The book also profiles community resistance to the extractive cycle of migration and outlines possible ways that U.S. policies could be shifted to recognize and reverse migration as extraction and support the abolition democracy work being done by Mexican migrant communities.

Since taking office on January 20, President Trump has issued a far-reaching series of executive orders targeting key areas of federal policy—from the legal profession and education to immigration and administrative governance.
This session places these actions in historical and constitutional context, tracing the evolving boundaries of executive power and the legal mechanisms intended to check it. It will also explore how these orders compare with prior exercises of presidential authority and how they fit within established constitutional frameworks.
The program will examine recent and ongoing litigation challenging these executive actions, highlighting the standards of judicial review and the courts’ role in preserving the separation of powers. It will also assess the legal strategies employed in opposing and defending executive orders, and evaluate the broader implications for presidential authority and the resilience of rule-of-law norms in an increasingly polarized political climate.

About the Speaker:

Jim Hilbert is currently professor of law at Mitchell Hamline School of Law where he has taught full-time since 2010. He is the former interim president and dean (2023–24) and former vice dean (2020-2023) at the law school and currently also serves as Senior Fellow at the Dispute Resolution Institute. He teaches Transactions & Settlements, Civil Rights, Education Law, Expert Witness Advocacy, Deals & Dispute Resolution, and International Business Transactions. He is a long-time executive committee member of the St. Paul NAACP. He is also ad hoc counsel for the State NAACP. In addition, Professor Hilbert is the co-director of the Expert Witness Training Academy, which was funded by the National Science Foundation and provides training to climatologists on communicating in courtrooms and legislative hearings.
